As we reported last week, Massachusetts Attorney General Maura Healey unilaterally banned many common firearms via executive action. AG Healey’s “enforcement notice” has now come under attack by officials within the Massachusetts government, including many from her own party.
In a letter to AG Healey, Democratic State Representative Harold P. Naughton Jr. noted that “this recent directive, concerning so called ‘copies and duplicates’ of banned weapons in the current law is not only confusing, but the vagueness of the guidance has raised significant questions over which firearms are now banned or could be banned in the future.” Signaling his belief that Healey had overstepped her authority, Rep. Naughton cautioned “I strongly believe that any such review of our gun control laws should be a legislative matter to be considered by both the House and Senate along with public input.”
Naughton was not alone in his criticisms. 58 of his colleagues in the legislature signed another letter calling in to question the constitutionality of AG Healey’s action where they wrote:
For the last 18 years, the law has been implemented and enforced consistently, both by your office and your predecessors. Your new directive, which has been presented by your office as nothing more than a closing of ‘loopholes’ in the current law, appears in fact to be much more than that: the enforcement of a whole new law that unfairly infringes on the Second Amendment rights of law-abiding gun owners in Massachusetts.
Possibly the harshest critique of the substance of AG Healey’s new “enforcement notice” came from Daniel Bennett, the Massachusetts Secretary of Public Safety and Security. Secretary Bennett paid particular attention to the vagueness of the two-part test articulated in the “enforcement notice.” He raised substantial concerns that the new test could be read to apply to nearly any semi-automatic firearm when he directly asked AG Healey “Does your enforcement notice mean that your office considers any weapon, even a pistol like the M1911 that has these characteristics to be an assault weapon?”
Supporting the concerns raised by Secretary Bennett, Governor Charles D. Baker further noted that “ambiguities in [the] notice require clarification for responsible gun owners who simply want to follow the rules and for thousands of gun owners who were told they were following the rules for eighteen years.”
While this widespread government opposition to the action of a sitting attorney general may seem surprising, it is indicative of the clearly unlawful nature and vagueness of the “enforcement notice.” NRA continues to pursue all legal and legislative remedies to reverse this unilateral executive gun ban.

Motorcycles are efficient
Motorcycles make efficient use of road space in congested areas, require less parking space than cars, have a lower environmental impact and running costs, offer an affordable option where public transport is limited and walking or cycling is unrealistic.
There is a motorcycle for everyone
Motorcycles offer a credible alternative and there is a model for everyone, from the nimble city scooter to the long-range touring motorcycle.
Mobility is a challenge
In the European Union, over 60% of the population lives in urban areas where about 85% of the economic activity is produced. Most European cities are expected to keep growing, along with the demand for personal transport. Many urban areas throughout Europe are chronically congested and this congestion costs Europe €100 billion per year. Reducing congestion, pollution and accident risk while at the same time increasing mobility is major challenge for all major cities in Europe. Powered two-wheelers are a big part of the solution.
Greener cities
Electric scooters and motorcycles offer a high potential for urban and short-range transport. Their introduction could be accelerated with awareness campaigns, scrapping schemes for older vehicles, and the installation of more charging stations.
Safer vehicles & safety behaviour
In the majority of accidents, motorcyclists are not at fault, but are overlooked by car drivers. Awareness and training campaigns can help solve this problem. There is safety in numbers: with more scooters and motorcycles on the road, the accident risk decreases as car drivers learn to share the road with motorcyclists.
What can be done to promote the use of powered two-wheelers in cities?
• Access to bus and taxi lanes where possible
• Allow filtering for better sharing of the road space
• Allow parking on sidewalks where appropriate
• Privileged inner city access and exemption from congestion charges
• Inner city motorcycle and scooter parking areas, free of charge
• Advanced stop lines at traffic lights, shared with bicycles
• Favourable taxation schemes
• Awareness campaigns addressing the advantages of motorcycle use

Today’s record, held by Rocky Robinson since 2010 riding the Top Oil-Ack Attack streamliner, sits at 376.363 mph.

