HIGHLY SENSITIVE SUNDAY POST for July 12th, 2015

Hey,

It’s a riot how life changes so quickly. A lot of this rapid-fire decision making comes with our multiple communication devices, good and bad.

You could be all set to go in one direction for six months, then presto everything changes. I try to follow a couple of simple mantras: One is never give up. Pause, take a break, regroup, but don’t give up. That mantra could apply to painting your bathroom or building a world class, land speed record trike.

It also applies to writing a book, building the next project bike, or building a deck alongside the blue collar, Bikernet Headquarters.

It’s incredible how time can slip away, but staying focused is the key. We found out this week that our 45 Bonne Bell won’t be ready for Bonneville this year. It rapidly doesn’t look like our Trike will be ready, and I will need to make some decisions quick. So, we thought, Great! We can focus all the team’s attention on the magnificent Ray Wheeler. His bike is ready, tuned, and hot to trot.

I spoke to the Performance Editor the other day, and suddenly he discussed selling mufflers on the streets of Sturgis over setting a World Land Speed Record or two. Hell, Tobey, our Dr. Feng race pilot is poised to ride the 5-Ball Wheeler Racer at a moments notice. WTF?

This juried show pays homage to the people, machines, industry and lifestyle that created and sustained one of the world’s largest motorcycle gatherings. The exhibit features photographs by Steve Babbitt and Michael Lichter, vintage advertisements and photographs from the Rapid City Journal and original works of art from 17 artists responding to the motorcycle theme.

BAD COP REPORT–Tucson PD releases names of people possibly connected to prostitutes — after removing those who happen to be cops

The Tucson police department is publicizing hundreds of names and phone numbers that appeared in some cellphones confiscated from several massage parlors around the city. Of course, there could be any number of reasons someone’s number might appear in the phone of a woman working for a massage business that has been accused of prostitution. She might have her handyman or dentist in her phone. Perhaps her friends are in there. Wrong numbers, too. There may even be a city councilman in there, for completely innocuous reasons.

So far, no one whose information was found in the phones has been charged with a crime. That’s why at least some local media are refusing to publish the names.

Bizarrely, Tucson Police Chief Roberto Villaseñor confirmed as much when he told the Arizona Daily Star, “The inclusion of information in this list is in no way indicative of involvement in criminal activity.”

So why release the information? Well, to embarrass these people, of course. It’s a form of extra-judicial punishment for what an as-yet unproven, nonviolent, consensual crime.

Don’t agree? Consider this:

Two Tucson police officers have resigned and five more are still under investigation by internal affairs in connection with their possible involvement in a long-running prostitution ring.

The number of officers believed to be involved has almost doubled since April, when interim City Manager Martha Durkin sent a memo to the mayor and council saying four Tucson police officers had been placed on paid administrative leave for “allegations related to criminal activities.”

The two officers who resigned did so while on administrative leave, and it’s likely they’ll still be part of an ongoing Arizona Department of Public Safety criminal investigation, said Tucson City Attorney Mike Rankin.

The DPS investigation could be completed within 30 days, a department spokeswoman said.

The names of any officers found to be involved won’t be released until after the investigation and the appeal process are completed, said Tucson Police Chief Roberto Villaseñor.

So, before releasing the names of hundreds of people who appeared in the phones, the city police checked the names against the city’s roster of police officers. They then redacted those names, and released all the others. The police officers’ information won’t be released until they’ve had a chance to clear their names through an internal investigation. As for everyone else, well, good luck explaining to your spouse, your kids, your boss and anyone else who might want to know why your name or number appeared in an accused prostitute’s cellphone. Sure seems like two-tiered justice to me.

You also have to wonder how much law enforcement money and manpower has been wasted on the initial investigation, the investigation of the investigation, the PR nightmare and the accompanying fallout. And it was all to stop consenting adults from paying other consenting adults for sex.

Last week we shared the harrowing story of former CNN Headline News anchor Lynne Russell and husband Chuck de Caro, who exercised their right to armed self-defense to stop a gun-wielding robber who forced his way into their Albuquerque, N.M. motel room. Espousing a straightforward logic that even gun control supporters should be able to grasp, Russell stated, “If you don’t want to carry please don’t. Then, shut the f–k up about it. Make your own decisions.”

