How about a new rule. If you want to pass a law to create some legacy in your life and you can’t write a book or do something constructive like build a home or a motorcycle, abide by this law: for every new law passed, five must be eliminated, repealed or made toast—adding Independence. I like the sound of that.

BIKERNET UNIVERSITY INDEPENDENCE LESSON OF THE WEEK– The Fourth Amendment of the U.S. Constitution provides “the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
Pretty straight forward really—the Fourth Amendment protects a citizen’s right to privacy and freedom from arbitrary governmental intrusions. This week however, the Fourth Amendment took another blow by none other than the US Supreme Court. In a 5 to 3 decision in UTAH vs. STRIEFF, the dissenting opinions were a scathing rebuke of current police practices. Essentially, this case focused on whether or not a law enforcement officer can stop someone on the street without probable cause, ask for an ID, run a warrant check and arrest that person due to an outstanding warrant, then search the person to attempt to find evidence of a different crime. ‘Someone’ could be a motorist, a bicyclist, or a pedestrian.
Let’s face it, stopping people on the street by police generally does not happen often in middle class communities. It is a more common action in communities where crime is high and where outstanding warrants are just as likely for people who cannot pay for outstanding traffic tickets and other court fees. One of the reasons that the Supreme Court majority ruled in favor of the state of Utah had to do with what they thought was ‘an isolated incident’ and ‘good faith mistakes’ by the officer who, pretty much everyone agreed, stopped Strieff illegally because there was no reasonable suspicion to do so.
But in reality as both the two dissenting authors Justices Sotomayor and Ginsberg pointed out this was indeed not an isolated or good faith detention of a citizen.
Justice Sotomayor wrote in her eloquent dissent that the Utah Supreme Court described that it is common practice for Salt Lake City police officers to run warrant checks on pedestrians who are detained without reasonable suspicion. She wrote that in the related context of traffic stops, one widely followed police manual instructs officers looking for drugs to “run at least a warrant check on all drivers stopped.”
Justice Sotomayor added that statistically speaking, narcotics offenders are more likely to fail to appear on simple citations which include traffic violations. This leads to the issuance of bench warrants. When police discover an outstanding warrant during a routine stop, the police officer can arrest and then search the now suspect.
Outstanding warrants are surprisingly common. The number of actual outstanding warrants and the police procedures that Justices Sotomayor and Ginsberg address in both of their dissents is shocking: The States and Federal Government maintain databases with over 7.8 million outstanding warrants, with the vast majority appearing to be for minor offenses.
Ferguson, MO with a population of 21,000 has 16,000 people with outstanding warrants New Orleans police in a single year made nearly 60,000 arrests with about one third of those arrested having outstanding traffic or misdemeanor warrants from neighboring parishes for such violations as unpaid tickets.
In the St. Louis metro area, law enforcement officers make it a regular practice of stopping people on the street for no reason other than to check to see if the person had a municipal arrest warrant pending.
In NYC, officers are trained to stop and question first, develop reasonable suspicion later. With a population of 8.4 million people, NYC currently has 1.2 million outstanding warrants.
California has 2.5 million outstanding arrest warrants which corresponds to about 9% of its adult population.
Pennsylvania with a population of about 12.8 million has 1.4 million warrants for its citizens.
In a more personal statement in her dissent to UTAH vs. STRIEFF, Justice Sotomayor drew a link to racial inequity that pervades the criminal justice system. “It is no secret that people of color are disproportionate victims of this type of scrutiny.” She added, “We must not pretend that the countless people who are routinely targeted by police are ‘isolated.’ They are the canaries in the coal mines whose deaths, civil and literal, warn us that no one can breathe in this atmosphere. They are the ones who recognize that unlawful police stops corrode all our civil liberties and threaten all our lives. Until their voices matter too, our justice system will continue to be anything but.”

5-BALL LEATHERS PIT CREW ROAD TEST— We originally designed the 5-Ball Pit Crew Vest as a vest for the Pits, or for traveling and maybe not riding, something that wasn’t heavy or all leather.
This last weekend it was warm in Los Angeles, like 83 on the coast and 88 in North Long Beach, so I decided to take a run on the Indian wearing the Pit Crew. As it turned out the asphalt road led inland and hit 95 degrees, but I immediately noticed how the Pit Crew Vest started to breathe.
It was sort of amazing and I discovered a new application for the Pit Crew, it became damn handy in the extreme temps. The Pit Crew is a tough and durable vest built basically with ballistic Nylon, capable of deflecting shrapnel, but it also breathes. So if you’re working in the hot pits, but need to carry shit like a camera, a phone, keys, tools, you name it, the Pit can do the job and cut you some slack from the heat at the same time.
Plus, this puppy contained our exclusive Media pocket in the back for magazines, I-pads, files, you name it.
I was impressed as I cut through the Wilmington ghetto on the way back to the Bikernet digs on the edge of the Los Angeles Harbor.

