4TH OF JULY THURSDAY NEWS 2013

Happy 4th of July!

Get out and party. Party for me, I’m working on the news. A brother said, “Why don’t you just post a note that you’re riding to a party, and shine the news?”

I can’t do that. Besides the news never stops. I would never be able to catch up. I just need more whiskey and a new redhead to help out.

About the time we think about relaxing the gate cracks, new parts arrive, and the dog shits in the corner. Or the new contractor, Red from Pedro calls, “I can start tomorrow.” Or the brother at the tow yard next door announces, “You could have that boat for a song.”

Holy shit, let’s hit the news:

The news is sponsored in part by IronWorks and Cycle Source Magazines

MONGOLS MOTORCYCLE CLUB AUSTRALIA FIGHT BACK–
On June 15, 2013, an article written by a Robyn Wuth, and titled “Mongol hordes descend on the Gold Coast as more patched bikies hit Glitter Strip,” appeared in the Gold Coast Bulletin.

This article essentially portrayed Mongols Motorcycle Club Australia members as a group of grievous criminals with an acute and incurable case of Psychopathy. We find it bewildering that such ridiculous, bordering on outright senseless assertions can be presented as fact.

Just a modicum of research would have discovered that our members have families, regular jobs or are respectable businessmen in their respective communities. Also given that our club has not had any media exposure in the states where we have a presence, that no member has ever been interviewed or even approached for that matter, on what bases are we being portrayed as operating some kind of empire on the Gold Coast where we are non extant?

As a club we firmly believe in freedom of the press, however, do not believe that freedom extends to writing articles about individuals and organizations based on untruths and misrepresentations.

No one from the Mongols Motorcycle Club Australia was ever approached in order to attain facts about the club or endeavor to test the veracity of the statements made. We tend to believe failure to follow protocol was due to either sheer incompetence of the journalist and the publishers or fear that the actual truth would have gotten in the way of an agenda to which we are not privy.
The headline image used in the article is three years old, two of the three men in it are no longer with the club, and have not been for quite some time.

Another image is also years old and is of an American member, however previously we did have two members visiting from Germany & France who were involved in building a custom motorcycle for a contest. The business to which the article refers was only the location where one of these members was building this custom motorcycle. It is not a club owned business.

Further, Mongols Motorcycle Club Australia is not “muscling in” anywhere, nor has it ever done so. That is a fact, and a matter of public record.
Moreover, we categorically and emphatically repudiate ever having any issues whatsoever, with any club whatsoever, in this country. Mongols MC policy is simple, and clearly stated on our Australian website, we are about brotherhood and motorcycles. We have no “business interests,” on the Gold Coast, so what is it we are meant to be “muscling in” on?

Additionally, the alleged police comments within the said article are wildly inaccurate, extremely irresponsible and inexplicably inflammatory. Why would any responsible officer of the law wish to imply issues exist between the Mongols Motorcycle Club Australia and other Australian clubs when there clearly and knowingly none exist.

In closing, the article in question is devoid of facts, maligning of the club and its members and highly defamatory. We demand from the journalist and the publisher a public apology and an immediate retraction as a mistake of Facts.

Motorcycle Only Checkpoint H.R. 1861 – Needs your SUPPORT now!–
Congressman James Sensenbrenner (Wisconsin) introduced a bill to prohibit the federal funding of motorcycle only roadside checkpoints. Sensenbrenner has always been an MRF Champion and he needs your support now on this bill.

As we approach July 4th, our Nations Independence Day this is a perfect opportunity for you to use the system that our founding fathers set in place to make a change for the better. The bill, H.R. 1861, has nine original co-sponsors however, we need many more to pass this landmark legislation. Call your congressman and ask them to support H.R. 1861.

Sensenbrenner had this to say in a ‘Dear Colleague letter’ that is circulating in the House of Representatives; ‘In the 112th Congress, I introduced H.R. 904, a bill to prohibit the Department of Transportation (DOT) from providing funds to state and local authorities for the purpose of creating motorcycle only checkpoints. Section one of the Stop Motorcycle Checkpoint Funding Act contains the same language as H.R. 904. However, this bill also contains language to force the DOT to focus motorcycle safety efforts on crash prevention programs, not national helmet mandates.’

