Hey,

It’s a short one, this weekend, but packed with good info. We are just back from a Vegas Bikefest whirlwind weekend. We finished the Thursday News, then Ray C. Wheeler, Bikernet Performance Editor, and I, jumped in the Bikernet Hearse and cut a dusty trail into the Mojave desert toward the Nevada border.

I helped judge the bike show, the Miss Vegas contest, checked the Artistry in Iron, then at 6:00 a.m. we returned to the 15 interstate heading back to the coast. Uncle Monkey mentioned some of the moves by the factory against aftermarket shops. I think it’s a major mistake by the factory and will drive more business into the aftermarket as other companies fill the dealership void. We have already received reports of companies who will step up to build the needed products to keep the independent shops rolling. We will bring you more reports in the very near future.

Las Vegas was down from a motorcycle industry vendor standpoint, but attendance was strong, Including Dan Ackroyd who signed bottles of Skull Vodka for an immense crowd of buyers. I’ll try to dig up a couple of shots of the girls for the post, but let’s get started.

I’ll plug in bits and pieces as news surfaces.

INDIAN WARS–As you know there is an ongoing dispute between John White, of Crazy Horse, the makers of Indian styled engines, and the new Indian Motorcycle Company recently purchased by Polaris.

John and his group have fought off several new Indian name owners. Following is a letter from John’s attorney back to Polaris. It covers his history with this effort:

Dear Mr. Ehard:

Your letter of September 19, 2011 has been forwarded to us by John L. White (“Mr. White”). As we represent Crazy Horse Motorcycles LLC (“Crazy Horse”) in intellectual property matters, we have been asked by Mr. White to respond to your letter which you sent to Mr. White at Crazy Horse. It is our understanding that you represent Polaris Industries Inc. (“Polaris”) and its recently-acquired subsidiary Indian Motorcycle International, LLC (“IMI”) with respect to their trademark matters.

In your letter, you requested a response before September 29, 2011. We find the time to respond artificially short, but nonetheless have prepared this response for your benefit. We also note that your letter resurrects concerns that Crazy Horse has thought were abandoned by IMI years ago.

Perhaps since Polaris only recently acquired IMI, you have not been fully informed regarding this matter. In the fall of 2006 (almost five years ago), IMI, through its counsel, put Mr. White on notice that IMI had acquired valid and protectable rights in federal registrations, common law trademarks and trade dress used by IMCOA Licensing America, Inc. (“IMCOA”) and its predecessors. At that time, IMI threatened that “IMI will take whatever action it deems necessary to protect those trademarks” including “seeking a court order enjoining” Mr. White, “treble damages and attorneys’ fees.” In response, Mr. White indicated that he is an INDIAN® motorcycle enthusiast and that he respects the legitimate intellectual property rights of third parties and has no intention of violating any legitimate trademark rights IMI may possess. At the same time, Mr. White expects that third parties will respect his trademark rights and will not improperly interfere with his legitimate business interests and contractual relationships.

In January 2007, IMI again threatened Mr. White and his company referencing specific federal registrations, pending applications and common law rights and threatening increased damages, including attorneys’ fees and costs. Mr. White was given one day to respond. In response, we made it clear that Mr. White and his company disagreed with IMI’s position on the matter. And, because of the threat of litigation for trademark infringement, Mr. White and his company filed a Declaratory Judgment action in Utah seeking a judgment that his company’s “marks do not infringe any valid and/or enforceable trademark rights that may be owned by IMI” and that, as against IMI, his company is entitled to use all of its trademarks without harassment, threat of litigation, etc. from IMI. After that response by Mr. White and his company, IMI further threatened that if Mr. White and his company would not confirm that they would not be using “Indian imagery (including the term INDIAN itself and Indian Head Dress Designs)” IMI would go “to the press regarding the issue.” In response, Mr. White and his company, through their counsel, stated:

[W]e do not believe that IMI has exclusive rights to a Native American motif regarding motor vehicles, such as motorcycles, or their parts, such as engines. IMI does not have trademark rights that preclude the use of the image of a Native American in traditional attire (e.g. in war paint, wearing beads, wearing an identifying feather, or wearing a head dress). If that is your position, certainly IMI is overreaching.

In February 2007, Mr. White and his company repeated the position quoted above and further stated that Mr. White “does not intend to use the term “INDIAN” or the likeness of a Native American that is likely to be confused with any legitimate trademark rights of IMI” and indicated if IMI was willing to accept Mr. White’s use of his Native American motif and trademarks on motorcycles and motorcycle engines, as were displayed and marketed at the trade show in Cincinnati” that the parties could reach a resolution. IMI responded “[w]e believe that there is no reason for the parties to be litigating over these issues and that they should be able to co-exist, but this will require that Mr. White not use the term INDIAN in connection with motorcycles and not use an Indian Head Dress Design that is similar to [IMI’s].”

