This is wild. I’m trying to scramble and write my SmokeOut Story, and then Born Free exploded and Michael Lichter stayed at the vast and unrelenting Bikernet Headquarters during his assigned duty days for various magazines. Each day returned to the Ivory Tower on the Port of Los Angeles and down loaded his day’s images into his computer until 3:00 in the morning. He was up at 6:00 making arrangements for his next Sturgis Chip Bare Exhibit and taking care of business before running off to the next assignment.

Mike called me from each location, “Quick, get over here,” he said. “You’ve got to see what these guys are doing.” He went to Cycle Zombies in Huntington Beach, which I featured on Bikernet in 2009. The next day he hit a very cool, old school Chopper shop in Long Beach, Brat Style. A young successful Japanese builder who recently moved to LB. Great, classic stuff and Bikernet will feature his classic Indian Chief engine stuffed into a Scout frame.

That’s not all. We cruised to the edge of Signal Hill and got lost in the Suicide Machine facility. They flat track everything from new Harleys to Buells and Sportys. Great group of guys.

So, what’s he saying. Did he beat us to the punch. Did he mastermind his driveway before we sketched our first Streamlined Trike. The mystery continues.

THE DICE ATOMIC COMMUNITY PROJECT–
We are doing a donation piece to raise money for my friend’s family. On Father’s Day my friends went kayaking with their kids and two of the boys were pulled under and the one of the fathers jumped in to save them and also drowned. All three went over a dam.

I am friends with the mother of Carson, a young Boy Scout who risked his life to try and save his friends. This piece will go up for raffle and all the ticket sales will be split between the two families who lost their loved ones on Father’s Day. I’ve known Carson’s mother Jen since elementary school, and now as adults we live right down the street from one another.

Atomic’s brother died in a motorcycle accident at age 21 and he was an Eagle Scout. This piece is personal and we hope to raise a lot of money for the two Scout families.

KAWASAKI NAMED AS OFFICIAL MOTORCYCLE OF JASON PRIDMORE STAR SCHOOL–Organizations align over shared passion for improving motorcycle safety

Kawasaki Motors Corp., U.S.A. has announced an agreement with Jason Pridmore and his STAR Motorcycle School to be their official motorcycle through 2016. The Kawasaki Ninja motorcycle will be used by the schools instructors, and all students participating in over 30 training courses annually will have the opportunity to demo .

“I’m so happy that STAR Motorcycle School and Kawasaki have aligned for this year and into 2016,” said Jason Pridmore. “The Ninja started it all for me as I won my first AMA National on a ZX-7R in 1992. We are both so excited to collaborate on educating all levels of riders throughout the industry. Jason Pridmore is also the official motorcycle safety trainer for the Marine Corps Semper Ride program, for which he will also be using Kawasaki Ninja motorcycles. BIKERS SHOW COMMUNITY UNITY, lending hand during service for Charleston shooting victim–
CHARLESTON, S.C. (WCIV) — When several motorcycle clubs like the Fearless Divas, the ThunderGuards and the Pavement Chasers roared into Charleston Sunday to show support for the nine people killed at Emanuel AME Church they had no idea some would be called to lend a helping hand.

The bikers organized the meeting on social media so they could come together from all over the East Coast to pay their respects and see the church for themselves.

“They gave their sacrifices we have to let their lives be something of worth,” said Lorenzo Moore, a biker from Beaufort.

Together they raised more than $3,000 for the nine families.

“We all come in on one accord, to let them know that, ‘Hey Charleston we support you,'” Moore said. “But more so we are going to take the same attitude back to our communities so that our communities can be more vigilant and stronger about anything that could possibly happen like this so that we can come together.”

But then the bikers got a little surprise when 6 members of the Thunderguards were asked to hoist the casket of Myra Thompson into the church for the viewing Sunday evening. The bikers leapt in to action, grateful for the opportunity to help any way they could.

“If it’s our turn next then we’ll see Charleston, we’ll see New York, we’ll see Virginia, we’ll see all those places come as everyone else did,” said Tyrone McMillon of Beaufort. “We are glad to be here, glad to be a part of it to show our support

Supervise children, especially with sparklers. Young children should never be permitted to handle actual fireworks. Many parents are unaware that sparklers burn at over 1200 degrees, and are the leading cause of harm to children under age 5 during the July 4th holiday.

Keep hoses and buckets of water nearby. Fireworks and grills are a common cause of outdoor fires and burns during the 4th of July. Always supervise their use and remember to soak spent fireworks before disposing to avoid trash fires.