It’s important to contact your sitting member of the House of Representatives and ask them to be a co-sponsor of this important legislation. Ask them to contact Congressman James Sensenbrenner and lend their support as co-sponsor of H.R. 1861.

READER REVIEWS BIKERNET SPONSOR PRODUCTS–Just a little feedback on one of your advertisers. I checked into the Pulstar product with the thoughts of changing out the plugs in my basically stock ’05 Road King Custom.

I must say that after a few hundred miles there is a difference in response and power. Even though its stock there is a little more punch in the old girl. Have you tried these plugs in any of your rides?

I was initially going to order online but after talking with a rep from the company she told me the plugs could be purchased locally from an auto parts store thus eliminating the twelve dollar shipping charge which was really excessive. There was only a few cents difference in price.

I did mention I had seen the ad on your banner page.

Interesting that you wrote about Pulstar plugs. I recently messed with my mudflap girl and asked a tech friend about gaps. He recommended .035 for an Evo with an electronic ignition. I changed my gaps from .042 to .035, and my bike ran substantially smoother. I can’t wait to try Pulstar. Thanks for the feedback and mentioning Bikernet.–Bandit

ZERO MOTORCYCLES AND HOLLYWOOD ELECTRICS SET RECORDS AT?2013 PIKES PEAK INTERNATIONAL HILL CLIMB
— Zero FX Sets Fastest Production-Based Time Ever in Exhibition Powersports Class.

Zero Motorcycles and Hollywood Electrics, leaders in all-electric motorcycles, made history on June 30, 2013, at the 91st running of the Pikes Peak International Hill Climb (PPIHC). In a historic weekend of racing that saw an electric motorcycle set the fastest overall time in the motorcycle division, Zero Motorcycles and Hollywood Electrics made history of their own with six production-based Zero Motorcycles that all competed and finished with impressive times.

Jeff Clark, riding a 2013 Zero FX, was the fastest of the production-based group with a 12:00 flat run up the mountain, setting a new record for production-based electric motorcycles and putting him inside the top half of all motorcycles entered in this year’s event.

Clark was closely followed by BE-EV.com sponsored rider Jeremiah Johnson, riding a 2013 Zero S and finishing in 12:05. Rounding out the podium with a time of 12:24 in the special Exhibition Powersports Class – Z was Motorcycle.com editor and test rider Troy Siahaan, competing on a 2013 Zero FX. All three finishing times were faster than the previous electric motorcycle record time set by Chip Yates in 2011.

“This week exceeded all expectations,” said Harlan Flagg of Hollywood Electrics. “We came prepared and ready to race, but were blown away by how smoothly it went all week. Even after several crashes during practices days, one that sent a bike flying off a 15 foot embankment, the motorcycles only suffered superficial damage, a testament to how well designed these machines are by the engineering team at Zero Motorcycles. We came to prove just how much fun and how competitive electric motorcycles can be, especially production-based motorcycles, and I believe we proved a point.” Flagg concluded by stating, “A big thanks goes out to all the riders, sponsors and support crews for making this happen. It was truly a historic weekend for electrics and for Zero Motorcycles.”

This year marks the first ever Electric Motorcycle Division in PPIHC’s 91 year history. In addition to the top three finishing Zero riders, team members Ted Rich (12:53), Nathan Barker (13:14) and Brandon Miller (13:16) set impressive times as well. Hollywood Electrics organized and managed the efforts with motorcycles and technical support from Zero Motorcycles, represented onsite by Media Relations Coordinator, TJ Aguirre.

Hollywood Electrics entered several different model Zero Motorcycles in the event, including a number of stock and modified motorcycles. Hollywood Electrics has been an authorized Zero Motorcycles dealer for four years and is Zero’s number one dealership in sales.

In addition to Hollywood Electrics, Zero Motorcycles dealer network has grown to over 50 dealers in the United States and Canada alone, as well as a very robust and growing dealer base in Europe. For more information on Zero Motorcycles visit www.zeromotorcycles.com.

