Icy Sunday Post for January 13, 2012


Hey,

This Post might be short, and maybe not. We could pack it with news from our own headquarters. We are still try to sort out 2013, which looks to be a fuckin’ amazing year. I know, I need to stay focused on the primary motorcycle goals, our Trike Streamliner, and books.

Our list also includes a Freedom grant effort, a movie project, a television series, and a water processing system that could help orphans and folks all over the world have more potable water. Plus work with the Motorcycle Riders Foundation to build an active Industry Council to help support motorcycling.

Let’s hit the news. We will touch on some of these items as we ramble. At the end I’ll list all the content coming your way on Bikernet.

Regarding the book Gods of Mischief: I gave up reading books penned by rats long ago. The unilaterally written, biased books are ridiculously embellished to the point of hyperbole and are always written from a LE’s perspective while conveniently leaving out such important issues as the UC being responsible for many laws being broken or inciting a situation in which many people, except the UC, were busted.

If people want to put money into the coffers of a person, who by the very nature of their undertaking, is a professional liar that’s their prerogative, but I won’t.

Very lofty praise from Jay Dobbins. Isn’t that the same one guy who is now suing his handlers?

Despite its status as the Motor City, Detroit has only two automobile plants entirely within the city limits. One is Chrysler’s Conner Avenue Assembly Plant, which reopened in December after being closed for more than three years during the automaker’s bankruptcy. Later this month, the factory’s first Viper — considered a “halo” vehicle, built to enhance a company’s image rather than drive sales — will roll off the line. A worker at Conner, Mike Chapman, says that “you’re more like a craft person than a line worker” there, while at other plants “you’re pretty much like a robot.” Elsewhere, workers spend less than a minute on each car; at Conner, they spend a half-hour on each car. And with almost no automation in place, the loudest sounds are the roars of a Viper’s engine. – Sonari Glinton

REPORT JUST IN FROM THE MOTORCYCLE RIDERS FOUNDATION MRF–113th Congress,
Last week both the US House of Representatives and the US Senate swore in its body for the 113th Congress. Washington D.C. has a whole lot of new faces with this Congress. The US House has 82 new freshman members out of 435 and the Senate has 13 new Senators, out of 100.

That’s a lot of new people for the Motorcycle Riders Foundation to get to know. The majority remains the same, albeit more Democrats were elected than Republicans in both chambers. The House remains under Republican control and the Senate continues to be led by the Democrats. Speaker Boehner and Senate Majority leader Harry Reid were both, as expected, re-elected to retain their positions.

In the House we have a new Transportation Committee Chairman, Bill Shuster of Pennsylvania. If his name sounds familiar it’s because his father Bud ran the same committee from 1995-2001 when the national helmet law was repealed.

It has only been a week but this Congress is expected to be a busy one filled with controversial legislation. Especially considering the lack luster performance of the 112th Congress.

Fiscal Cliff

What a difference a week makes. This time last week you couldn’t swing a cat without hitting some media reference to the “Fiscal Cliff”, or the point in time when many tax cuts expire and many new taxes are implemented. This would result in a sharp increase for almost every American’s personal taxes.

The Congress and the White House did reach a last minute deal that would push the so called “cliff” just a little farther down the road. This solution was done so at the expense of the American people. The Congressional Budget Office (CBO) has stated in the deal that the ratio of spending cuts to tax increases is 1-44. So we will be revisiting this same situation in a few months.
Some estimates say the bill will cost $620 Billion over ten years.

One of the new tax credits is for motorcycles, but only all electric motorcycles. Senator Ron Wyden of Oregon insisted that the electric motorcycles be included as part of the deal. The tax credit was not something the MRF advocated for. The credit was the result of direct lobbying by the electric motorcycle manufactures. The credit is good for 10% of the purchase of a brand new electric motorcycle.

Regarding the article about the Motorcycle Escort Progam; I have brought this up at the ABATE of Maryland inc. B. O. D. meeting, and have suggested that we go by the same criteria as road construction crews as far as getting certified through the “Flagger Program”.

I work for the local electric company and have been through the American Traffic Safety Services Association course and hold a card as a REGISTERED FLAGGER. It may not be the entire answer, but its a start.

