“Astroturf” in the Rose Garden? White House Insists “Everyone” Agrees, Ammo Ban is “Common Sense”—
On Monday, White House press secretary Josh Earnest said that President Obama supports the Bureau of Alcohol, Tobacco, Firearms and Explosives’–which is to say, President Obama’s–ongoing attempt to ban M855-type AR-15 ammunition. Obama “has long believed that there are some common sense steps that we can take,” Earnest said. “[E]veryone should agree that if there are armor-piercing bullets available that can fit into easily concealed weapons, that it puts our law enforcement [officers] at considerably more risk.”
For starters, notice Earnest’s words “everyone” and “common sense.” As investigative journalist Sharyl Attkisson recently explained, the use of such words is an “astroturfing” technique designed “to give the impression that there’s widespread support for or against an agenda when there’s not.”
In reality, Obama’s attempt to ban the second most popular ammunition for the most popular rifle in America is being widely and vigorously opposed.
More than half the members of Congress have signed House of Representatives Judiciary Committee Chairman Bob Goodlatte’s (R-Va.) letter to BATFE director R. Todd Jones opposing the ban. Strong opposition is also expected with a Senate opposition letter being spearheaded by Chairman of the Senate Judiciary Committee Chuck Grassley.
Large numbers of gun owners are contacting Congress, urging opposition to the ban. Gun owners are also contacting BATFE to convey their reasons for opposing the ban. (To assist gun owners, NRA-ILA provided initial information about the ban on February 13th, and additional details on February 18th.)
Furthermore, many in the law enforcement community oppose the ban. WND.com reports that the law enforcement officers it interviewed disagreed with the administration’s characterization of M855 as a special threat to men and women in blue. Asked if any law enforcement officers had been killed or seriously wounded by M855 fired from a handgun, Milwaukee County, Wisconsin, Sheriff David Clarke, Jr., said, “Not in my jurisdiction. We’re doing a search nationwide . . . but so far we haven’t found anything.” Similarly, Sgt. Dana Pierce, of the Cobb County Police Department, near Atlanta, said he’s never heard of any officer being shot at, or even threatened, by a criminal wielding an AR-15 handgun.

The 1939 Vincent HRD Series-A Rapide is not only the marque’s penultimate prewar machine, but was rescued from scrap and lovingly restored.

BAD BANKS NEWS FROM BIKERNET—Federal officials are investigating at least 10 major banks for price rigging in precious metals markets, said Jean Eaglesham and Christopher M. Matthews in the Wall Street Journal. The Justice Department is reportedly “scrutinizing the price-setting process of gold, silver, platinum, and palladium in London” and targeting several major firms, including HSBC, Barclays, Credit Suisse, Deutche Bank, Goldman Sachs, JPMorganChase, and UBS—over allegations that the banks manipulated metal prices.

GUN NUT WEEKEND REPORT–Committee Hearing Scheduled on a Bill to Ban the Sale and Possession of Legally-Owned Ivory in California.
Assembly Bill 96 is scheduled to be heard in the state Assembly Waters, Parks and Wildlife Committee on Tuesday, March 10. This legislation was written with the good intentions to help stop the illegal trade in wildlife, as well as poaching for meat and products such as horns and tusks. Unfortunately, AB 96 would do nothing to promote the purported goal of addressing poaching and the illegal ivory trade. AB 96 would only impose a heavy burden on law-abiding citizens and deprive them of the value of property that was originally obtained legally and in good faith.
Current California law exempts the possession with intent to sell, or sale of the dead body, or any part or product thereof, of any elephant before June 1, 1977, or the possession with intent to sell or the sale of any such item on or after June 1, 1977, if the item was imported before January 1, 1977.
AB 96 would delete this exemption and amend the law to prohibit a person from purchasing, selling, offering for sale, possessing with intent to sell, or importing with intent to sell ivory or rhinoceros horn, except as specified, and would make this prohibition enforceable by the Department of Fish and Wildlife.
The NRA is receptive to measures that directly target the illegal ivory trade and poaching, but Assembly Bill 96 would not contribute to that goal. AB 96 would harm those who have no part in these activities. American collectors, sportsmen, hunters, and recreational shooters have legally purchased firearms that incorporate ivory features for decades. These include some of America’s most historically significant and collectible guns. Historically, the U.S. Fish and Wildlife Service maintained the position that most ivory in the U.S. has been legally imported and that its sale in the U.S. did not materially contribute to the illegal ivory trade.
Why the NRA opposes banning lawfully-owned ivory in the U.S.:
Even for items at least 100 years old, the burden of proof would be on the seller to show that the ivory is old enough—a nearly impossible task, since a firearm or other item more than 100 years old may have been restored with newer ivory parts. Meeting FWS standards of proof would be challenging and expensive, as FWS will require evidence such as scientific testing, a “qualified appraisal,” or other “detailed history” information ranging from family photos to “ethnographic fieldwork.”
The proposed bans demand rigorous documentation to sell ivory that is more than 100 years old, documentation that private individuals typically do not have. Furthermore, there would be no accommodation for the numerous items made of legal ivory after 1915. Such items could not be sold, even with supporting documentation, and property that cannot be sold is radically diminished in value.
The NRA supports efforts to stop poaching and the illegal ivory trade, but the proposed restrictions on domestic sales of legally-owned ivory —from elephants taken long ago—will not reduce the poaching of elephants or illegal trafficking in ivory. On the contrary, a ban would affect only honest Americans by making their ivory—acquired lawfully and in good faith—worthless.

