Weeks fly by. A handful of Hamsters on motorcycles scrambled into the headquarters yesterday for lunch. One brother couldn’t make it. From his phone call, I got the impression a car was in pieces in his front yard, and he needed to finish it, before he was evicted by the neighborhood, or his wife. “I can’t seem to find a weekend to work on it,” the mysterious rodent mumbled and hung up.
I can relate to project overload, but like so many brothers point out to me. “It’s better to have too many projects, than none.” Let’s take a gander at next week’s list. I’m hoping the 45 Bonne Belle fenders will arrive from Bare Knuckles. We are talking to a new staff member for Bikernet back east. We need to launch our 5-Ball Racing Sponsorship program, so we can start to launch 5-Ball Racing build articles. Ray is waiting with his 124-inch Turbo build, and I have Departure Bike Works K-model top end updates, and Paughco chassis tech info. Plus, we have a serious Branch Flowmetrics twin-cam headwork build article. It ran in Hot Bike Baggers a couple of months ago.
I will launch another Mudflap girl bike build article this coming week, and Wednesday we will roll over to Saddlemens to see them get started on my seat for my FXR. Plus, the XS build is underway with my Grandson and we received a box of old school antique brass finished parts from Mr. Lucky. Franky plans to roll over here in his used undercover cop car, every Tuesday to work on his bike, and help me with his dad’s. That’s just scratching the surface. Let’s hit the news and I’ll fill you in on additional projects as they pop through my whiskey-soaked brain cells.

SPEAKING FROM AUSTRALIA--New anti-biker laws lack due process.
Even as a lightning rod for new legislation aimed at countering outlaw motorcycle gangs, Vince Focarelli cuts a controversial figure… so write Willem de Lint and Marinella Marm
Mr Focarelli was arrested recently in Adelaide following a week in hospital, having survived the fourth attempt against his life since 2006.
A good deal of recent violence in Adelaide, attributed to a “bikie war”, is really located around the comings and goings of Mr Focarelli between various motorcycle gangs.
Since his prison release in 2006, Mr Focarelli has been an in-and-out member of two motorcycle gangs (Hells Angels and Comancheros), founded a new gang (The New Boys), and apparently has relinquished the key of his tattoo parlour to the Finks MC.
The South Australian Attorney-General, John Rau, now proposes legislation to finally break through the code of silence of organised gang members, and protect witnesses and members of the public by sealing their evidence from defence attorneys.
To avoid an unpleasant déjà vu – with crucial parts of South Australia and New South Wales legislations being declared invalid by the High Court – the SA Attorney-General should have a long look at other nations with similar (if not worse) organised crime problems.
Like Canada, Great Britain, the United States, Austria, the Netherlands and Italy, Australia has introduced expansive law against organized crime.
Australia has also been a leader, with the South Australian law proudly proclaimed as “the world’s toughest” by the then SA premier Mike Rann.
However, in both New South Wales and South Australia, law bodies have expressed “shock” and “serious concern” at the speed at which new measures against OCMGs have passed through parliaments.
Following suit, the High Court of Australia struck a blow by invalidating parts of the South Australian law in 2010 and New South Wales law in 2011 – namely, their restrictions on judicial impartiality.
It was actions that were judicial but sidestepped the judiciary that rightly offended the High Court (and lower courts).
At the same time, the High Court has provided sufficient room with its judgment to accommodate much of what states have wished to legislate.
In particular, the High Court has not prohibited the use of what is called “criminal intelligence” – secret evidence that is given to selected adjudicators to protect sources and methods.
If criminal intelligence is firmly entrenched into new legislation, as is expected, then it would be a randomly selected judge who will be adjudicating on this evidence as an impartial umpire.
The protection of secret information in the prosecution of organised crime has been a major problem in Italy since the events that followed the gruesome Mafia killing of judges Falcone and Borsellino in 1992.
One could legitimately ask how the Italian police and prosecution succeeded in the following years in presenting criminal intelligence as evidence before an adversarial judge without incurring breaches of national and European human rights charters and courts.
In 1992, two laws (and related amendments) were introduced, touching key points such as admissibility of evidence, right of cross-examination and identification of sources of evidence.
Further, two elements complement the Italian legislation aimed at prohibiting membership of organised criminal associations: First, court-authorised electronic surveillance and wiretapping; and second, accounts from “pentiti”, criminal insiders turned supergrass.
This latter element has offered major inside knowledge to Mafia affairs, and has effectively addressed that sense of impunity and code of silence.
All points no doubt being considered right now in South Australia, and yet all problematic for due process.