Avoid alcohol. Holidays and alcohol do not mix well. During the 4th of July, alcohol hazards increase because most of the celebrating occurs outside on warm summer days. Be aware of drunk drivers including boat operators when celebrating. Never, under any circumstances, should anyone ignite fireworks while under the influence of alcohol.

INVESTIGATOR ROGUE OPENS BAD JUDGE FILE–Murphy disgraced judiciary by blaming others for his actions

The fight is over, the white flag of surrender has been waved and still Brevard County Judge John C. Murphy is getting hammered by the Judicial Qualifications Commission.

Because sometimes, you just have to stop blaming others for your bad luck.

The six-member JQC slammed Murphy on Tuesday for refusing to take responsibility even during his written response, saying he would accept the panel’s recommended sanctions stemming from a 2014 altercation with assistant public defender Andrew Weinstock.

The panel last month recommended a four-month suspension from the bench, a fine, as well as continued mental- health counseling to deal with anger-management issues. On Friday, Murphy said he would accept the punishment though he called it “harsh” and that he was “dismayed,” and continuously referred to Weinstock as a “discredited witness,” who he said basically embellished what transpired between them.

That kind of response did not sit well with the JQC. “Judge Murphy’s actions disgraced the entire judiciary of Florida,” the JQC wrote in Tuesday’s court filings. “A truly contrite Judge Murphy would avoid heaping blame on others, would accept without reservation the discipline proposed by the Hearing Panel in this matter and would be grateful that removal was not recommended. Instead, what we see is a grudging acceptance and a continued, major effort to deflect his own responsibility onto someone else for his egregious wrong.”

In other words, just stop talking and take the punishment, something you would think a military veteran with Murphy’s experience can appreciate. He did, after all, reference his extensive military service five times during his court filing accepting the panel’s recommended punishment.

We are thankful for his service to our great nation and thankful for all the wonderful things he has accomplished on the bench, like starting a veterans court in Brevard. The court — stressing intervention and not punishment — helps veterans with mental health issues or substance abuse by keeping them out of jail. But in this instance, Murphy needs to just admit he was wrong. Period. End of story. No buts, no excuses, no mitigating circumstances even if there are plenty. Why? Because judges don’t go around challenging lawyers they dislike to fights.

The JQC held a two-day session in March and issued its recommendation to the Florida Supreme Court — the judicial body that will make the final decision in the case — after finding Murphy’s courtroom demeanor as being “more than inappropriate.” The June 2, 2014, incident occurred in Murphy’s courtroom in Viera as several defendants and attorneys gathered for a hearing. Murphy and Weinstock engaged in a heated back and forth over defendants and their speedy trial requests, prompting the judge to challenge Weinstock to a fight.

The panel found Murphy guilty of violating several standards of conduct.

Let it go now. Do not respond. Either take the sanction quietly and move on or leave the robes behind and just go back to practicing law.

THE WACO BULLSHIT CONTINUES TO MOUNT UP– Evidence To Be Kept Secret From Public.

Judge Rules Police Can’t Block Defense Lawyer from Seeing Waco Motorcycle Club Massacre Video Footage.

But evidence of what really happened in that shootout will still be kept secret from the public

Great news of an at least partial crack in the wall of obfuscation the Waco police have built around what actually happened that day last month when nine people were killed and 18 wounded by gunfire at a political meeting of biker clubs at the Twin Peaks restaurant.

I reported last week that the police tried to quash a subpoena (sent to someone else!) that would have called for restaurant videos to help Matthew Clendennen in his defense against criminal charges and in his lawsuit essentially for false imprisonment, as he was one of 177 people arrested willy-nilly on a blanket charge of “engaging in organized criminal activity.”

The Twin Peaks surveillance video will not be shared to the public. Judge Matt Johnson said Tuesday morning that he will allow the defense to view video but a protective order will be placed on it. Johnson went on to say that the video cannot be viewed by the public in any way, shape or form.

The city of Waco was in court on Tuesday morning to fight the release of the surveillance video.

During the hearing, it was argued that the video should not be released due to the potential interference during the Waco Police Department’s investigation.

Matthew Clendennen’s Attorney Clint Broden argued that he needed the video for his case.

Judge Johnson entered a gag order in the case, which will limit only the defense and state attorneys from discussing the case in the media.

More from local TV KXXV, including that Broden plans to appeal the gag order regarding the video.