AMC’s “Ride with Norman Reedus” Visits Furnace Creek Resort in Episode 2;

For years, Death Valley National Park has been a popular location to film movies and TV shows, and the latest to visit was AMC’s new travel series, “Ride with Norman Reedus” (AMC, Sundays at 10/9c). Mr. Reedus, known for riding motorcycles and killing zombies in “The Walking Dead,” explores Death Valley in episode two of the travel docu-series, which is now available online at AMC.com, the AMC app, or via iTunes, Amazon, Google Play and Xbox.
“Death Valley: Dante’s View” follows Mr. Reedus and actor/friend Balthazar Getty as they embark on a Las Vegas joyride to Death Valley, spending the night at the Inn at Furnace Creek and riding through volcano-formed mountains and painted canyons to Dante’s View. Reedus exclaims as he looks out over Death Valley and the Badwater salt flats, “This is probably the prettiest thing I’ve ever seen.”

Riki Rachtman, former host of MTV’s Headbanger’s Ball and current host of the nationally syndicated radio show Racing Rocks, started today on his third annual running of Riki’s Ride, an epic motorcycle trek that traverses North America.
“I’m going to hook up with friends in Los Angeles,” says Rachtman. “We’re going to ride from Mexico up to Canada– then head towards North Carolina. Which leaves us a lot of America to see in between.”

A small group of us departed Lowbrow for a 3,000+ mile jaunt West, North, South, East all over the dang country, hitting 12 states along the way. It was the perfect way to test the Pan-American S&S-powered 93-inch Panhead that was finished just a couple days before we left.

The first round of the RFME Flat Track Cup will be on July 9 and 10 at the Ricardo Tormo Grand Prix circuit. An oval track, that is the exact replica of the famous Lodi Cyclebowl in central California, is under construction. The series Champion will fly to Daytona in March to compete in the opening round of the 2017 AMA Pro Flat Track championships. Both the Masters and Rookie champions will be invited to compete in special races in Spain or Italy.

INDIAN MOTORCYCLES TO RACE AMA PRO FLAT TRACK
Jared Mees with be its star rider. The factory Indian Motorcycle team has been developing a brand new, dirt track specific, liquid-cooled V-twin race engine, the Scout FTR 50. It is in partnership with their Swiss-Auto subsidiary. They plan on running it in one race this year and compete for the full season in 2017. Welcome back.

There were rumors that Volkswagen/Audi would sell Ducati as part of a sale of assets. Money needs to be raised to pay for repairs of about 11 million cars affected by the emissions-cheating scandal of 2014. So far no word as to how the VW group will pay, but Volkswagen/Audi said that Ducati will not be sold.

Harley Davidson will build a production version of the two-year-old LiveWire concept bike within the next five years. Lots of work to do. Victory has already raced an electric motorcycle at the Isle of Man TT and soon Pike’s Peak.

South Australian biker to be deported despite having lived here since age two

An Adelaide father with a longterm fiance is set to be deported to the UK despite having lived in Australia since he was two.
Immigration Minister Peter Dutton has stripped Paul Burgess of his permanent residency visa on character grounds because he has a criminal history and had a motorcycle club connection.
But his family and lawyer say he was only connected with the Comancheros motorcycle club for two months in 2013 and that his crimes are “not of the same nature” as those of others who have been kicked out of the country.
Minister Dutton, a one-time QLD cop before entering politics, has sweeping powers to cancel visas without notice.
It was reported earlier this month that two Adelaide men had been deported to Christmas Island by Dutton — Mr Burgess and Mongols treasurer Andrew Peter Stevens.
Mr Burgess’s fiancee, who declined to be named, said he was “not the face of organized crime”.
“His whole life has been here,” she said.
“Peter Dutton (talks about) the misery inflicted on mums and dads; well none of that has been inflicted by Paul.
“The only misery being caused is on our five-year-old Australian son who has been left without a dad.”
One criteria for cancelling visas is that a person has to have been sentenced to prison term of 12 months or more.
In 2003 Mr Burgess was sentenced to 15 months for assault and robbery, but he only had to serve three months.
His family says he is no angel but has been unfairly targeted.
Mr Burgess was taken from his home with no warning and sent to the Christmas Island detention centre to await his fate. His lawyer hopes to take the case to the Federal Court but concedes the case could be “futile” because of the arbitrary nature of the laws.
Solicitor Mitchell Simmons, of McDonald Steed McGrath lawyers, said the authorities made it “as hard as possible” to help Mr Burgess.
“Under these powers, the Act says they don’t have to follow natural justice, or procedural fairness,” he said.
Mr Simmons said it seemed to him the Government had already deported many serious criminals and was now going after smaller fish.
“It’s just not of the same nature,” he said, adding that Mr Burgess had not been charged with any crimes relating to motorcycle club activity.
In a “notice of visa cancellation”, Dutton notes that deportation would cause severe hardship.
“I have considered that he would experience severe emotional and psychological hardship in being separated from his family,” he wrote.
Dutton told media that “criminal bikie gangs pose considerable threats to the Australian community”.
“Protecting the Australian community is the highest priority of the Turnbull Government,” he said.
“If foreigners are involved in serious criminal activity, I won’t hesitate to cancel their visa and have them removed from our country.”