Both Russell and de Caro are Right-to-Carry permit holders, and in an interview with Fox News following the shooting Russell had some choice words for anyone that would deprive them of the right to bear arms.

Russell elaborated on her pro-gun position stating, “The discussion over the debate to own a gun is just ridiculous. As Americans we have the right to bear arms and as humans the right to protect ourselves. I’m sure that the man who shot my husband did not have a gun permit. Criminals will always have guns. The rest of us legally obtain our gun permits.”

While some might find a portion of Russell’s vehement defense of gun rights a little inartful, considering the tenor and accuracy of Second Amendment “reporting” on the “Worldwide Leader in News,” we hope that CNN considers re-employing Russell to provide an honest and diverse viewpoint.

TRIUMPH MOTORCYCLE NEWS– Guy Martin and Triumph Attempt to Bring the Record Back Home

Triumph Motorcycles confirms new land speed record attempt in August 2015

* TT legend and adrenaline junkie Guy Martin confirmed as pilot for the Triumph world record attempt
* The Triumph Rocket III Streamliner is powered by two 2.3-litre Triumph Rocket III engines, producing 1,000 bhp
* Federation Internationale de Motocyclisme (FIM) world record attempt to take place at the Bonneville Speedway, Bonneville Salt Flats, Utah – 24-27 August 2015

Triumph, the iconic British motorbike brand, has confirmed its intention to break the motorcycle land speed record at the salt flats of Bonneville, USA, in August 2015. While the current record stands at 376.363 mph, the Triumph team is aiming to surpass that over the measured mile.

Piloting the purpose built, 1,000 bhp Triumph Rocket Streamliner will be Isle of Man TT racer, truck mechanic and TV presenter Guy Martin. Well known for his love of speed, Guy is relishing the prospect of bringing the land speed record back to Triumph – and the UK – after an absence of 45 years.

Triumph has a long legacy of smashing the land speed record and held the title of “World’s Fastest Motorcycle” from 1955 to 1970 with the exception of a brief 33-day period. The record-breaking Triumph streamliners of that period were Devil’s Arrow, Texas Cee-gar, Dudek Streamliner and Gyronaut X1, the former achieving a top speed of 245.667 mph (395.28 km/h). Today’s bar, held by Rocky Robinson since 2010 riding the Top Oil-Ack Attack streamliner, sits at 376.363 mph (605.697 km/h).

The 2015 Triumph Rocket Streamliner features a carbon Kevlar monocoque construction with two turbocharged Triumph Rocket III engines producing a combined 1,000 bhp at 9,000 rpm. The motorcycle is 25.5′ long, 2′ wide and 3′ tall. Powered by methanol fuel, the bike is competing in the Division C (streamlined motorcycle) category.

The iconic Bonneville name was conceived following Johnny Allen’s land-speed record runs at the Salt Flats in September 1955, when he reached the record-breaking speed of 193.72 mph. The first T120 Bonneville model was unveiled at the Earls Court Bike Show and went on sale in 1959.

With final testing scheduled at the Bonneville Salt Flats in mid-July, the record attempt will take place 24-27 August, 2015.

Federal Regulators Breathe Life into Marijuana Businesses Even as They Seek to Choke Out FFLs–
By now, knowledgeable members of the pro-gun community are well aware of Operation Choke Point (OPC) and its effect on lawful firearm-related businesses. As we have often reported (here, here, and here, for example), OPC is a deliberate attempt by federal regulators to pressure banks to sever or avoid business relationships with legitimate industries that are considered politically objectionable, including firearms and ammunition sales.


The House Oversight and Government Reform Committee has issued reports condemning the participation of both the Federal Deposit Insurance Corporation (FDIC) and the Department of Justice (DOJ) in the program. Internal investigators at both agencies have also launched their own probes into allegations of abusive practices under the guise of OPC.

According to a recent article by State Net (a provider of legal research tools), however, the administration’s use of banking regulators for political purposes goes both ways.

