Law Enforcement’s National Threat Assessment Program (TAPS ACT) Predicts If You Pose a Future Threat

It has been nearly two years since I reported on the dangers of creating a law enforcement run Mental Health Assessment (MHA) program. In Texas, police use MHA’s to “screen” every person they have arrested for mental illness.

But the TAPS Act, first introduced in January 2019, would take law enforcement screenings to a whole new level. It would create a national threat assessment of children and adults.

In the course of six months, the Threat Assessment, Prevention, and Safety (TAPS) Act (H.R. 838) has seen the support of the bill grow to nearly 80 Congress members. TAPS was introduced by a bipartisan Congressional Group along with local police during the recent National Police Week.

Speaking on Capital Hill, Texas Congressman Brian Babin made this remark in an opening statement:

“We do this first to honor the sacrifice of these men and women in blue, who put their life on the line every single day to protect us in the vital role that law enforcement plays in the safety and well-being of our communities and our districts. And secondly to highlight a bipartisan solution — that we all are working on — to protect our communities and schools from the terrible acts of violence that we have seen, and are getting to be almost routine.”

Taken at face value, the TAPS Act sounds like a noble attempt to stop school shootings, but not all is as it seems.

The TAPS Act would encourage law enforcement to give everyone a personal threat assessment (kids and adults) and single out those that they deem as future threats.

This is the opening paragraph of the Act:

“By bringing threat assessment experts together, and utilizing evidence-based behavioral threat assessment and management processes, we can bolster public safety by implementing strategies to identify and stop dangerous individuals before they can commit an act of violence. We have the expertise to combat the targeted violence plaguing our schools, places of worship, and public spaces, but we have yet to fully implement this expertise to prevent attacks.”

On the local level, the resources and information could be utilized not only by police but also teachers and counselors.

Initially sponsored by Senators Marco Rubio, Kyrsten Sinemea and Thom Tillis, the TAPS Act will create a national behavioral threat assessment and management process for everyone. The TAPs act will also immediately create a Joint Behavioral Threat Assessment and Management Task Force that will look into how to identify individuals that exhibit patterns of dangerous behavior that MAY precede an act of targeted violence. The Task Force will also be required to:

  • Ensure consideration of the different needs and resources of communities across the country, and will not be construed as a national standard.
  • Include recommendations for the most effective leveraging of existing Federal, State, local, and Tribal infrastructure, workforce, and experience.
  • Include recommendations to increase collaboration between government agencies and private entities that focus on public safety responsibilities.
  • Include recommendations on training programs to disseminate to State and Local entities.
  • Include recommendations for a Behavioral Threat Assessment and Management School Violence Prevention Program to train and support a multi-disciplinary and multi-jurisdictional behavioral threat assessment and management process for educational entities.

Of course, we all want to keep our communities and schools safe but is this the right way to do so?

The never-ending war on terror and the TAPS Act should not be used as an excuse to destroy our Bill of Rights.

Capitol Hill Update

Heavy Hearts
The news late last week from New Hampshire regarding the death of 7 motorcyclists was devastating. We at the MRF express our thoughts and prayers to the friends of families of all those involved. We pray that those still in the hospital fully recover.  It is important that the focus now is on those that are grieving and how we as a community move forward after such a high-profile tragic event.

This most recent tragedy, like the Tama Valley incident in Iowa from 2003, is a stark reminder we must discourage distracted driving. All news reports on the New Hampshire incident point to fault lying with the driver of the truck. Now is not a time for regulators and the media to push a narrative regarding what the riders could have done differently or how safety gear and apparel would have changed this senseless tragedy. The investigation should center on the facts of this specific incident and those responsible should be held accountable.

We thank both the good Samaritans and first responders for their selfless courage and dedication in attending to the victims. As we move into the summer riding season, please look out for our fellow brothers and sisters on the road, take a moment to reflect on how precious our safety and freedom actually is.

 

4th of July
There are few guarantees in the world of politics, but one thing is certain, politicians will be out in full force on the 4th of July break at parades, picnics, and BBQs. As you gather with family and friends to celebrate this great nation keep your eyes peeled for your local Congressman or Senator shaking hands and talking to voters.