Those hoping for justice in this case clearly need to pray for leaks. That the police in this case are trying to hide possible evidence of their own misconduct is a presumption that only they can dispel, and they don’t seem eager to do so for some reason. NINE WORDS WOMEN USE–

(7) Thanks: A woman is thanking you, do not question, or faint. Just say you’re welcome. (I want to add in a clause here – This is true, unless she says ‘Thanks a lot’ – that is PURE sarcasm and she is not thanking you at all. DO NOT say ‘you’re welcome’… that will bring on a ‘whatever’).

(8) Whatever: Is a woman’s way of saying “you’re an idiot!”

(9) Don’t worry about it, I’ll do it: Another dangerous statement, meaning this is something that a woman has told a man to do several times, but is now doing herself. This will later result in a man asking ‘What’s wrong?’ For the woman’s response refer to # 3.

NEW FLORIDA LAW, Ticket quota bans, speed traps curbs– Senate Bill 264 makes it clear that local law-enforcement agencies cannot use ticket quotas.

Also, the law requires individual local governments to submit reports to the Florida Legislature if traffic-ticket revenues cover more than 33 percent of the costs of operating their police departments.

The proposal is a reaction to the speed trap that was nestled along U.S. 301 in the small North Florida city of Waldo.

Palm Bay Police Chief Mark Renkens said that, while “the Palm Bay Police Department is very concerned about traffic safety,” the ticket quota measure does not concern his agency.

“While we expect our officers to conduct traffic enforcement, we do not have ticket quotas,” Renkins said. “In fact, the majority of officers are sympathetic to the cost of a citation, and tend to give verbal warnings much more often than those who actually receive citations.”

EMBATTLED VA WATCHDOG STEPPING DOWN– The embattled chief watchdog of the Department of Veterans Affairs announced Tuesday he is stepping down at the end of this week.

Deputy Inspector General Richard Griffin said he will retire after more than 43 years with the federal government.

The move comes one day after a group of VA whistle-blowers from medical facilities in more than a dozen states urged President Obama to fire Griffin, saying his office has gone after whistleblowers rather than the problems they uncover, failed to cooperate with oversight and in some cases to conduct thorough investigations, in a “horrifying pattern of whitewashing and deceit.”

THE MONKEY LOST HIS DOG–Last week one of the days we never want to face happened. After twelve long years we had to say our final goodbyes to our beloved dog Cookie.

Cookie was a biscuit colored American Eskimo that we had found at the local humane society. We had almost missed him as he was caged in the opposite room with the cats. We would quickly learn that was because he had an absolute hatred of other dogs. Many a Rottweiler and pit-bull peed the ground and ran away with their tails between their legs when Cookie got wind of their presence.

He had come from a rough home as he had distrust in men. It was trust I gained slowly from him as I greeted him at the top of the stairs the first time he ventured all the way to our bedroom a couple days later.

He became furiously loyal to me and my family. In the mornings when I left for work he would jump on the bed to watch over my wife until she got up. When the kids had friends over he would stand guard to quickly jump in if rough housing was starting. More than a couple kids fled our house in fear of Cookie.

Cookie was a house dog who even on the nicest days preferred to stay indoors rather than go outside. He never ventured into the garage to see what I was doing preferring to stretch out by the door waiting for me to come in. As our children grew and eventually moved away Cookie laid claim to the corner of the sofa waiting patiently for me to give him a nod it was ok for him to jump up.

He would stay by my side as we watched sports, watched movies and watched documentaries. There probably wasn’t another dog around that knew as much about astrophysics, nature reserves and this biosphere we call home. .

The years would slowly catch up to Cookie. No longer able to jump up on the bed to protect Mrs. Monkey as she slept he would lay at the top of the stairs ready for any intruder. Our nightly walks would become sporadic at best being more content to curl up and nap in his bed by the television.

A couple years ago it became apparent that his best years were behind him. We knew the end was coming. We dragged our feet as much as anyone would. He was still happy, still content with the good life we were providing him. He would have good days and bad ones. After a particular bad couple of weeks this spring I sat on the floor with him.

I explained what was going to happen and he seemed at peace with it. He would get better; a reprieve from the gallows but time is always against us all. Last week that time ran out. Three years past what was considered a long life for his breed his health began failing fast. Compassion finally outweighed selfishness so we said our final goodbyes.

I cried a lot that day, still feel the tears well up from time to time since. It’s not something I have to explain too many of you. Some of you are even probably going through it right now. For me I take comfort in that I was able to provide a good life, a loving home for that scared little dog I found in that cage all those years ago. I will miss you my friend.

BIKERNET GUN NUT REPORT: Judge Slams Brady Campaign for Frivolous Lawsuit that Costs Plaintiffs Over $200K–Sometimes victory is years in the making. A recent court victory, however, reminds all of us how important the NRA-ILA’s legislative victories can be, even many years or decades down the road.