VIEWERS WILL FLIP FOR THE SHOWROOM SHOWDOWNS IN VELOCITY’S ALL NEW SERIES DALLAS CAR SHARKS–
DALLAS CAR SHARKS World Premiere on VELOCITY Tuesday, July 23 at 8:30PM ET–
(Silver Spring, Md.) – Auction surprises aren’t exclusive to storage containers – sometimes the drama unfolds on four wheels. Velocity’s all-new series DALLAS CAR SHARKS takes viewers to the Lone Star State where car enthusiasts from across America gather to participate in the ultracompetitive world of car flipping.

Here tough-talking, larger-than-life dealers compete to outbid and out-buy each other in the intense world of automobile auctions. They love the thrill of the bid nearly as much as the incredible cars they’re working hard to win, but are sometimes in for a rude awakening when the car they’ve won turns out to be a lemon. Velocity rolls out DALLAS CAR SHARKS beginning Tuesday, July 23 at 8:30 PM ET/PT.

In each episode of DALLAS CAR SHARKS, tempers flare and rivalries ignite over any number of cars ranging from a 1980 Corvette to a 1998 Official Indy 500 Pace Car. After winning the bidding wars the real work begins for the car sharks. Now they have to get down and dirty to inspect their purchases, and what they find under the hood reveals the true value of their skills on the bidding block. Each contender has his or her own distinguished reputation and unique bidding style in the auto flipping world. DALLAS CAR SHARKS features its fair share of personalities including:

•Tommy “The King” Spagnola, a true Texas family man who turns tough when it comes to turning over cars. “The King” has been in the business for 30 years with a family-run auto lot featuring a massive, museum quality show room.

· Ash “The Wise Guy” Rabah is the sometimes cocky, independent dealer who goes after cars across the spectrum and whose brash personality puts him smack dab into conflicts with the other sharks, especially Tommy.

•Martha Davis, known as “Mother Hen”, battles with being a woman in the used car world but is determined to succeed in order to provide for her family. “Mother Hen” loves to compete with and get the best of the “big boys”.

•JD Cole, Martha’s son, lives more on the edge than his mother does, taking big risks on flashy cars, much to his mother’s chagrin.

“DALLAS CAR SHARKS combines all the drama and big characters of an auction show in a style that is uniquely Velocity,” said Robert Scanlon, senior vice president of Velocity. “This series goes inside the art of the deal to show the level of competition and adrenaline that drives this market. It’s addictive television.”

DALLAS CAR SHARKS is produced for Velocity by AMS Pictures. Executive producer is Andy Streitfeld and senior producer is Randy Martin. David Lee is executive producer for Velocity. Robert Scanlon is senior vice president of Velocity.

NEW OUTLAW CULTURE BOOK COMING—Bandit, I doubt if you remember me from the ‘70s but I have written a book about the outlaw culture of those years in Salt Lake City and the rest of

UNCLE MONKEY ON THE RETURN OF THE CODE OF THE WEST–Standing outside my niece’s wedding I watch as the familiar rumble of a Harley’s exhaust draws the men’s attention as well as more then a few of the women. There is something primal in the sound of a Harley. Men want to ride them and women want to ridden by the men on them.

Times are changing. The outlaw scourge of the land has been replaced with doctors and lawyers and well-meaning white-collar workers who are baffled by changing a light switch cover. A biker use to be good with his hands, ready to think out of the box to solve problems, adapt, rectify, and exemplify what being a man was. Sadly the Code of the West has been wiped away with each swipe of a credit card. Grown men shy away from lending a helping hand to a stranded brother on the road, afraid to reveal their inadequacies when all that was required was a listening ear to be a sounding board.

I try to instill what being a man is to my son. It means opening doors for others, offering a comforting arm to an elder to steady themselves. Letting a little girl dig her heels into your feet as she balances on your once shiny shoes, as you dance her around the dance floor at a wedding. Respecting and listening to others’ opinions while standing strong for your own beliefs.

Motorcycles, while rolling canvases of art, harkens back to simpler times. A time when a man’s word was worth something, when life moved at a slower pace, when you could stop the world and appreciate the finer things in life like a good woman on your arm, a fine glass of whisky, merry music and fellowship.