DISABLED VETERAN DIES IN HERMOSA BEACH COURTROOM OF HEART ATTACK WHILE FIGHTING WELLS FARGO OVER UNJUSTIFIED FORECLOSURE—from easy reader, by Ed Pilolla

Larry Delassus, a 62-year-old disabled veteran, died in court last month while continuing a three-year battle against Wells Fargo for foreclosing on his Hermosa Beach home – a battle he had to fight even though court records show he paid his mortgage two months ahead of schedule and also paid his property taxes in advance.

He suffered heart failure Dec. 19 while his attorney argued against a tentative ruling issued by a Torrance Courthouse judge siding with Wells Fargo.

Wells Fargo called Delassus’s death “tragic,” but it was Wells Fargo that put Delassus into default when the bank mistakenly thought Delassus was behind in his property taxes. In fact, the bank was using an incorrect assessor’s parcel number that corresponded to Delassus’s neighbor’s home.
Delassus’s attorney and close friend, Anthony Trujillo of Redondo Beach, working the case on contingency, discovered the bank error and informed the bank. Wells Fargo acknowledged the error, fixed Delassus’s credit history but still proceeded with selling Delassus’s home at auction, according to deposition testimony and court documents.

When both parties appeared in court Dec. 19 for a preliminary hearing, Delassus, suffering liver disease, was in a wheelchair in the back of the courtroom, incoherent and breathing loudly.
Judge Laura Ellison told Trujillo the facts of the case did not appear to justify Delassus’s claim of fraud and negligence.

In response, Trujillo spent most of an hour reviewing, out loud, bank documents that indicate Delassus was never late on a mortgage payment or property tax bill. He argued that putting him in default was an error originally created by the bank’s tax service subcontractor.

As the proceedings played out, Delassus went into cardiac arrest.

“He was sure that when a judge heard that he was never even late on a payment, that [the judge] would do something,” said Debbie Popovich, a friend who arrived in court with Delassus.
Wells Fargo did not respond to requests for comment on this story. The bank issued this statement after Delassus’ death:

“Mr. Delassus’ passing was a tragic event and our deepest sympathies go out to his family and friends. In a tentative ruling posted on the court’s Web site the night before the scheduled hearing, the judge indicated she was prepared to dismiss all the claims put forward by Mr. Delassus’ attorneys and rule in favor of our motion for summary judgment. Given that there was no testimony or evidence to be presented at the hearing, there was no reason for Mr. Delassus to attend and it is truly unfortunate that he was brought there.”

Trujillo said Delassus indeed needed to be in court because a hearing was requested by the bank to determine if Delassus needed an independent guardian appointed by the court.

“He was there to testify,” Trujillo said.

Judge Ellison declined comment for this story because the case remains pending before the court.

STURGIS, S.D. RALLY TRADEMARK WARS –
The Sturgis rally trademark wars are flaring up again, with the son of the Black Hills Motor Classic’s founder lobbing barbs at the Sturgis City Council meeting this week.

Jack Hoel, the son of Pappy Hoel, told the council and City Manager Daniel Ainslie Monday night that the city should not have to pay for the use of its own name.

His comments came as the city finalized its contract renewal with Sturgis Motorcycle Rally Inc. (SMRI), which owns the rights to the Sturgis name as it relates to the annual motorcycle rally.

“This is nothing but a gift to SMRi,” Hoel said.
The contract in 2011 cost the city nearly $50,000 that included royalties paid for land the city leased and banner sales to official sponsors, Sturgis Mayor Mark Carstensen said, as reported in the Rapid City Journal.

The city will not have to pay those royalties in the future. The contract passed Monday is retroactive to the 2012 Sturgis motorcycle rally, the mayor said.

Under the five-year contract approved Monday, the city will continue to pay 10 percent to SMRI for the use of the Sturgis trademarks which, in addition to the name Sturgis, includes Sturgis Motorcycle Rally, Sturgis Bike Week, Take the Ride to Sturgis, Sturgis Rally & Races, and Black Hills.

Ainslie said the city received $269,440 from the 2012 rally as a result of its sponsorship license agreement.

“The 10 percent royalty payment is identical to the previous agreement, which was originally entered into between the city and the chamber,” Ainslie said.