BIKERNET MEDICAL CENTER SCARE OF THE WEEK—Dying by accident.
Fatal mishaps are on the rise: Every four minutes an American dies from an unintentional injury, the National Safety Council reports, making accidents the nations’s fourth leading killer—surpassing stroke, Alzheimer’s desease, diabetes, flu, and suicide (wait, what about medical accidents the wrong medications and hospital infections).
The research is based on federal statistics, found that more than 136,000 people in the U.S. met an accidental deather in 2014—a 4.2 percent jump from the previous year and 15.5 percent more than a decade earlier.
Opiod and heroin abuse is fueling the trend, the report says, as over-doses and poisonings have increased 78 percent since 2005. Meanwhile, old farts are falling down more and that stat surged 63 percent over the past 10 years, while vehicle deaths dropped 22 percent.
Recently we heard that 220,000 folks die annually due to medical errors, and 150,000 peeps die each year from hospital infections. So, what’s it going to be?
Oh, and don’t forget 5,000 motorcycle deaths. Better pass another helmet law—I’m kidding.

QUICK, GUN NUT REPORT– California: “Gutting and Amending” the Second Amendment
Anti-Gun legislators in California have been clear on their targets this year, the Second Amendment and law-abiding citizens. Now joining the numerous anti-gun bills that are pending votes in the Senate and the Assembly, Assembly Member McCarty has “gutted and amended” two more pieces of legislation into anti-gun bills.
While these bills originally covered completely separate subject matters until this week, they now are aimed at arguably the most law-abiding citizens, CCW permit holders.
Assembly Bill 450, will now require fees for CCW permits to not only cover issuance but also enforcement. The enforcement aspect is so broadly worded that it’s unclear what the author is even trying to accomplish other than to allow such ambiguity that law enforcement could price out ordinary citizens.
Assembly Bill 466 does not have official amended language available as of today. However, according to a press release by the author “Would require that the applicant present facts to distinguish the applicant from the average person and must show that the applicant faces greater harm than the general public.”
AB 450 is scheduled to be heard by the Senate Public Safety Committee on Tuesday, June 28. Please contact the members of the committee and Assembly Member McCarty to respectfully express your opposition requiring more fees to exercise your right to self-defense. FLORIDA Deputy charged in killing–
The Florida Department of Law Enforcement on Tuesday arrested a Brevard County Sheriff’s Office deputy in connection with the fatal June 19 roadside shooting of a 25-year-old man in Palm Bay.
Yousef Hafza, 32, was charged with second degree murder and attempted second-degree murder in the shooting death of Clarence Howard. Hafza was off duty at the time of the incident and was not acting in the capacity of a law enforcement officer at the time of the shooting, FDLE said.
The sheriff’s office said Hafza has been a deputy since November 2015 in the West Precinct Patrol division. He previously served with Palm Bay Police Department, Orange County Sheriff’s Office and West Melbourne Police Department.
Sheriff Wayne Ivey spoke to media at the sheriff’s office in Titusville on Tuesday afternoon, emphasizing the importance of having FDLE conduct an independent investigation.
‘Pursuant to the arrest, Hafza was immediately suspended from our agency without pay pending an administrative review of the incident.
Once FDLE has completed their investigation, they will provide a copy of the findings, which will furnish the information required to complete the administrative investigation.’
Ivey said that it was important for FDLE and BCSO to keep their investigations separate to maintain the independence of the outside agency.
The shooting took place just after 11 a.m. on June 19 near St. Johns Heritage Parkway and Emerson Drive, where Hafza reported that two men were chasing him.
Family members said Howard and the car’s driver were out getting air for a bicycle when the incident happened.
FDLE described the confrontation between Hafza and Howard as a road rage incident that occurred after the two nearly collided. The driver of the car and Howard began following Hafza when they stopped and exited their vehicles, according to reports.
There also may have been a self-defense component of the shooting, Ivey said, but he could not offer specific details about the nature of the confrontation. Initial reports from law enforcement officials said that there were no other weapons present at the scene other than Hafza’s gun.
‘The thing with self defense is the state attorney’s office has to look at it and see if self-defense applies. They looked at the case and felt that these were the appropriate charges,’ he said.
No information was available on whether or not Hafza used his service weapon in the shooting, but Ivey told reporters deputies are allowed to be armed while off duty.
‘We encourage our deputies to always be armed and most of them do. I would think almost all of them do. Generally speaking, they’re going to be carrying their firearm,’ he said.
Hafza, a West Melbourne resident, was taken to Brevard County Jail where he is being held without bond. He is represented by attorney Martin White, who was reluctant to talk about the details of the case on Tuesday.
Hafza and his attorney chose to have the first appearance waived by Judge Michelle Baker on Tuesday afternoon.
‘Of course he’s upset and distraught… he’s hanging in there,’ White said of Hafza. He also maintained his client’s innocence and declined to comment on why he made the decision to waive the first appearance.
No future court dates have been scheduled for Hafza, according to the clerk of courts website.
Howard left behind three children after his death on Father’s Day. Family members said Howard grew up in Melbourne and was a drummer in church. In recent years he worked moving furniture and was raising his three children with his girlfriend.