The time has come to pick up that tattered flag, brush away the cobwebs and lead this great nation.

NORML REPORT: CANNABIS COMPOUND REDUCES CIGARETTE CONSUMPTION IN TOBACCO SMOKERS–London, United Kingdom: The inhalation of the non-psychoactive cannabinoid CBD (cannabidiol) significantly mitigates tobacco smokers’ desire for cigarettes, according to clinical trial data published online in the journal Addictive Behaviors.

Investigators at University College London conducted a double blind pilot study to assess the impact of the ad-hoc consumption of organic CBD versus placebo in 24 tobacco-smoking subjects seeking to quit their habit. Participants were randomized to receive an inhaler containing CBD (n=12) or placebo (n=12) for one week. Trial investigators instructed subjects to use the inhaler when they felt the urge to smoke.

Researchers reported: “Over the treatment week, placebo treated smokers showed no differences in number of cigarettes smoked. In contrast, those treated with CBD significantly reduced the number of cigarettes smoked by [the equivalent of] 40 percent during treatment.” Moreover, participants who used CBD did not report experiencing increased cravings for nicotine during the study’s duration.

Investigators concluded, “This is the first study, as far as we are aware, to demonstrate the impact of CBD on cigarette smoking…. These preliminary data, combined with the strong preclinical rationale for use of this compound, suggest CBD to be a potential treatment for nicotine addiction that warrants further exploration.”

Previously published clinical trials on CBD have found cannabidiol to be “safe and well tolerated” in healthy volunteers.

Separate investigations of CBD have documented the cannabinoid to possess a variety of therapeutic properties, including anti-inflammatory, anti-diabetic, anti-epileptic, anti-cancer, and bone-stimulating properties.

Jared Blake Announced at Easyriders Saloon During 2013 Sturgis Motorcycle Rally–
Easyriders Saloon, Sturgis’ top destination during the annual motorcycle rally and your free ride for top shows, is proud to announce Jared Blake performing this August. With a show every day from Aug. 1-10, Blake will be just one of many acts showcased at Easyriders Saloon during the 2013 rally.

Jared Blake grew up in the small town of Star City, Ark., and always had big dreams of performing on the big stage, but that didn’t stop him from taking his time growing up and learning everything he could about the business, songwriting and playing multiple instruments.

His willingness to keep going, not knowing, landed him on national television. Blake found himself on an adventure into what turned out to be the No .1-rated show on NBC, “The Voice.” So, he did what any regular ol’ country boy would do…he rocked it! All of his performances appeared on the charts worldwide more than 56 times, reaching as high as No. 16.

Blake was featured in magazines such as People and Rolling Stone, television morning shows and radio stations syndicated across the nation. He began a national acoustic tour the last week of the show airing, promoting a single his fans selected.

In June 2012, Blake was offered a recording deal with Skiddco Music and began working on his first full album, scheduled to release summer 2013.

There’s no doubt Blake’s voice is one of the most powerful voices to hit the country genre, and once heard it’s never forgotten. The no-frills production is enough to entertain any crowd. For that, he has played with artists like Lee Brice, Thompson Square, The Band Perry, John Rich, Randy Houser and headlined or opened for events like The Lonestar Rally, Sturgis Bike Rally, Country USA and more.

Blake’s newest single was released in June 2013, titled “Countryfied.”

As always, all shows at Easyriders Saloon are completely free. For the full event schedule, visit www.easyriderssaloon.com.

PANHEAD RESTORATION EFFORT FEATURED ON BIKERNET—Author’s note: 90% of the parts I used were from J&P Cycles with the exception of a few swap meet finds and the dual electronic ignition from a previous chapter. Seat was from Ebay. It’s a replica ’48 tractor on pogo.

Pipes are Paughco. It looks like a Primo belt drive. The only clue I had was a clutch spacer that was left out for some reason. I contacted Ben at Primo, and he filled me in, and said It was an early unit and I was to install the spacer. –Gunner

Mikuni HSR48 Performance Carburetor Kit for American V-Twins–Mikuni’s high performance HSR48 Flat Slide Racing Carburetor is the must have for highly tuned increased displacement American Big Twin motors. This smooth-bore carburetor offers the highest air flow possible while providing highly accurate fuel metering, more power, and Mikuni’s renowned precision throttle response. A new extended main jet and larger fuel valve assure ample fuel supply for very powerful and larger displacement engines.