Titled “Cashed Out: Legal Weed Outlets Flush In Cash Struggling To Find Banks,” the piece recounts the “unique problem” facing prosperous marijuana businesses operating legally under state laws that are finding banks reluctant to provide them with services. This is perhaps not surprising, given that marijuana distribution is still, after all, a federal crime, and banks that knowingly do business with marijuana dispensaries could expose themselves to criminal prosecution. According to the article, “That prohibition could even chain out to include security companies that provide legal weed outlets with security or transportation services.”

Yet who’s seeking to “mitigate the problem” of banks shying away from participating in actual criminal activity? Why none other than Obama’s Treasury Department and DOJ. According to the article:

[The U.S. Treasury Department’s] financial enforcement arm, the Financial Crimes Enforcement Network or FinCEN, issued guidelines in 2014 that gave banks a pathway for dealing with marijuana businesses. Those include a requirement that such businesses take responsibility for making sure their marijuana clients are obeying the laws of their state and notify federal authorities of suspicious transactions. Other actions have since followed, including a Department of Justice directive to U.S. Attorneys ordering them not to prosecute banks that deal with pot sellers as long as the banks adhere to federal guidelines.

Considering how lawful firearm and ammunition business have been systematically cut-off from access to necessary financial services by abusive government regulators, we just had to know if this was true. The short answer is “yes.” The administration’s position seems to be that it will ignore unlawful activity it doesn’t agree with, while attacking lawful activity it finds objectionable.

The FinCEN guidance document explicitly sets out to “enhance the availability of financial services for, and the financial transparency of, marijuana-related businesses.” In that vein, the document describes DOJ enforcement priorities for marijuana-related enforcement and counsels financial institutions to keep these in mind when making decisions as to whether or not to service marijuana-related businesses.

It also provides advice for conducting “customer due diligence” and filing mandatory “suspicious activity reports” of varying detail depending on the bank’s assessment of the customer’s risk profile. The document concludes with reassurance that “FinCEN’s enforcement priorities in connection with this guidance will focus on matters of systemic or significant failures, and not isolated lapses in technical compliance,” and encourages banks to contact the agency with further questions.

DOJ’s memorandum directly addresses “ALL UNITED STATES ATTORNEYS” and is similarly blunt and to the point. While acknowledging that “provisions of the money laundering statutes, the unlicensed money remitter statute, and the Bank Secrecy Act (BSA) remain in effect with respect to marijuana-related conduct,” it points federal prosecutors to a limited list of eight enforcement priorities. These include such things as businesses that divert revenue from the sale of marijuana to criminal gangs and cartels and that “use … firearms in the cultivation and distribution of marijuana … .” It goes on to state, however: “Conversely, if a financial institution or individual offers services to a marijuana-related business whose activities do not implicate any of the eight priority factors, prosecution for these offenses may not be appropriate.”

The DOJ memo does, however, insist that is merely “a guide to the exercise of investigative and prosecutorial discretion” and “does not alter in any way the Department’s authority to enforce federal law, including federal laws relating to marijuana, regardless of state law.”

Ironically, a number of the “due diligence” steps the memos mention as a means of facilitating the provision of financial services to state-legal marijuana businesses are, in the context of doing business with firearm-related companies, among the forces driving banks to drop customers. This is likely because banks are being systematically indoctrinated by federal regulators to consider firearm businesses as inherently risky, if not inherently criminal. Yet unlike marijuana sales, sales of firearms and ammunition are not only legal, but even as an Obama-appointed judge acknowledged, protected by the Second Amendment itself.

That’s a distinction that’s apparently lost on the Obama administration, however, which certainly never lets “details” like democratically-passed laws (or even constitutional amendments) get in the way of its relentless political agenda, a defining priority of which is to undermine lawful gun ownership.

HANG ON!— Sturgis and Bonneville is just around the corner. I need to wrap up my Indian paint article before I ride back from the Badlands. But first the SmokeOut 16 Report must be completed and launched. Damn 16, how did it get that old.

I also can now wrap up my Shige, Triumph feature. He owns Mooneyes. It’s going to a busy week.