By mid-2007, the Declaratory Judgment action was dismissed, without reaching the merits, for lack of personal jurisdiction over IMI in Utah. Although Mr. White and his company have continued to use his marks, IMI did not follow up the dismissal with any action for trademark infringement. The two parties have co-existed, each using its respective marks, without incident until your letter referenced above. In fact, IMI has listed Crazy Horse on its website in the “Pre-2009 Indian Riders Resource Locator” directing its website visitors to Crazy Horse’s website “for product information.”

Although Mr. White and Crazy Horse has long-thought that IMI has acquiesced in this issue, they have repeatedly indicated that they do not intend to infringe any legitimate rights of IMI. My client has serious reservations regarding the true nature and extent of any legitimate rights owned by IMI (and now Polaris). My client has always been willing to discuss the matter so that an amicable resolution can be reached without further threats of litigation or further harassment.

Please understand that Mr. White is an INDIAN® motorcycle enthusiast and looks upon Polaris’ acquisition as a positive move for INDIAN® motorcycles. There exists no ill-will towards Polaris. Believing that an amicable co-existence is possible, we would be happy to discuss this matter.

EDGE, SOUTHEASTERN BIKERNET CORRESPONDENT EXTRAORDINAIRE AND COMMANDER OF THE SMOKE-OUT REPORTS– October is just my month. I freaking love October. The weather is perfect here, 50s at night and 70s during the day here in SC. I just went on a ride up the mountains a group of friends to a place called “Kickstand Lodge.” Really cool place in the Appellation Mountains and the owners are really laid back with a unique business plan. It is basically a lawn like grass field next to one of the prettier motorcycle roads in western NC. A few miles away is one road with eleven waterfalls. The field sits between the road and a mountain creek with a small pond in the middle and a scattering on tiny cabins and a few hammocks. (http://kickstandlodge.com/)

You just pull in and set up. The owners come later in the day to cook up dinner and you can pay for the site when the owners get there. When we rolled in there was a group that had arrived after dinner the night before and they had to wait a bit for the owners to arrive so they could pay but generally it seems to work really well.

The amazing thing to me is everything else is by donation. Dinner is all you can eat and Moe (the lady owner) walks around pushing excellent food on you. There is a suggested donation of $ 10 for dinner, which is a deal. I am convinced Moe would be fine with less of a donation from a biker down on his luck and I am equally convinced everyone else would pitch in more in a heartbeat if they knew the till needed a few more bucks.

I love that there are still places in America where individual responsibility and honor can carry the day. It is so great to have the convenience of just being able to walk over to a jar and settle up instead of waiting in front of a cash register.

After dinner is served Moe’s significant other gets a fire going and everyone kind of gravitates over one of the chairs around the bonfire. The air was crisp that night, beer in hand, I was mesmerized watching Ranger TV. I’ll talk about the beer in a second. I am told Moe brings some type of dessert every night before she leaves. This night it was warm chocolate chip cookies. It made me think of Fab Kevin who lives for chocolate chip cookies.

Breakfast is more interesting because it is available if one of the campers wants to cook. Moe will load the volunteer cook up with bacon, sausage, eggs, pancake mix and whatever else and they have everything available. You do not need to bring any dishes, coffee cups, or even towels or soap. It is all there. The suggested donation is five bucks for breakfast, once again for all you can eat.

They have fridges full of different sodas and various beers and you just take what you want and put money in the donation jar. There is no suggested donation so you are kind of left to figure out what to put in the jar on you own. I was throwing in two bucks a beer, which is way cheaper than a bar and no tipping required. It sure beats riding down to a gas station, paying way more than grocery store price and then buying ice, which I have done more times than I can count. It is just an awesome campsite, really convenient.

HEARST CORPORATION SELLS CYCLE WORLD TO BONNIER CORPORATION–  NEW YORK, September 30, 2011 — Hearst Corporation, one of the nation’s largest diversified media companies, today announced the sale of Cycle World to Bonnier Corporation, one of the largest consumer-publishing groups in the U.S. serving passionate, highly engaged audiences. The announcement was made jointly by Terry Snow, CEO of Bonnier Corporation, and David Carey, president of Hearst Magazines. Financial terms were not disclosed.

Cycle World—the No. 1 media brand in the motorcycle industry—joins Bonnier’s impressive collection of top brands in the U.S. that include Popular Science, Parenting, Field & Stream and a number of special-interest active lifestyle titles.

Founded in 1962 and based in Newport Beach, Calif., Cycle World publishes a monthly magazine with a circulation of 235,000. In addition to the print publication, the brand has a robust website, events, licensed content, research initiatives and mobile apps. It was the first motorcycle brand to publish a mobile app with the launch of the Cycle World iPhone app in 2009.

BIKERNET INSURANCE WEEKEND MEMO–Riding a friend’s motorcycle. Are you protected by insurance?

We get a lot of questions from customers about whether or not they are covered when riding off with a friend’s bike. Let’s look at this issue.

