MIC Urges CPSC to End Ban on Youth Vehicles–The MIC has urged chairman Inez Tenenbaum and the other members of the Consumer Product Safety Commission to recommend in its report to Congress on the Consumer Product Safety Improvement Act (CPSIA) an amendment that would end the current ban on youth powersports vehicles resulting from the law’s lead content provisions.

As part of the legislation that funded the CPSC in 2010, Congress gave CPSC a deadline of Jan. 15 to submit suggested improvements to CPSIA to the Senate and House Appropriations Committees, the House Energy and Commerce Committee and the Senate Commerce, Science and Transportation Committee, the MIC stated in a release.

In a Jan. 12 letter, the MIC thanked the CPSC for its efforts to promote youth safety by implementing a temporary stay to make some youth vehicles available despite the ban. MIC also suggested three ways to completely or substantially exclude or exempt youth off-highway motorcycles and all-terrain vehicles from those provisions:

1. a ?functional purpose? amendment
2. a categorical exemption, such as would be provided by H.R. 1587
3. a change in the definition of ?accessibility? for powersports products

Even though the lead in metal parts of the vehicles do not pose a health hazard to youth riders, the CPSIA, as interpreted by CPSC, does not provide it with the flexibility it needs to grant an exclusion from the lead content limits. As a result, a CPSIA amendment is needed such as a ?functional purpose? amendment proposed by Chairman Tenenbaum in response to an earlier Congressional inquiry.

MIC General Counsel Paul Vitrano stated in the letter: ?Such an amendment should permit the Commission to grant exclusions for youth ATVs and motorcycles since lead in many accessible components is necessary for their functional purpose, contact with those components is infrequent and the elimination of lead is impracticable or impossible based on available scientific or technical information.?

Other solutions include a categorical exemption, such as would be provided by H.R. 1587, a pending bill with 55 bi-partisan co-sponsors, or a change in the definition of ?accessibility? for powersports products.

?Everyone agrees that the key to maintaining the safety of youth riders is for them to operate only appropriately sized vehicles,? Vitrano added. ?We are hopeful that CPSC?s report to Congress will pave the way to legislation that will ensure youth motorcycles and ATVs remain available.?

Vitrano said it will again be critical for enthusiasts and industry to mount a massive grassroots effort to advocate for one of these amendments to the CPSIA. For more information visit, www.stopthebannow.com.

QUICK LOWER ALABAMA WEATHER REPORT– As I sedately rode out of town this morning at 7:42AM the fog hung in the cool morning air like moss on a southern oak. The thermometer hovered at 45 degrees but with all the moisture it felt colder. Our roller coaster ride with the weather continues. My trips haven?t amounted to a lot of riding lately due to rain, cold, etc. but today was too good to pass up, even 24 miles round trip is better than no trip at all. Things at work have not picked up as much as usual but hopefully they will after the end of this month. Maybe my boss won?t be another casualty of these bad economic times but only time will tell.

If anyone is interested in knowing a good place in SE Alabama to purchase a motorcycle and a good salesman to talk to call Dothan Harley- Davidson and ask for Tim Perry. He is the most knowledgeable person I have run across (next to my husband of course), as far as Harley’s are concerned. He has worked in the parts dept. and warehouse and now is in sales. He can tell you just about anything you want to know about bikes and if he does not know he will find out for you. He goes way above and beyond the job of just selling you a bike. Customer service is still his number one priority and he does a great job. (334) 792-0063. However, the hours have been cut back at the Harley Dealership and they are no longer open on Mondays, guess they are feeling the economic pinch as well, but they are there Tuesday thru Saturday.

I am originally from a very small community called Red Bay in the NW Florida panhandle. It is growing a bit and has a grocery store/diner called the Red Bay Grocery www.redbaygrocery.com (see it even has a web site now). From what I hear it has good food and entertainment every now and then. Check out the site. There are hills (ok, little bitty hills more like mole hills compared to real hills like out west) in NW Florida too. The picture shows the northern route out of town headed toward Alabama. BBC Fires Hells Angels Employee After Police Criticism–Getting fired was probably the last thing on BBC reporter Steve Jones’s mind when he criticized the police for being too heavy-handed at a “Bulldog Bash” biker event in a radio interview. But the 20 year BBC veteran, speaking under the pseudonym of “Echo,” caught the attention of colleagues who recognized his voice, which led to his firing under the pretense that he violated the company’s code of conduct dictating that “journalists must disclose their interests and get permission before representing outside organizations.”

Jones was described by another BBC employee as being “… a lovely bloke and an excellent broadcaster but he’s a bit of a maverick.” Apparently, he also had a history of ruffling feathers at work by wearing short sleeves, which revealed his tattooed arms.

Though his identity as a Hells Angels member surely sounds salacious, his comments about the police– one of which can be seen at the bottom of this article– don’t sound all that provocative. Another one of his statements: “In the UK, we’re not organised crime – we’re a brotherhood of bikers.”

Did Jones deserve to be fired, or was he being discriminated against because he’s a Hells Angels member?