WOMAN BREAKS WORLD RECORD on 11,236 Mile Motorcycle Expedition–
Brand new motorcycle driver Deena Mastracci left the California Department of Motor Vehicles on June 1 with her new license, rode out of the parking lot and proceeded to set the record for the “Longest, Continuous Journey by a New Licensee,” which included traversing Alaska and the Arctic Circle.
Deena Mastracci never says no to a new challenge. Refusing to be outdone by her fiancé, professional endurance driver Carl Reese, (who set the fastest time on a motorcycle from Los Angeles to New York), Mastracci decided to set her own long distance motorcycle record; but first, she needed a motorcycle license, no easy feat in itself.
Mastracci’s cross-country trip of more than 11,000 miles began June 1 in Santa Clarita, California. She had no prior on-road experience other than that gained at a one-day class at Streetmasters Motorcycle Workshops—on a closed racetrack—as part of her preparation and a Motorcycle Safety Class given at the local college for her motorcycle test.
The coast-to-coast ride by way of the Arctic Circle was no vacation as Mastracci encountered a variety of challenging road conditions, including snow, mud, ice, 50 mph wind, flooded roads and golf ball sized gravel. Her route included the full length of the Dalton Highway (one of the world’s most dangerous roads), a treacherous road that leads to Dead Horse, Alaska over the Brooks Mountain Range.
Her journey included pit stops in Prudhoe Bay, Alaska; Denver, Colorado; Brookfield, Connecticut; and Grand Rapids, Michigan before concluding in New Bethlehem, Pennsylvania. Mastracci covered an average of 400 miles per day. During the third week of her journey, she travelled 1,000 miles from Denver, Colorado to Hammond, Indiana within a 24-hour time period, a feat that is only attempted by the most seasoned riders, often referred to as an “Ironbutt Challenge.”
Mastracci’s total mileage of 11,236 miles surpassed the previous record of 9,000 miles held by Clif Chu set back on July 23, 2012. Clif’s journey was witnessed by William Schoetteler.
A look at Mastracci’s record-setting route
Mastracci’s very first motorcycle ride was not only a successful attempt to set a record for “Longest Distance Traveled by a New Motorcycle Licensee,” but was also a way to bring attention to the work of the Motorcycle Relief Project, a nonprofit charity that helps veterans with PTSD and other injuries.
The group arranges multi-day motorcycle tours and other activities and also offers counseling for veterans in an effort to decrease suicides. Additionally, Mastracci hoped her ride would inspire other women who may feel intimidated by driving a motorcycle.
“My journey was the trip of a lifetime: a terrifyingly beautiful ride and an incredible learning experience all in one,” said Mastracci. “Everything about the voyage was a challenge for me. From navigating in traffic to maneuvering through mud and ice, it was very tough. While challenging, this journey was nothing compared to the trials that our armed forces face on a daily basis, which is why the work that the Motorcycle Relief Project does is so important to me.”
Reese, who followed Mastracci on the journey on a separate motorcycle as a safety precaution, said, “It was remarkable to see how Deena evolved as a rider over the course of her journey. Going from no on-road experience to tackling more than 11,000 miles over the course of 27 days is nothing short of epic! I am so proud of her for taking on and conquering such a challenge.”
No stranger to setting records, Mastracci (together with Reese and Rodney Hawk) already holds the Guinness World Record for the “Shortest Charging Time Cross-Country Trip in an Electric Vehicle” and as part of Reese’s driving team, has helped set records for the “Fastest Time for Crossing the USA in an Electric Vehicle (EV)” and for a “Double Transcontinental Trip (LA-NYC-LA).”
She holds a total of five EV records all set with a Tesla P85 D. Whether as a couple or individually, Mastracci and Reese are always seeking to accomplish new driving feats. For this record attempt, Mastracci rode a used F800GT BMW motorcycle purchased at West Valley Cycle Sales in Los Angeles, CA, the oldest BMW Motorrad Dealer in the United States. This attempt was Mastracci’s first individual record, and has been submitted to Guinness World Records book for formal verification.