When one buys automobile or motorcycle insurance, the generally accepted rule is that you are buying vehicle insurance to cover the vehicle, not for any person who may end up driving your vehicle. Vehicle insurance contracts typically follow the vehicle so no matter who ens up driving or riding it, the vehicle’s insurance company ends up paying for any damages. In other words, vehicle insurance is tied to the vehicle, not the driver even though the rate charged is partly based on the “usual and customary” driver of that vehicle… So remember, insurance coverage follows the vehicle specifically insured.

Alert if you decide to let a friend borrow your bike.
 

Be very careful of who you lend your car or motorcycle to as there could be serious situations that arise. Especially if that person does not have their own insurance or has inadequate motorist liability limits. Yes, if that friend does not have adequate insurance, the injured party to an accident involving your vehicle can come after you and your assets. Not good.

Now, if you lend your vehicle to someone with permission and they get in an accident, your vehicle’s insurance policy will usually pay the claim, not their policy. But, remember that p
premiums follow claims activity. Insurance companies will raise your premium after an “at fault” accident involving your vehicle. If your buddy is deemed “at fault” in the accident, your insurance will go way up or could even be in jeopardy of getting cancelled.

Lesson here: Lend Your Vehicle To Others At Your Own Risk.

We watched Born to Ride last night and the movie went from Branscomb & the other dude had just shot the one guy in the arm, to them being in the back of a truck. Seeing how we know one of the stars, the devil & I figured you might have some insight?

Head to the Texas National Motorcycle Rally this weekend. I covered it ’09. It was moved to the Royal Purple Raceway, hoping they will have more pro fuel bikes this year and have my media stuff on the way for the Lone Star Rally in Nov.

I’m updating the front end on the LRR to a newer single disk with a 4-piston caliper and some one-off rotors the devil gave me.

OWNERS CHANGE AT TWO HARLEY DEALERSHIPS–Dallas-based Powersports Listings announces that two popular dealerships changed ownership last month.

Dan Walton of Ketchikan, Alaska., purchased Donahue Harley-Davidson, a two-store business in St. Cloud and Brainerd, Minn. He will run daily operations with his son, Seth (father and son pictured at left). Donahue Harley-Davidson of St. Cloud was a Top 100 Dealership owned by Butch and Brett Donahue since 1992.

Also changing ownership is Rio Grande Valley Harley-Davidson, a two-store chain in McAllen and San Benito, Texas, bought by brothers Stratton and Marc Murphy. The stores will continue to operate under their current name.

JIMS SPONSORS BONNEVILLE RECORD SETTERS–  JIMS sponsored racers, Hiro Koiso and Jody Perewitz, broke a total of seven land speed records at the 2011 BUB Speed Trials at the Bonneville Salt Flats in Utah.

Hiro Koiso, engine builder/tuner at Red Rock Harley-Davidson in Las Vegas, set 2 new FIM World Records and 4 AMA National Records in the 3000 Blown Class. This included a 193.596 mph run without the fairing! This bike was legally ridden on the street prior to the races and is now claimed by Hiro Koiso Racing as “The World’s Fastest Street Legal Harley-Davidson.”

His 2006 FXD-I is powered by a JIMS 131” Twin Cam engine and a ProCharger, modified by T.R. Reiser of T-Man Performance who recently claimed “The World’s Fastest Bagger” title in 2010 with our JIMS Fat 5-Speed Overdrive
Transmission.

Jody Perewitz is the daughter of Team J’Witz builder/team owner Dave Perewitz. With no prior experience racing on the Salt Flats, Jody became the first woman ever to run over 200 mph on an American V-Twin Motorcycle. She popped off a run of 203 mph to clinch herself the new title! Her bike is powered by JIMS 100-inch cylinder kit assembled by R&R Cycle with a set of their custom machined heads and a ProCharger, all tuned by Dan Thayer.

As it turns out Both of our Mudflap Girl FXRs are shifted with JIMS 6-speed transmissions, and we just rebuilt Dr. Hamsters transmission with JIMS re-man program.–Wrench

VEGAS BIKETOBERFEST WEEKEND–Vegas is downright bizarre. It’s a human freak show every day on the seedy streets. Ah but BikeFest brought out the very best in custom motorcycles. I can’t wait to share Gard Hollinger’s custom for Keanu Reeves on the pages of Bikernet.

Gard runs LA Choprods and he’s one of those hidden talents, who make builder’s products, Mooneyes oil tanks, and distributes ISR controls from Europe. This bike will rock the world. It was one of just eight motorcycles to compete in the Artistry in Iron display.

The Bagger nation and custom Bagger talents are growing. Building custom baggers forces Jim Nasi, the Sinister crew, and several other top notch touring builders to meld form with function. With a chopper, less is often more. With a dresser build the bike must look cool, yet function better than a stock touring model. There are some amazing talents building baggers now.

So we handed out and tacked up Indian Day posters from the Las Vegas strip to boonies biker bars. Then we peeled back to the headquarters.

We hauled ass at the crack of dawn after too much whiskey and gambling. I was in a daze as the sun rose behind us and we peeled across the Mojave once more. At one point I could swear we say Aliens at a strange jerky drive through. I shot another 5-hour energy drink and kept driving.