DAYTONA BIKE WEEK PARADE RETURNS– Supercross fuel Bike Week optimism in Volusia, Flagler
DAYTONA BEACH — This year’s Bike Week — roaring to life on Friday — will be marked by the return of old traditions as well as new attractions.
With the Community Appreciation Parade back after a six-year hiatus and a revamped Rossmeyer store on Beach Street, as well as the only Florida Supercross event this year, hope is high for the March 9-18 event to generate increased interest and attendance.
That optimism runs through two counties, from the traditional biker hot spots in Volusia to places you might not expect in Flagler.
Tom Grimes, general manager of the Hilton Garden Inn in Palm Coast, said he’s already sold out for three nights of Bike Week and close to selling out for the others. It’s better than he did during Speedweeks, he said.
“Speedweeks, sometimes, folks coming up here, booking in advance can be a little bit spotty,” Grimes said. “Bike Week used to be the same way, a little bit spotty, because of the hub (locations) down in Daytona, but this year people have found that it works well to book out here in Flagler.”
Kevin Kilian, chief operating officer for the Daytona Regional Chamber of Commerce, agreed that Bike Week has increased in scope over the last several years.
“It really has become not only a multi-city but a multi-county event,” Kilian said. “It’s regional.”
The Chamber’s big effort this year is the March 17 return of the Community Appreciation Parade, which will start at 9 a.m. at the Ocean Center and head down A1A and International Speedway Boulevard, ending at Daytona International Speedway. The parade had been a longstanding feature of Bike Week, but took a hiatus in 2005 when the Daytona 200 moved from Saturday to Sunday.
Now the 200 returns to Saturday the 17th, and Sean Belgrade, vice president of marketing for the Speedway, said the parade is another chance for the Speedway to reach out.
“We want to make sure that the community feels a part of what we’re doing,” he said.
Belgrade said ticket sales for the Daytona Supercross this Saturday and the AMA Pro Flat Track and Daytona 200 next week are pacing ahead of last year, and that corporate displays and vendor space on Speedway grounds sold out about two months earlier than in the past. Although it’s hard to estimate attendance because not everything at the Speedway requires admission, Belgrade said he thinks there will be a good crowd.
The Supercross race, unlike other years, is the only Supercross stop in Florida, and that’s helping heighten the buzz.

BIKERNET 5-BALL RACING WHEELER REPORT–Another Sunday in paradise after an incredible week.
The main street running beside headquarters is nearly completed and smooth as a calm sea at high noon. The heavy truck traffic is now a whisper compared to the major lumps and bumps launching 18 wheeled semis that constantly rattled the castle walls last year and for months and months during the much needed repairs.

The Dyna’s fresh 96-inch Twin Cam engine is installed with just a few minor parts on the short list. With the new throttle body we need injectors and the attaching hardware.
The blacked out Samson pipes that fit perfectly and without a hitch now have oxygen sensor bungs welded in place that will send critical information to the Daytona Twin Tec computer.
Rebuilt Cases
The premier parts included in the build are factory cases that are rebuilt to better than new standards by one of the engine building masters in the United States. In addition to nuts on machine work and big inch monsters Randy restores any and all types of H-D type engines. Randy Torgeson of Hyperformance is located in Pleasant Hills, Iowa . Randy’s latest and possibly the biggest motorcycle engine on the planet? One of his customers in Thailand is completing a build around a 260 cubic inch evo style engine that will have a Turbo set up.
Inside the rebuilt cases are precision balanced and trued, plugged and welded 4 inch Darkhorse Crankworks flywheels w/H-Beam rods.
A Fisher Harmonic Vibration Balancer will smooth the hot rods internals just a little bit more.
On top are RevTech cylinders, 3.927 forged pistons and rings. Branch/O’Keefe flowed heads that are a work of art will let the air in and out.
Crane roller rockers and support plate for a nice quiet top end that should run for one helleva long time.
In the cam chest Eric Bennett installed a H_D Screamin Eagle cam support, hydraulic cam tensioners and oil pump kit.
A set of Fueling Reaper Series cams with .574 lift for a breathe of fresh air in a timely manner, race series pushrods and race series hydraulic lifters.
E.T.Performance Krank Vents so the cases will breathe properly.
Looks like a top secret throttle body, no butterfly, may be on line.
The latest Performance Machine see through air cleaner will keep the critters out.
On the cam cover we bolted on a Jim’s Machine heat sink to introduce fresh air that reportedly cools the engine as much as 10 degrees while your rollin down the highway, ah fresh air for your sweetheart cam chest. Cool.