There is no better day than Independence Day to introduce yourself to your lawmakers and discuss issues of importance to you. Among the rights guaranteed in the 1st Amendment to the Constitution is the right to petition your government. Be visible, be vocal and let your elected official know that you are a motorcyclist that is paying attention and engaged in the political process.

A Ticket And A Point? Distracted Driving Penalty Closer To Law

SACRAMENTO (CBS13) – Drivers in California caught texting or holding a phone may end up with a point on their driving record along with a ticket.

The Senate Transportation Committee unanimously passed Assembly Bill 47 on Tuesday. If it becomes law, it would go into effect July 1, 2021. Lawmakers asked the bill’s author to amend the bill to also have that date apply to convictions, as well.

AB 47 was previously amended to state a point would only be added if the offender is caught texting or holding a phone while driving within 36 months of the last violation. The original version would have added a point upon the first conviction.

California law adds points to a driver’s record for a number of violations. Those who accumulate four or more points in 12 months, six or more points in 24 months, or eight or more points in 36 months are considered “negligent drivers.” The DMV can refuse to issue or renew a license to a negligent or incompetent driver; insurers can also change a driver’s rate based on the number of points on his or her record.

Non-commercial drivers can enroll in traffic school to remove a point, meaning the proposal would essentially not add a point until the noncommercial driver’s third violation.

A similar bill, SB 1030, didn’t advance during the last session. In 2014 Governor Jerry Brown vetoed a nearly identical bill, writing:

““I certainly support taking reasonable steps to curb cell phone use and texting while driving, but I don’t believe this bill is necessary at this time to achieve that goal. I’m instructing the Department of Motor Vehicles to add a question about the dangers of using a communication device on the driver license exam. Additionally, the department is beginning a review and analysis of data on distracted driving in California. Let’s wait to see the results before enacting a law requiring a violation point.”

California law already states drivers can only use a telephone if that phone is specifically designed and configured to allow hands-free listening and talking. Drivers who are 18 and younger can’t use a device even if it’s equipped with hands-free technology.

According to AAA, texting while driving increases the odds of a crash by two to eight times; talking on a phone, even if it’s hands-free, increases the odds of a crash by 4 times. Drivers over 18 can use their phone if it’s hands-free, meaning voice-activated and operated.

10 percent of all deadly crashes are caused by distracted drivers.

Analysis of the bill revealed:

“According to the California Office of Traffic Safety, a 2016 survey revealed that more than 56% of California drivers said they had been hit or nearly hit by a driver who was talking or texting on a cell phone. In addition, the survey indicated that 40% of drivers admitted to making a mistake while talking on a cell phone.”

The bill’s author, Assemblymember Tom Daly (D- 69th District), “Driving while using a cell phone is a serious safety issue. In 2017, there were 243,760 distracted driving offenses in California related to cell phone use. During that same year, there were 932 collisions – 31 of which were fatal – where distracted driving due to
cell phone use was determined as the factor. Currently, driving while using a cell phone results in a small fine (oftentimes less than a parking ticket), but it has not proven to change behavior.”

Currently, the base fine for a distracted driving violation is $20. for the first offense ($162 with fees and assessments) and $50 for subsequent offenses.

California’s Wireless Communications Device Law went into effect on January 1, 2009. It bans people from writing, sending or reading text messages while behind the wheel. The handheld wireless telephone law went into effect on July 1, 2008. It prohibits all drivers from using a handheld wireless phone while operating a motor vehicle. In 2017, drivers could no longer hold cell phones for any reason, including to use map apps or music.

AB 47 previously passed the full Assembly, the Assembly Appropriations Committee, and the Assembly Transportation Committee unanimously.

We see it constantly around us. It’s one of the things I liked about being a biker. It was just me and my motorcycle. I wore what I wore for me and nobody else. Most of us looked like hell most of the time. Who cared?

Texas ROT Rally hits a homerun

This is a ’70s style event where alcohol meets full-frontal nudity. Over 200,000 made the annual pilgrimage to the Austin area to party like it was 1999 and with a good number of them entering the rally.

The ROT is a throwback rally where the Harley faithful connect at the Travis County Expo Center for music, stunt shows, vendors and custom bikes.