Our hat is off to all the NRA members who answered the call to action while we waged a seven-year pitched battle to protect firearm manufacturers and dealers against frivolous lawsuits for the criminal misuse of firearms and ammunition. Your calls, emails, and letters from so many years ago were answered in the affirmative earlier this week.

NRA supporters will remember that on October 26, 2005, President George W. Bush signed into law S. 397, NRA-ILA’s priority legislation known as the “Protection of Lawful Commerce in Arms Act” (PLCAA). This legislation was meant to protect the firearm industry from a coordinated campaign of antigun lawsuits claiming gun manufacturers and dealers were responsible for the criminal acts of third parties who were unknown to them and totally beyond their control.

As legal theories go, these lawsuits were as ridiculous and unavailing as they come, but that wasn’t the point. Rather, the object was to force industry members either to go broke fighting similar suits all over the country or to coerce them into settlements by which they would “voluntarily” adopt policies the gun prohibition lobby had been unsuccessfully pushing in legislatures. To halt this abuse of the legal system, Congress enacted the PLCAA. This law states that lawsuits may not be brought against lawful manufacturers and sellers of firearms or ammunition if the suits are based on the unlawful use of the product by a third party. NRA considered this issue such a priority that we also pushed through similar protections in a majority of the states.

For the most part, these laws have worked as intended. Yet the Brady Campaign, enjoying the recent influx of cash into antigun causes by megabucks donors, has in the last few years resurrected the strike suit tactics, apparently hoping the passage of time and outrage over the acts of a handful of high profile criminals will change their luck. Among their latest targets are businesses who advertise or sell products online, not coincidentally the same type of businesses in the crosshairs of Barack Obama’s failed gun control push of 2013. While Brady’s efforts have resulted in repeated failure from a legal standpoint (see here, here, and here, for example), they seem content to use these tactics as a vehicle to spread their propaganda, attempt to smear members of industry, and maybe hit pay dirt with an activist like-minded judge.

Yet the efforts are not without cost, and not just to the innocent business persons dragged into court. Besides trifling with the legal system, they exploit people whose lives have been touched by crime and who may or may not understand Brady’s larger agenda or the limitations of its legal theories. Now, a Brady-backed suit has resulted in a judgment of over $200,000 against the parents of a victim who was killed in the movie theatre attack in Aurora, Colorado, in July 2012.

The suit was brought against online merchants who sold the perpetrator various items he used in his crime. To get around the PLCAA, the plaintiffs claimed that law was unconstitutional or that its various exceptions applied to their case.

In a concise 19-page opinion dismissing the lawsuit, the court repeatedly cited precedent that directly contradicted the suit’s claims. Ultimately, the court simply refused the plaintiffs’ request to rewrite settled law to their liking. “To grant such relief this court must conduct hearings and make policy decisions that are within the authority of the political branches of government responsive to the people under our constitutional structure of representative government,” Judge Richard P. Matsch wrote. “The defendants’ motions to dismiss must be granted because this court does not have the authority to grant the relief requested.”

The court was even more direct in an opinion released last week awarding the defendants defense costs and attorneys’ fees. “It is apparent that this case was filed to pursue the political purposes of the Brady Center,” Judge Matsch stated, “and, given the failure to present any cognizable legal claim, bringing these defendants into the Colorado court where the prosecution of James Holmes was proceeding appears to be more of an opportunity to propagandize the public and stigmatize the defendants than to obtain a court order which counsel should have known would be outside the authority of this court.”

When all was said and done, the plaintiffs were ordered to pay the various defendants a total of $203,001.86. Just who will ultimately foot the bill is unknown, but Judge Matsch also noted the close relationship of the named plaintiffs to the Brady Campaign itself. Brady, having exploited the plaintiffs’ tragic circumstances for the group’s own political agenda, hopefully won’t leave the plaintiffs on the financial hook as well. Predictably, the fee award is being appealed.

In the meantime, Lucky Gunner, one of the main plaintiffs in the suit, has announced that it will be donating “100% of what is recovered to groups that support and defend the 2nd Amendment” by allowing website visitors to vote on which groups get the proceeds from their recovery. We can hope that these funds, when awarded by Lucky Gunner, go to the groups (and their members) who made a difference in getting the protections against such frivolous suits in place. We’ll give Lucky gunner the last word, as their statement announcing the decision says all that needs to be said about Brady’s ongoing campaign of abusive lawsuits.