BIKERNET AND ORPHANS IN THE STORM–
We had an amazing meeting yesterday with David Bartlet, a film maker who is the Founder of Orphans In the Storm. He wants to put water separators in orphanages all over the world to help kids. He is involved with lots of very high ranking folks from presidents of countries to George Clooney. His brother mixed the sound for the recent film The Life of Pi which was just nominated for 11 Academy Awards.

David has made two trips around the world with a group spreading an new Human Rights doctrine. Check the Youth for Human Rights web site. He is working on a star-studded album with songs by orphans, to be released this year, and a documentary film next year. Check his web site orphansinthestorm.com. Amazing things could be happening.

UTAH HELMET LAW UPDATE–
An amendment to the existing helmet law has been sent for review and introduction to the Utah State Senate in the 2013 session. This change will require mandatory helmets for all motorcycle riders and passengers regardless of age. This legislation will make it mandatory to wear helmets for not only motorcycles on the road but also Type 1 all terrain vehicles including snowmobiles driven on public land.

We encourage you to contact all Utah State Senators and respectfully ask them to oppose changes to the existing bill and ask them to support your position.

Please explain your reasons and point out the lost tourism dollars Utah will face.

DOG SALE AT THE BIKERNET KENNEL–
A man sees a sign outside our kennel – ‘Talking Dog For Sale.’ He rings the bell, the owner appears and tells him the dog can be viewed in the back garden.

The man sees a very nice looking Labrador Retriever sitting there.

“Do you really talk?” he asks the dog.

“Yes,” the Labrador replies.

After recovering from the shock of hearing the dog talk, he man asks, “So, tell me your story.”

The Labrador looks up and says, “Well, I discovered that I could talk when I was pretty young. I wanted to help the government, so I told the SAS.

“In no time at all they had me jetting from country to country, sitting in rooms with spies and world leaders, because no one imagined that a dog would be eavesdropping.

“I was one of their most valuable spies for eight years.

 
But the jetting around really tired me out, and I knew I wasn’t getting any younger so I decided to settle down. I signed up for a job at Heathrow to do some undercover security work, wandering near suspicious characters and listening in. I uncovered some incredible dealings and was awarded several medals. I got married, had a few puppies, and now I’ve just retired.”

The man is amazed. He goes back into the house and asks the owner how much he wants for the dog.

“Ten quid,” the owner says.

“£10!!? But this dog is absolutely amazing! Why on earth are you selling him so cheaply?”

“Because he’s a lying bastard. He’s never been out of the garden.”

PEACE RIDE IN LOS ANGELES–
I am producing an event called The Peace Ride and will have hundreds or thousands of bikes in a run through LA ending at the fair and barbecue.

It is related to the orphan project as the charity sponsoring it is a mentor of mine, called: The World Literacy Crusade. It is run by founder Reverend Alfreddy Johnson and is based in Compton. Their Mission Statement is: “To make the entire planet literate.”

It happens on Monday jan 21, which is Martin Luther King day. It starts in El Segundo and ends in Tragniew Park, where the fair and barbecue will be.

I though it could be fun for you and several thousand of your closest friends to have a ride and a nice barbecue on a National Holiday. Reverend Johnson is VERY hooked in with Africa and relief there and is one of my greatest supporters with the orphans. He is especially connected to Ghana and South Africa, and also very big in Puerto Rico.

It would be fun if you could do this, and maybe your bike community could join in.

KNOCK A MAN WHEN HE’S DOWN—

Everyone has seen images of 569 Quincy Avenue, Staten Island representing a post-Sandy devastated home. Owner, Michael Taurozzi’s house is the FIRST of the 200 homes scheduled for demolition Monday, January 14. Taurozzi finally signed “right for entry” papers with the City Friday 1/11/13 at 4:30 pm.

You may remember the Page One story the Wall Street Journal on Taurozzi and his next door neighbor James Rossi, who died in the storm on November 5th: 
 

Now fast forward two months… The City had held a meeting of all the agencies involved in the demolition of Taurozzi’s “RED TAGGED” home, Thursday 1/10/13 (Taurozzi was not invited to attend), but he was called and advised that the papers needed to be signed on Friday.