The HSR48 offers all the same features and big performance gains as the popular Mikuni HSR42 & HSR45 Carburetors for stock and mildly modified Harley-Davidson and other V-Twins. All HSR carburetors are designed with an 8-roller bearing flat throttle slide assembly that allows an unobstructed venturi at full throttle to flow more air, while it mixes fuel more precisely at all throttle settings.

Mikuni’s roller bearing throttle slide offers smoother throttle control and allows the use of a lighter throttle return spring for reduced throttle effort. And the Mikuni adjustable accelerator pump provides instant throttle response in any riding or performance application. While a high capacity float bowl prevents fuel starvation even under full throttle applications. The new HSR48 comes complete with rubber mounting flange, choke cable, remote idle adjuster and additional jetting.

Mikuni Aftermarket Carburetors and Tuning Components are sold “As Is” for Off Road / Racing Use Only and are not intended or approved for use on vehicles operated on Public Roads or in Locations where applicable engine tampering and anti-pollution laws apply. Mikuni Carburetors, Tuning Components, Replacement Parts and Rebuild Kits and available from Mikuni Dealers and Distributors in the USA and Worldwide and are shown in the complete Mikuni Carburetor Products Catalog on www.MikuniPower.com.

Legends and Heroes to Honor Michigan MX Champ, Kirk Bigelow–

Motocross pioneer Kirk Bigelow to be recognized at Lucas Oil Pro Motocross National at RedBud.

July 3, 2013 – Encinitas, CA – This Saturday, July 6, The Legends and Heroes of Motocross Tour will recognize an MX legend local to Michigan, Kirk Bigelow.??

Bigelow came from a family of racers and grew up riding motorcycles with his brothers Chris, Kip and Craig. Kirk’s first race entry was in 1971 on a Bultaco 100, competing at Michigan’s Green Acres. “Those were the days when we would race three classes with three motos each just to get our riding fix,” stated Kirk on his early motocross memories.

As Kirk graduated to a Penton, a mix of scrambles and MX were the norm for the young racer. Dynamics Cycle noticed Kirk’s passion and offered him his first sponsorship in 1974, in which he would ride a TM125. His brother Kip and Craig soon joined the team as well and the three became a formidable force in AMA amateur racing. Team Dynamics was one of the first sponsored race teams in the area and was widely supportive in promoting motocross in Michigan.

In 1977, Kirk was signed on as a support rider for Yamaha, but soon made the jump to team Kawasaki just a year after going pro. Kirk was then banging handlebars with the likes of Jimmy Weinet and Danny LaPorte, and capturing notable finishes across the board. Sadly, Kirk’s racing career was forced to end in 1981 when he severely injured his femur.

“In the mid 70’s, Kirk and the Dynamics Team were a challenging force to be reckoned with. I can remember word reaching us here on the east coast of this team of brothers as well as their buddy Rusty Hibbs who were making a mark for themselves,” states Alex Moroz, managing partner for the Legend and Heroes Tour. Kirk Bigelow will be honored on the Lucas Oil Podium stage at RedBud this Saturday July 6 at noon. Join Kirk and his friends at the Legends and Heroes display between motos for a meet and greet with the champ.

FIRE FIGHTERS GUARDED BY BIKERS–
They sent in the big tankers today for the fire. It has been devastating to say the least.

We gathered bikers in our state to stand guard for a candle light service last night because the WBC has posted they are going to protest the funerals for the 19 dead hotshot firefighters.

Either way the LE and the bikers provided a very respectful watch and worked together which was awesome!

WEEKLY S&S BARGAIN–By popular request, S&S Cycle has released a pair of new nylon mesh pre-filters for our award winning S&S Super Stock Stealth air cleaners.

These pre-filters are similar to the one we offer for the S&S Single Bore Tuned Induction system, and are constructed of sturdy, great looking, black nylon mesh with an S&S logo on the top side.