The suspension and wheels are off of a late model Busa sport bike, a tried and true set up that runs in the 200 mph plus zone on the Bonneville salt flats without any issues. Rick Tedder is fabricating a one off frame that will hold the 124 inch Turbo charged Hyperfromance/R&R Cycle Twin Cam engine.

A ride to the local Veterans facility is planned with Smitty, Racing for Vets. We we’re there last year, had a blast and rode away with a ton of memories.

DC BABY STEPS TOWARD GUN LAW SANITY–
Since the Supreme Court’s 2008 decision overturning Washington, D.C.’s handgun ban in District of Columbia v. Heller, our nation’s capital has stood nearly alone in its level of contempt for residents’ Second Amendment rights. Two recent developments may give hope for a turn for the better.
First, an NRA-supported case has ended in victory for residents of the District of Columbia’s public housing system, as the D.C. Housing Authority has finally changed its lease provisions to allow lawful gun possession in its properties. The case, brought by 66-year old William L. Scott, has now been dismissed in light of the change. This is an important victory, because gun bans in public housing are aimed squarely at low-income residents of high-crime areas, who may have an urgent need to be armed for self-defense.
The victory puts an end to the housing authority’s defiance and foot-dragging in the face of multiple court decisions. The gun ban was put in place in January 2008, even though the U.S. Court of Appeals for the D.C. Circuit had already ruled that the Second Amendment protects a fundamental, individual right to keep firearms in the home. Only a year after that ruling was upheld by the U.S. Supreme Court in District of Columbia v. Heller—and after prompting by Mr. Scott’s attorneys—did the housing authority even propose amending its leases. But the new lease changes were never made final until now, months after Mr. Scott filed suit in July 2011.
In the second notable development, the D.C. Council’s Committee on the Judiciary began work on a bill to roll back a few of the most extreme provisions of the District’s post-Heller anti-gun laws. Though final council action hasn’t yet occurred, the version of the bill passed by the committee on Feb. 29 would eliminate the District’s mandatory five-hour training requirement (including one hour of live fire). Instead, would-be gun owners would only have to watch a video presentation on gun safety—an easier alternative that even the District’s police department had favored all along.
Among other changes, the bill would also end the requirement that handguns registered in the District be test-fired for ballistic identification, a requirement that has proved useless in the handful of states that have imposed it, and postpone the implementation of a California-style “microstamping” requirement.
In testimony submitted to the committee, NRA-ILA Director of State and Local Affairs Charles H. Cunningham noted that, while the changes would be welcome, they don’t go nearly far enough in respecting citizens’ rights. In addition to the provisions already in the bill, NRA suggested bringing the District’s laws into the mainstream by abolishing mandatory training entirely, along with long gun registration, the District’s “one gun a month” registration limit, and other registration requirements that burden law-abiding gun owners. The provisions also burden District taxpayers, who are stuck with the bill to defend these laws against an ongoing NRA-supported legal challenge.
Washington Times Opinion Page Senior Editor Emily Miller, who chronicled the extreme difficulties of purchasing a firearm in our Nation’s Capital, recently wrote an op-ed piece, in which she notes that D.C. officials have no solution for the city’s crime problem. The article reports that violent crime in the District is up 40 percent in the first two months of the year, including double the number of robberies at gunpoint.
The article also notes that at a recent community meeting on the increased violence–held by D.C. Council member Mary M. Cheh–one resident asked officials why the city makes it so difficult for law-abiding residents to possess guns and refuses to allow them to carry firearms outside of the home.
Paul Quander, the District’s deputy mayor for public safety and justice, responded that crime victims should give the criminals what they want. The resident protested, saying, “But how do you know you’re going live [sic] and survive? You’re completely at their mercy.”
Mr. Quander responded, “The problem is, if you are armed, it escalates the situation. It is much better, in my opinion, to be scared, to be frightened, and even if you have to be, to be injured, but to walk away and survive. You’ll heal, and you can replace whatever was taken away.”
The Times article further reported that Kristopher Baumann, head of the D.C. police union, also attended Cheh’s meeting. In response to deputy mayor Quander’s “crime-fighting” suggestions, Officer Baumann said, “Having the deputy mayor for public safety publicly announce that being victimized is something we, as residents of the District, must accept is disgraceful. At the same time, Mr. Quander failed to offer a single short- or long-term solution to fighting crime in this city.”
Worried About Your Metabolism?