RADAR SYSTEMS FAIL SCIENTIFIC SCRUTINY ONCE MORE— Most longtime NMA members understand the weaknesses of using radar to measure vehicle speeds. However, less experienced drivers and even the courts regard radar as foolproof. Nothing could be further from the truth, and we have fresh evidence that further erodes radar’s patina of infallibility.
A member of the NMA Board recently attended a meeting of the American Academy of Forensic Sciences and was kind enough to forward us this description of one of the research presentations titled “Testing of Police Radar”. The research was conducted by two professional engineers, one of whom previously worked for one of the radar manufacturers.
The gist of the presentation is that, despite 30 years of technological innovations, radar still suffers from the same reliability and performance issues that have made it unacceptable as evidence in a court of law. The researchers state that radar cannot meet the requirements of the Daubert test, which is a set of standards trial judges use to determine whether or not expert testimony is based on valid scientific reasoning and methodology:
The reality of police radar is that it fails when subjected to the Daubert test. In this regard, police radar operation should be repeatable—this research demonstrates that it is not a repeatable technique and is, in fact, subject to operator interpretation when multiple targets are present.
The researchers tested several radar unit brands and units. With only one target, the units were consistent in their speed measurements. However with multiple targets, there was no guarantee as to which vehicle’s speed was displayed. They observe that “the radar units can well read different speeds … the decision to issue a citation is highly dependent upon the operator, relative to the instrument.” This refers to one of radar’s biggest downfalls: it can’t distinguish one vehicle from another.
The researchers further explain that radar can pick out either the strongest signal or the fastest signal, depending on road conditions and the mix of vehicles on the road. It cannot, however, pick out the speed of the nearest vehicle. They point out that radar “gun sights” intended to aid target acquisition are useless. They also note that one radar manufacturer allows the officer to black out the displayed speed of the police vehicle in moving mode to conceal from the motorist that the officer was exceeding the speed limit.
Even though the researchers come from a technical/scientific background, they have the presence of mind to point out that radar speed enforcement encourages policing for profit. The NMA has been making this argument for years, but we have seen few other observers make the same connection between shoddy speed enforcement and revenue generation. The researchers further warn that using unreliable radar readings as an excuse to conduct a traffic stop and execute a questionable vehicle search raises Fourth Amendment questions:
But some jurisdictions use strict traffic enforcement as the basis of presumptive traffic stops—they will issue a warning for the traffic violation and instead are looking for a reason to search a vehicle for contraband.

Overall, the study further supports the conclusion that radar speed measurement is unreliable, easily misused and often abused for revenue purposes. In the NMA’s “Fight That Ticket!” e-book, we show you how to use the many kinds of radar error to undermine the officer’s scripted testimony. When you prove to the court that what the officer has testified to is physically impossible or technically violates proper radar procedures, the prosecution’s case will be seriously compromised.

Hundreds of Lawmakers Sign Letter Opposing Proposed Ban on AR-15 Ammunition—
This week, in an overwhelming show of bipartisan opposition, 238 Members of the U.S. House of Representatives signed a letter to the director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, opposing the Obama Administration’s attempt to ban commonly used ammunition for the most popular rifle in America, the AR-15. The NRA worked closely with House Judiciary Committee Chairman Bob Goodlatte (R-Va.) to gather signatures on this critical effort.
“This letter sends a clear message to President Obama that Congress opposes his attempt to use his pen and phone to thwart the will of the American people,” said Chris W. Cox, executive director of the NRA’s Institute for Legislative Action. “Obama said he would enact his gun control agenda ‘with or without Congress.’ He is now trying to make good on that promise. The NRA would like to thank Chairman Goodlatte and all who signed the letter for opposing this unconstitutional attack on our Second Amendment freedom.”
The NRA is working with Senator Chuck Grassley (R-Iowa) on a similar letter of opposition from the U.S. Senate. Please contact your U.S. Senators and urge them to sign Sen. Work has resumed at West Coast ports after nine months of slowdowns and stoppages, said Andrew Khouri in the Los Angeles Times, but it could take months to clear the backlog of cargo.
Some 20,000 dockworkers struck a tentative five-year deal with their employers this week, after months of tense negotiations slowing trade through 29 West Coast seaports, which handle roughly 40 percent of incoming U.S. cargo. The protracted dispute has cost businesses across the country millions.

So, what’s up for this week. I’m going to crawl out of bed at 5 am for a week and read my book chapters, so I can move this book to the next stage of publishing. I’ve written several books and enjoyed the process immensely. I haven’t been tremendously successful, but I will attempt to take all I have learned and pour it into, what might be my last book effort.
Then we have several techs coming, a Rocketeer feature. And we may have some serious excitement coming for Cantina Members.
Never a dull moment, that’s for sure.