TALKING POINTS: A BILL TO ADDRESS MOTORCYCLE PROFILING —

o On July 13, Congressman Reid Ribble of Wisconsin introduced House Resolution 831 which addresses the issue of motorcycle profiling. Congressman Tim Walberg of Michigan is also an original co-sponsor.
o As a member of the Motorcycle Riders Foundation, we support legislation that would define and attempt to limit the practice of profiling of motorcyclists by law enforcement.
-Why This Issue is Important
o According to a recently conducted national survey, over 30% of respondents felt they had been profiled by law enforcement despite not committing any traffic infractions.
o The stereotype of the “criminal biker,” has been exacerbated by television shows like, “Sons of Anarchy” that depict motorcyclists as dangerous and unlawful citizens; responsible motorcyclists are suffering the consequences.
o Riding a motorcycle or wearing related attire is an individual’s chosen form of expression and is protected under the First Amendment.
o Further, the Fourth Amendment requires that law enforcement have a reasonable suspicion that a crime has been, is being, or is about to be committed before stopping a suspect and yet, over 30% of survey respondents believe they have been pulled over with no apparent reason and are victims of a “stop and frisk.”
o Riding a motorcycle or wearing motorcycle apparel does not equate bikers to criminals. We believe that through education and awareness, this issue can be addressed and mitigated.
-What Can Be Done?
o House Resolution 831 is the first step in addressing the profiling of motorcyclists at the national level.
o The Resolution promotes public awareness of motorcycle profiling and encourages
o Further, it urges state law enforcement officials to condemn motorcycle profiling in written policies and training materials.
o As H.Res.831 gains additional co-sponsors and advances through the House, it makes motorcycle profiling a national discussion and helps to raise awareness for those states considering the perusal of similar laws like those in Maryland and Washington.

Yes, we have made good with our customers. There was only a handful of them who made deposits and had not received their bikes.
Since our reorganization, we have made good with each customer and are actually in the final stages of the last two builds.
We are very grateful for our customers. We always have been. We simply got into a tough spot where overhead out paced production and put us in a negative cashflow challenge.
We are happy to report we are diversifying our offering so we don’t find ourselves in that position again. We are also receiving new bike orders and all is well.

UNCOMPROMISING AMERICAN MOTORCYCLES
PENNSYLVANIA “RIDE ON RED” LEGISLATION SIGNED BY GOVERNOR —
Pennsylvania has joined 16 other states in recognizing that motorcycles often do not trip the sensors that activate stop lights, mostly in rural areas. The new bill, called “Ride on Red,” has been signed into law by Gov. Tom Wolf. It allows drivers to proceed through a red light after pausing to make sure it is safe to proceed without infringing on anyone else’s right-of-way. Now, when a traffic signal is unresponsive to a driver, the driver can legally drive through the red light, rather than waiting at the intersection.
The bill was initially only for motorcycle riders, but was expanded to include other vehicles to allow drivers to legally proceed on a red light safely if their vehicle is not detected by sensors. It was signed into law on July 20 and takes effect around September 18, 2016.
The author of the bill, Rep. Stephen Bloom, said, “Governor Tom Wolf Wednesday signed into law legislation, including provisions, to give motorcyclists and other drivers the option to proceed with caution through an intersection when trapped at an unresponsive traffic light.”
“If the vehicle detection system fails to recognize the vehicle and the driver has come to a complete stop, the driver must then make sure it is safe to continue, and only then would they be able to lawfully proceed with caution through the intersection,” Bloom explained.
“This law does not give drivers a free pass, but ensures a safe and legal option to avoid the danger and inconvenience of being trapped in perpetuity at a locked red light,” Bloom said. “This issue is more common than many people realize, especially on rural roads or during late hours when long periods often elapse before a heavier vehicle comes along to finally trip the unresponsive light.”
Pennsylvania joins a growing number of states, most recently Indiana, that are passing laws to remedy the problem of stop light sensors not recognizing all vehicles.