ABATE OF MICHIGAN HELMET CASE– I recently represented a client in Manistee County who was issued a ticket for a violation of Michigan’s helmet law being MCL 257.658(4). After the District Court found my client responsible, I appealed the matter to Manistee County Circuit Court. As part of the appeal, the Circuit Court wanted the parties to address the issue of whether the language in the statute which requires the State Police to approve helmets was an unconstitutional delegation of legislative responsibility.
In my Brief, I essentially argued that as the statute did not give the State Police any standards or guidance to adhere to as they approved crash helmets, the statute did in fact constitute an unconstitutional delegation of legislature, i.e., the legislature was unconstitutionally giving the power to make the law to the State Police.
The Circuit Court agreed, and on February 23, 2012, entered an Opinion and Order reversing the District Court and dismissing the ticket. (P.S. The attorney listed in the caption is Lawrence Katkowsky as that is the attorney I was working for at the time the materials were filed.

VANITY LICENSE PLATE JOKE BACKFIRES–
Motorcyclist with “no tag” plate getting tickets from around country. An Irving man with the vanity plate “no tag” for his motorcycle is getting mixed up with cars that don’t have license plates and have been ticketed.
An Irving, Texas, man is getting tickets and fines for cars he doesn’t own — and his motorcycle’s license plate is to blame.
In the last year, Kirk Thor has received about a dozen notices saying he owes fines and fees across the country — from South Texas to Oklahoma, Nebraska and Florida.
The plate on his Harley Davidson motorcycle reads “NO TAG.”
“I saw a friend get a ticket that didn’t have a license plate on his car,” he said. “It said ‘no tag,’ and he didn’t have to pay for it. It never came back to him, so I thought to myself, ‘If I get this, maybe I won’t have to worry about getting tickets, either,'” Thor said.
But the plate has the opposite effect.
Thor, a doctor and local executive with a large company, figures police officers and deputies are writing down “no tag” in the plate description when writing tickets for cars without license plates. And Thor, who paid extra to get “NO TAG,” is getting the tickets.
But he said he doesn’t plan on changing his license plate to avoid the problem.
Thor said he loves putting vanity plates on his vehicles, saying it’s a way for other drivers to get a laugh.
Thor said the fines range from $300 to $600. He hasn’t paid and, so far, has explained away what has happened.
Thor said he has never personally received a ticket while riding his Harley.
“I mean, I’ve done nothing to ever get pulled over, so all of my tickets have come from other people’s transactions,” he said.
He has received letters and even a few phone calls from people asking him to pay the fees.
“They put a lot of pressure on you because some of them are collection agencies, so they’re just trying to do their job and make a buck,” Thor said.
When asked how he stays cheery about collection agencies calling his home to collect money he doesn’t owe, Thor said he thinks he laughs about it now because he’s only had the bike for a year.
“Maybe you guys should come back in 10 years and interview me and see if I have the same state of mind,” he said.

….and here’s the rest of the story:
So a local unknown Malaysian guy on the open Facebook Biker Friends page, sends me a note advising that my bike was possibly seen in a certain part of the city….went down there, handed out flyers to all of the security guards, and hoped for the best…..well, four weeks later one of those security guards called me and said that a moto besar (big bike) was in his condo and could possibly be mine….
I drove there, pulled the cover off the poorly hidden bike, and THERE SHE WAS! Asshole painted all of the tins flat black with a rattle can, but other then that, she was totally intact and untouched. Just a bit of overspray on the chrome.
The police ambushed and arrested the guy, and the bike will be heading back to the workshop for a fresh coat of paint. Without the power of social networking, I probably wouldn’t have gotten my bike back. That and a bit of Lady Luck!
A tip to everybody: Don’t worry about locking the ignition….lock the steering. They might take off in a hurry, but they’ll just go round and round.

MUDFLAP GIRL FXR ART PROJECT–
Not much of a teaser but here’s where art stands as of now. I should be able to finish the line art and start coloring it tonight.
Regarding the paint. My plan is to paint the forks, handlebars, frame, and swingarm with a heavy flake, color. I was leaning toward a bright redish purple. All my sheet-metal would be painted silver, with some matching Mudflap girl blue or purple graphics and pinstriping. My son’s bike will be the opposite.

THIS IS THE YEAR–We are going for it this year. But of course, there are the bullshit projects jumping into the fray.
We need to finalize the shipping of the V13R from the police impound next door. We completed the tie-down process this weekend.
We need to fill out a claim for headquarters damages, due to the construction along side our precious old 1923 building. Plus I need to peel to the city hall and collect a list of historic permits from its 88-year history, so we can review modifications and see what rights we have to make improvements. Just what I want to do, stand in line at the City Hall.