Then without any notification, Friday 1/11/13 at 11 am the DOT under instructions from OEM and the mayors office “towed” the Taurozzi’s daily work truck off his property, without his knowledge. When Taurozzi arrived at 7 pm Friday evening to begin work removing his final belongings from his property he was stunned to find his truck missing, so he called he police to report it “stolen”.

I’m wrapping up an article from Paul Morris, which hit my Bikernet desk a few days after rolling into the Long Beach International Ultimate Builder Motorcycle Show. Paul walked off stage with the first place trophy and a fat check in hand.

Coming up this week our 5 Ball Racing Team, 124 inch Twin Cam, Turbo Charged, Raycer will find a home on a Handy Lift air lift. We’ll design and machine rear set shift linkage for changing gears without the air-shifter on the street. The Pingel air shifter will up shift only, perfect, and yes we have air stored in the one-off Rick Tedder built frame. Mark Susman of www.ccmotorcyclewheels.com designed and machined a set of black anodized and ready for installation 6-inch aerodynamic risers for street riding comfort and style. We’ll take photos during upcoming installation.

For the Mojave Mile and the Salt Flats we’ll change out the custom built Barnett clutch and throttle cables then relocate the bars for a tight, comfortable custom Bonneville fit. On the short list, Race Tech suspension, dyno, bolt on the tag and haul ass. Closer by the day.

The goal, have a road ready rocket the end of February.

Deal gave millions to Hollywood, rum makers  Are you outraged yet? You should be. Congress just approved the fiscal cliff legislation and, according to ABC News and other media reports, it included the following: Puerto Rico and Virgin Islands rum subsidy: $222 million.
Hollywood: $430 million

Our Congress is completely out of control, and you will not see much change for the next two years. I think term limits is the key. The House of Representatives should have limits of four terms or eight years and the Senate limits should be two terms or 12 years.

We have to do something. Our debt is increasing at the rate of $140 million an hour, which works out to more than $3 billion a day. Our country it out of control. Please get outraged.

WYOMING PROTECTING GUNS–
Here’s How Wyoming Lawmakers Are Trying to Beat Obama Admin. to the Punch on Possible Gun Ban

A number of Wyoming lawmakers are proposing legislation intended to protect gun owners from any future federal ban on semi-automatic rifles or high capacity magazines, KTWO reports.

Introduced last week, the “Firearms Protection Act” would make any federal law banning semi-automatic rifles or limiting magazine capacity unenforceable in Wyoming.

In fact, under the proposed bill, anyone who tried to enforce a federal gun ban could be charged with a felony. The Wyoming Attorney General’s office would also be permitted to defend any state resident against a federal gun ban.

“An act relating to firearms; providing that any federal law which attempts to ban a semi-automatic firearm or to limit the size of a magazine of a firearm or other limitation on firearms in this state shall be unenforceable in Wyoming; proving a penalty; and providing for an effective date,” the bill states.

“Any official, agent or employee of the United States government who enforces or attempts to enforce any act, order, law, statute, rule or regulation of the United States government upon a personal firearm, a firearm accessory or ammunition that is owned or manufactured commercially or privately in Wyoming and that remains exclusively within the borders of Wyoming shall be guilty of a felony,” the proposed legislation adds.

Per the Washington Examiner’s Charlie Spiering:
One of the bill’s co-sponsors, Wyoming State Senator Larry Hicks, told The Washington Examiner that this type of legislation sends a message to the federal government in Washington D.C.

“It says that your one size fits all solution doesn’t comport to what a vast majority of the state believes,” Hicks explained in an interview.
Citing the Tenth and the Second Amendments, Hicks asserted that the legislation was Constitutional, adding that he fully expected it to pass in the Wyoming state legislature. Hicks said that his Wyoming constituents were upset about the looming threat of gun control coming from Washington, particularly since Vice President Biden signaled yesterday that President Obama was willing to issue an executive order to tackle the gun issue.

Hicks explained that the model of the bill was taken from a bill passed in the State of Montana in 2009 adding that it wasn’t much different from what he’d seen other states do.

Whether or not such a law would actually be effective is a topic that will likely be debated. However, the so-called “Supremacy Clause” in the U.S. Constitution says federal law overrules state law when the two conflict. Still, as we’ve seen in states that have recently legalized marijuana, like Colorado and Washington, the feds don’t always immediately exert their power over a state’s sovereignty.