They add another level of filtration to keep gravel and larger particles of grit from the exposed parts of the air filter element, preventing premature clogging of the filter. The new S&S pre-filters are great for the S&S Bobber and Muscle air cleaner covers that leave a lot of the filter element exposed.

Available for the standard and 1” taller performance filters.

S&S Pre-Filters
Standard Stealth Air Filter 170-0193 MSRP $24.95
1” Tall Stealth Air Filter 170-0197 MSRP $24.95

TOM CALDWELL/OLD GUYS DO RULE RACING WINS at the AMRA SUMMER SHOOTOUT at BOWLING GREEN–It was time for Tom Caldwell/OLD GUYS DO RULE RACING to go to the AMRA Summer Shootout in Bowling Green, KY.

Caldwell, “Again, we were fortunate to be sponsored by Trammel Creek Cycle Works in Adolphus, KY. Great friends and supporters! And as much as we looked forward to attending, everyone knows it is hot and humid there especially in June. Performing well is a challenge.”

Caldwell had prepped the bike and evaluated the data gathered from the NHRA Atlanta race and winning the AMRA Hagerstown race. He was looking to improve on his performance at the AMRA Bowling Green event.

“We had a great showing of 7 bikes in Pro Gas, including the return of former champion, Andy Simon . I ran a few T&T runs Friday evening and my best was a 8.18 @ 166 mph. By Saturday with a heavy headwind, the humidity rolled in. The air was averaging at 3800 feet. I qualified #1 with a 8.060 at 163.77 mph, I wanted to back up the 8.06 in the 3rd qualifying round to reset my ¼ et record but the air was heavy with the humidity, the track was hot and slick so, those plans changed.”

“In the 1st round of eliminations on Sunday since, I had earned the bye run so, I tried a different clutch package and it did not work as well as I thought. But critical data was obtained for a later date. In the second round I ran Donnie Huffman on Pee Wee Bynres GroundZro bike and won with a 8.18 @ 161 to his 8.470. I ran Billy Doherty in the final and won with a 8.163 @ 162.26 to his 8.389. I missed resetting my et record by .0224 seconds. Next time!”

This is Caldwell’s second consecutive AMRA win placing him 35 points out of 1st place in Pro Gas.
Caldwell’s looking forward to AMRA Xenia, Ohio to earn more valuable championship points.

We are working hard to make 2013 another great year for OLD GUYS DO RULE RACING, with 2 wins and one runner-up to date.

KENTUCKY LEGISLATIVE ALERT–On July 22nd at 1pm in the Capitol Annex in Frankfort
the KMA/KBA will be testifying on three issues that came up during the last legislative session. The hope is that all questions / concerns that the legislators have on these bills will be answered prior to the session allowing for easier passage.

If you are able to attend we would love to fill the room. Please wear your leathers and if you have been affected by any of the following issues please send me an email describing your situation to president@kmakba.com We will relay those stories to the committee members. Here are the issues we will testifying on:

•Right of way violatons / Vulnerable users bill – this bill would increase penalties for car drivers that injure or kill a biker due to negligence of some type.

•Being able to turn left at an intersection where the traffic signal is inoperable or does not detect the motorcycle.

•Allowing motorcycles to park in municipal parking garages. Some garages, mainly in the larger cities, have banned motorcycles from using these facilities.

Thank you in advance and hope to see lots of you there. If not as you see your legislators over the summer at the various county fairs, church picnics aand such please be sure to menition that we are in support of the above issues.

BORN FREE SHOW BIKES FOR YOUR REVIEW–More of the show bikes, they all have a sign with them. Again, one was to be given to a raffel ticket holder.

Many of the “ride in” / “display” bikes could be in the show.

The crowd picture is that of the awards presentations. I have never seen so many people hang around for trophies.

And they didn’t even have any hot trophy girls for bait.