BROTHER LOST–As the Inquisitr previously reported, the longtime Oklahoma sportscaster Bob Barry Jr. died Saturday afternoon while riding his motorcycle close to his home. The car hit Barry’s motorcycle after making a U-turn, leaving Barry with fatal injuries. Bob ultimately died from injuries to his head, trunk, arms, and legs, Sport Act reports.

The driver of the car, Castillo-Gutierrez, was charged Tuesday with a felony driving offense that holds a maximum sentence of five years in prison. At the time of the crash, Castillo-Gutierrez tested positive for cocaine, and was arrested for first-degree manslaughter, drug possession, making an illegal U-turn, and driving without a license. Castillo-Gutierrez is a

Mexican national, and was in the country illegally.

He has previously been deported on three separate occasions.

ANOTHER MARIJUANA BREAK–
Miami-Dade commissioners voted Tuesday to let police treat marijuana possession the same way they do littering and loitering by issuing a civil citation with a $100 fine that keeps the offense out of the criminal system.

“We have better things to do with our police resources,” said Commissioner Sally Heyman, sponsor of the ordinance. “For goodness’ sakes, we don’t have to destroy the lives of so many.”

The change in county code passed 10-3, marking a milestone in how Florida’s largest local government treats marijuana offenses. The new ordinance gives police officers the option of either charging pot possession as a criminal misdemeanor or as a civil offense — which brings a fine but no criminal record — for possession of 20 grams or less, enough for about three dozen joints.

Backers pointed to the damage that a marijuana arrest may cause, jeopardizing eligibility for certain jobs, military service, student loans and affordable-housing programs. Advocates also said marijuana arrests are clogging the court system and keeping police too busy.

“It would be stunning to you the amount of taxpayer dollars that is utilized every time someone is charged with a simple offense of possession of marijuana,” said Judge Samuel Slom, who oversees the court branch that handles misdemeanor cases. “It takes the officer off their beat. Instead of protecting the community, now they’re transporting someone from as far away as south Kendall all the way to the Dade County jail.”

Slom and other backers of the ordinance emphasized that the change does not de-criminalize marijuana possession, since officers would still have the option of filing criminal charges. State and county law provides jail time and fines for possession of 20 grams or less of marijuana, and that would not change. Police director J.D. Patterson also said that smoking marijuana in public would remain a crime, and that the new ordinance would apply only to possession.

But the ordinance gives police throughout Miami-Dade the non-criminal option for possession, which would bring the offender a civil citation and the required fine. The ordinance takes effect in 10 days, and applies to all Miami-Dade cities as well. Mayor Carlos Gimenez endorsed the legislation Tuesday, calling it “good, common sense.” The police department that answers to Gimenez helped draft Heyman’s proposed ordinance.

Voting against the local law were commissioners Esteban “Steve” Bovo, Rebeca Sosa and Javier Souto.

“All we’re doing here is making parents’ lives harder,” Bovo said. “I could see a teenager telling a parent: ‘It’s just a fine, it’s not a big deal.’”

Senior county officials have not detailed how police would implement the new law, or when it would be appropriate to still arrest someone for possessing small amounts of marijuana.

Patterson told commissioners at a hearing two weeks ago that he would encourage officers to use the criminal option when the marijuana is clearly meant to be sold or if someone was caught with pot in a car accident. On Tuesday, Patterson said department rules will offer more guidance on how the rules should be enforced, including when repeat offenders should be charged criminally.

Miami-Dade’s new ordinance is part of a national movement away from criminal prosecution of minor marijuana possession. In South Florida, Broward County and Miami Beach are considering similar changes.

Approval of the ordinance follows a report this week by CBS 4 showing the racial divide in marijuana arrests that is helping drive the weakening of marijuana laws nationwide. CBS4 reviewed every misdemeanor marijuana arrest made in Miami-Dade County between 2010 and 2014. Among the findings:

 The misdemeanor pot arrests accounted for 10 percent of all cases filed in the criminal court system.

 County police account for 61 percent of those misdemeanor pot arrests.

 While about 20 percent of Miami-Dade’s population is black, about 55 percent of the pot cases involved black defendants.

 Of the 44,860 marijuana cases closed in Miami-Dade between 2010 and 2014, only 2 percent resulted in a conviction.

The change in Miami-Dade’s marijuana law was included in a larger rewrite of how to treat other minor offenses. With the new ordinance, police also would have the option of issuing $100 civil citations for loitering, littering and even possession of a plastic crate that’s registered as a dairy company’s property. The new ordinance also creates a civil citation for possession of drug paraphernalia.

Commissioners also passed an implementing order that would allow people cited for a marijuana civil infraction to perform two days of community service to work off the $100 fine.
