CALIFORNIA FIGHTS HELMET LAW FOR ALL STATES– I just got an email from Mike Osborn, ABATE of California Judicial Fund officer. He was in court today, along with Attorney Wendy Lascher. As you know, we’ve been working to get donations to the judicial fund to support the plaintiffs in the Quig et al v. CHP case, scheduled to be heard sometime in May, 2008.
There was another case recently, which dealt with the CHP being cited for contempt of court because of their refusal to sign off on helmet tickets as “correctable”, despite that order from the Superior Court of California, Santa Cruz County. That ended with the court ruling in favor of the CHP, denying the contempt charge. The reason the court said was the CHP officer had an exclusion to the law which says if the condition presented an immediate safety hazard, he did not have to sign off as a correctable situation. That exclusion gave the officer discretion to get around the signing off the ticket. More important to us, the 6th Appellate Court ruled that by law, if no exclusion was present, helmet tickets “were correctable.”
Shortly afterward, the Attorney General filed a motion for Summary Judgement or Summary Adjudication. This was her attempt to make the Quig et al v. CHP case go away. She briefed that there was no standing now that the 6th ruled it was a matter of discretion on the law enforcement officer. But they were dealing with Quig’s BOLT baseball cap. Remember, the 6th said, usually, as a matter of law, helmet tickets were correctable. The enforcement practices of the CHP pulling over bikers and refusing to sign off the ticket as correctable, no matter what the helmet was made of as long as the officer thought it was illegal, is what the Quig case is about. The fabrication of a helmet cannot be a reason for determination of non-compliance and neither an officer or consumer can determine, by fabrication, if a helmet is legal. That’s what the Buhl case said. In fact, the court said it was absurd to consider fabrication.
Today, February 8, 2008, the court made it’s ruling on the Motion for Summary Judgement. It was denied.
This means the Quig et al v. CHP should be heard in May. It appears Judge Attac actually gets what the plaintiffs are saying about helmets, correctability and the CHP’s enforcement practices. The game goes on, we’re in the bottom of the ninth and the score is tied. It’s time for a homerun by the home team. We can do this.

V-FORCE CUSTOMS BUSINESS LAUNCH– Rock Tavern, New York 8 February 2008 Vinnie DiMartino and Cody Connelly owner, operators of V Force Customs kicked off their 2008 Rally Tour at the VTwin-Expo in Cincinnati, making their first appearance since leaving the popular television series American Chopper.

S&S ENGINES CARB APPROVED FOR CALIFORNIA–S&S engines CARB approved S&S Cycle has announced that its V-Series engines, certified using the California Air Resource Board (CARB) engine certification option, will be available from April. Availability of the engines is, of course, subject to final approval of the engine certification option, but S&S has elected to proceed with an understanding from CARB that the engine certification option is imminent.
Potential buyers will have the option of choosing from 50-State certified V-Series engines in 4in bore 113ci and the 4-1/8in bore 124ci, both will be equipped with carburetors, and the new S&S sealed air cleaner, and a carbon canister for evaporative emissions.
Michael Scaletta, Director of Business Development, said: “This CARB certified engine program will allow dealers and small volume OEMs to purchase an S&S certified engine, build an on-highway motorcycle, and sell it in California with no additional gaseous emissions testing needed.”

Each 50-state engine will come with an installation manual, engine owners manual, evaporative components and permanent label to designate the vehicle meets California regulations. In addition to those requirements, a notice printed on a separate sheet of paper explaining the documentation, record keeping, notification requirements, and access of ARB to records will be included.
There will also be a notice explaining the MSO for the engine will not be provided until the engine manufacturer receives a statement from the owner that they have read and understood the requirements for proper installation of the engine into the vehicle.
Some of the information listed in the Installation Manual will include the maximum gear ratio (n/v), maximum vehicle weight, exhaust system back pressure range, maximum fuel tank capacity, evaporative system connections and label placement. The owner’s manual will include the emission component warranty, engine maintenance requirements and anti-tampering requirements.

LEGENDS RIDE TO BENEFIT KIDS & CHROME FOUNDATION– Buffalo Chip and Deadwood, South Dakota – The first annual Legends Ride will take place Thursday, Aug. 7, 2008 during the annual Sturgis Motorcycle Rally. The ride, which is presented by The Legendary Buffalo Chip Campground and sponsored by the City of Deadwood, will benefit Kids & Chrome Foundation, which in turn benefits the Children’s Home Society and the Sturgis Motorcycle Museum.

THE SUN IS OUT–Dr. Hamster and I rode over to Chopper Dave’s shop, in Hawaiian Gardens. Then we rolled back into lovely Wilmington, the third world country between Long Beach and San Pedro for fresh fish tacos at the Mexican joint called Shamrocks. Does anything make sense anymore? Then we rode to a classic Triumph shop in San Pedro, where the master Earl build classic Triumph and BSA bobbers. “I don’t restore anything,” Earl said. “I send all the restoration parts to another guy and he ships me custom shit.” Earl has built these bikes for 30 years (310) 218-2979.
Okay, here’s my epiphany. Last night I watched an interview with the President on Fox and it was obvious the interviewer was trying to elicit something from the President regarding the on-going police action in Iraq. Bush told him he studied Lincoln and memorized the Gettysburg address as a young man. He said that Lincoln was panned for the address at the time, but years later it was highly recognized and memorized by students throughout history.

I’ve been reading a series of books by Winston Churchill. They documents the politics after WWI until and through WWII. Last night I read a couple of pages that struck home. He mentioned that most of the Allies after WWI were certain that there would never be another World War and acted accordingly. By 1939 Hitler was posed to storm Poland and the Allies were forced to wake up. Prior to that event German rearmed in violation of a solemn treaty. They took over Austria, carved up Czechoslovakia and built up armaments along the border of France and Germany. If at any point prior to the attack on Poland, the Allies had stepped up and put an end to Hitler, millions of lives would have been saved, billions of dollars, millions of homes and almost a decade of conflict.
Maybe someday we’ll thank Bush for being pro-active against a growing storm of terrorism. Who knows for now? Let’s party, support our troops like crazy. Their efforts now may be saving us from something far more harsh in the future.