Monday at the crack of Dawn hit the streets in SoCal at 3/4 throttle, by noon it was full throttle and haulin’ ass. With 51 days until the BUB Speed Trials and your 5-Ball Racing Teams date with the Salt Gods of Bonneville. After a full day picked up Dr. Willie in Long Beach and rolled to Lake Elsinore to meet our local used Busa parts guy. We scored a complete headlight assembly for our street legal and tagged non-track riding days. We’ll mount in a 1/4 fairing built by Air Tech Streamlining with an any-day expected arrival.

While in Elsinore we found a slightly damaged (we need measurements only), Busa front wheel for Colorado Customs Crew to measure for carrier bolt-hole locations. On a mission, I rolled to the next destination.

Wednesday afternoon arrived in Corona at the Race Tech Suspension Headquarters. First person I ran into was Paul Thede, the Founder and visionary of a 50-location global business. Happy employees around the globe living the motorcycle dream on a daily.

The suspension from axel to axel is dialed in with new top shelf pieces, aligned, and spring rates are on the money. An in depth suspension report is in the making.

Wednesday evening Dr. Willie attacked the Raycer, preparing for a dyno session in San Jose Friday evening before rollin’ to the Hollister show on Saturday.

BIKERNET UNIVERSITY ENGLISH DEPARTMENT CONFUSING CONUNDRUM OF THE DAY–dandy DAN-dee, noun:

1. Informal. something or someone of exceptional or first-rate quality: Your reply was a dandy.
2. a man who is excessively concerned about his clothes and appearance; a fop.
adjective:

2. Informal. fine; excellent; first-rate: a dandy vacation spot.

But I actually was fine and dandy. I didn’t have to put it on.

— Saul Bellow, Humboldt’s Gift, 1975

Oh, will you? Oh, won’t that be just dandy? Now I just know I can get that coat. I just know they’ll let me have it, if I talk to them right.

— Theodore Dreiser, An American Tragedy, 1925

Yankee Doodle keep it up, Yankee Doodle dandy…

— Traditional, 1770

The MRF looks forward to working Secretary Foxx in his new position.

South Australian Government to close loophole in anti-bikie legislation to reduce risk of challenges by gang lawyers–The State Government will today act to close a potential loophole in its controversial anti-bikie legislation to reduce the risk of challenges by gang lawyers.

The pre-emptive strike – which is the second time the legislation has been amended – will now clear the way for police to lodge applications in the Supreme Court to have several gangs declared criminal organizations.

The applications have been held up after concerns stemming from a High Court judgment in March.

Attorney-General John Rau will today introduce amendments to the Serious and Organized Crime (Control) Act that will “fine tune” elements of it – principally concerning the appointment process for a judge to hear the application – ahead of the looming police action.

Mr Rau said he hoped to have the SOCCA Amendment Bill dealt with by the end of this month to enable police to quickly move against the gangs and reduce the risk of a lengthy appeal that would delay any outcome.

“I thought it was pretty well bulletproof before, but this probably adds an additional degree of safety to it,” Mr Rau said.

“Given how much work police do in getting one of these applications prepared, every little bit of safety we can build into the process is worth it.

“It would be a tragedy if they went through all of that effort and then got knocked over on a technicality.”

The Advertiser revealed in March that senior police were on the brink of lodging applications in the Supreme Court to have the Finks, Hells Angels and Rebels outlawed.

The applications – the Finks will be the first – will be the first since the Supreme Court and then High Court in 2010 ruled the government’s anti-bikie legislation invalid, forcing it to heavily amend key sections.

Those amendments – the most significant removing the Attorney-General from the declaration process and placing it with the Supreme Court – were passed in June last year and police have been working on the applications since then. They were stalled following an appeal in the High Court in March initiated by the Finks in Queensland. The Finks appealed against a Queensland Supreme Court decision to outlaw the gang there.

While the the High Court decision upheld the Queensland Supreme Court decision, it highlighted several areas in the legislation that needed amendment.

Mr Rau said a thorough examination of the High Court judgment by Solicitor-General Martin Hinton, QC, had established there were potential areas that could possibly be appealed in the amended SA SOCCA legislation – the major one being the appointment process for the judge hearing the application.

“This is fine tuning on legal points,” he said.

The key section that will be amended concerns the appointment by the Chief Justice of an “eligible judge” to hear the police application lodged against any gang.