RACE NEWS FROM YAMAHA–Yamaha Motor Corporation U.S.A.’s Customer Support Group announced Steve Maltba of Fayetteville Powersports in Fayetteville, North Carolina, as the 2016 U.S. Technician Grand Prix (USTGP) Champion. Maltba will represent the United States at Yamaha’s World Technician Grand Prix (WTGP), a head-to-head competition of international Yamaha-trained technicians to be held in October at Yamaha Motor Co., Ltd., world headquarters in Iwata, Japan.
Maltba and five other Yamaha Technical Academy (YTA) Gold Level training graduates earned invitations to this year’s competition by achieving the highest scores in YTA Gold classes conducted between fall 2013 and spring 2016.
Finishing second and third, respectively, were Joshua Fugate, CC Powersports, Louisville, Kentucky and Bryan Harner, Wild West Yamaha Camp Hill, Camp Hill, Pennsylvania.

BIKERS SUPPORT OUR FLAG–
According to recent reports, a group of anti-NYPD protesters were forced to rely on the law enforcement they were disrespecting when they were approached by a group of angry bikers.
The protesters, called Disarm the Police, were engaging in a flag burning at Fort Green Park when they were confronted by 40 members of the Hallowed Sons Motorcycle Club.
“They lit the f**king flag and took off running once they got slapped once or twice,” one biker told reporters.
In an ironic turn of events, police had to step in to protect the anti-police group.

The Historic RED BUD Motocross to Host PIRELLI RIDERS This Weekend–
– The sixth round of the 2016 Lucas Oil Pro Motocross Championship is set to kick off this Saturday, July 2 in Buchanan, Michigan at Red Bud Motocross Park for the championships annual visit on Fourth of July weekend.
The forecast calls for beautiful weather as riders prepare to overcome the challenging conditions that they will face. Michigan’s rich and loamy soil at the facility is perhaps the most popular on the schedule, allowing for Pirelli’s SCOPRION MX32 tires to give riders the ultimate advantage when the gate drops.
In the 2015 Pro Motocross Championship, Autotrader/Monster Energy/Yamaha’s Justin Barcia caught fire at Red Bud by performing brilliantly en route to the 450MX Class overall victory via 2-1 moto scores. He is coming off of a top five in last weekends second moto and will be looking to add another win to his resume when he crosses the checkered flag this weekend.
Californian Weston Peick began his championship campaign battered and bruised due to early season crashes, but has steadily improved his health as he marches back towards the front-runners. Last weekend he charged to his season-best overall finish, along with a top five in Moto 1. The third member of the JGRMX squad, Phil Nicoletti, has shown impressive speed in the first five rounds of the season. Misfortune has struck several times while battling near the front, but “Philthy Phil” is on the verge of a breakout ride.
BTO Sports/WPS/KTM’s veteran duo of Justin Brayton and Andrew Short continue their progression in the running order of the 450MX Classes deeply talented field. This past weekend at Muddy Creek Raceway in Tennessee, Brayton found himself rounding the first corner near the front of the field and battling for a top five position for several laps. The No.10 has his sights set on taking the next step when he lines up this weekend at Red Bud. Short has had his fair share of success at Red Bud in the past, including two-career podium finishes throughout his storied career.
BTO Sports teammate Benny Bloss remains one of the most impressive riders of the 2016 season, consistently battling with the sports brightest stars as he competes in his first season on the professional circuit. Expect for the youngster to keep the momentum going as he learns the race craft of his more experienced competitors.

No, this bike didn’t make it to Born Free. I rode my Indian. But I actually fixed this bastard and would like to ride it to Walker’s café this weekend.
I need to work on a scissor lift this weekend and make a trip to Costco for batteries. If we make this work, it could be amazing.