The amendment will see the court appoint a judge, rather than one being appointed by the Chief Justice. This will bring the legislation into line with that in NSW, the NT and Victoria which is also adopting that method.

Other minor amendments will see provision for an approved person to make oral or written submissions to the court during any application, provision for that person to be cross examined and for a person to make an application for any declaration made by the court to be revoked.

Another amendment will allow the police application and supporting affadavits made available to any person “the court considers” should be provided with the opportunity to inspect them.

Analysis: Nigel Hunt – Make no mistake, the bikies will fight the amended laws

To the average punter, South Australian Attorney-General John Rau’s move to tweak the government’s anti-bikie legislation will mean next to nothing.

But to the high-flying silks who will be engaged by the respective gangs to fight its use in the Supreme Court, it could be the difference between winning and losing the appeals that will inevitably follow.

Make no mistake, the bikies will fight police moves to use the Serious and Organized Crime (Control) Act – under which they can be declared a criminal organization and rigid association orders invoked against gang members – with as much zeal, and money, as they can muster.

The Finks did it in 2009 and won their appeal against sections of the legislation in the Supreme Court. They fought the government’s subsequent appeal to the High Court in 2010 and won that.

Lawyers acting for the gangs have been preparing for police to use the legislation since amendments to rectify the faults identified in the Supreme Court and High Court were proclaimed last June. They were primed and set to challenge the section of the Act that is now being amended – the appointment process of the Judge to hear any application.
While an obscure, technical ground for an appeal may be about to be remedied, no doubt there will still be appeals launched based on the overall philosophy of the Act, that is, targeting an individual’s right to associate with whoever they want.

It is inevitable the government will be questioned over yet another delay in tackling the bikies. But Mr Rau is quite correct in what he is doing. Any steps that can make the legislation appeal proof should be taken before police make their move on the gangs.

There will also be those who question why such action is needed at all. It is no surprise that since The Advertiser revealed in March that police were set to lodge applications to have the Finks, Hells Angels and Rebels declared, there has been almost no bikie related violence. Compare recent months to the preceding period. The mere suggestion the gangs were about to be targeted by police has resulted in the older, wiser players telling the less discliplined members to pull their heads in.

While the government move to amend the bikie laws can be viewed as a pre-emptive strike, the move to amend the Serious and Organised Crime (Unexplained Wealth) Act is overdue. Senior police have been urging change to that legislation for many, many months.

At present when detectives uncover evidence of how a criminal obtained possessions such as a luxury car or property using the proceeds of crime, that evidence cannot be used in any assets seizure action under the Act. The amendment will allow this to happen.

The Advertiser Newpaper is aware of numerous instances in which detectives have been in this situation. In one case a criminal’s entire business history was found on his laptop, but this evidence could not be used against him.

The use of the unexplained wealth legislation is perhaps the one thing organised, hardcore criminals fear most. It will allow police to seize what motivates them – their dirty money and the expensive toys they have purchased with it.

I find this heavy-handed shit amazing, like the RICO act in America. Generally it’s used to round up lots of guys, but rarely holds up in court. So, it destroys lives and pays lawyers, then won’t hold water.

I’m working on an effort with a couple of brothers to support Freedom in the states. I’m surprised that intelligent folks in Australia can sit around a table and try to develop legislation to destroy clubs. Why doesn’t one person step forward and say, “Aren’t we apart of a democratic free society? Why don’t we just apply the existing laws when necessary? Why did we pass laws, if we can’t use them? How can you possibly outlaw any organization without outlawing all organizations? Let’s go to the pub.”–Bandit

LET’S PARTY—Go for a ride, enjoy the sun, the moon, and the stars above. Even this weekend on Bikernet, you might see the first Smoke Out report from Mike Pullin, a ’60 Panhead feature shot by the magnificent Markus Cuff, a story about Bob Clift’s Indian collection shot by Marilyn Stemp, and you name it.

If the stars align properly I may start another Cantina episode, or work on the next chapter of World Run. And there is mounting pressure to write the book titled: Dogs vs. the Evil Nesters. Hell, I may not be a good writer, but I write a helluva lot.

Ride forever,
