Hey,

Yep, another holiday weekend and the parties are starting everywhere. Except the Wilmington ghetto, where no one will come to party on the fourth. We will keep watch over the port, while being able to see fireworks in all directions. If the sky is reasonably clear we can see the flashes in the sky from the Queen Mary in Long Beach to the Cabrillo Beach in San Pedro and all the inland bergs surrounding us. It’s amazing.

Let’s hit the news as I decide which article to complete for next week.

NEW FROM THE MOTORCYCLE PROFILING PROJECT–

Big Win – MC’s Stop ‘No Motorcycle Colors’ Policy in Colorado.

Royal Gorge Bridge and Park (RGB&P), located near Cañon City, Colorado, recently adopted an over-broad policy of discrimination against any individual wearing motorcycle-related patches or colors. So the National Council of Clubs (NCOC), an organization representing the interests of motorcyclists nationwide, immediately protested the decision in the form of a written complaint to RGB&P management.

Normally, private actors such as RGB&P cannot be sued for 1st Amendment restrictions because there is nothing unconstitutional about private actors discriminating. However, RGB&P leases the land from Canon City exposing the government actor to civil rights liability for the discriminatory acts of the private party.

After receiving the NCOC’s letter of complaint, RGB&P management contacted NCOC attorney Wade Eldridge and informed him that all “no motorcycle club colors” signs had been removed from the park and that the park reversed its policy. The NCOC verified on June 10th that all signs have been removed. NCOC participants, members of motorcycle clubs including 1%’ers, have been granted access to the Park.

This is an important win for the NCOC and the motorcycle club community generally. Many motorcyclists frequent RGB&P and some club members have even had their ashes spread at the park.

Silence is consent. Grassroots political opposition is one of the most effective strategies for tangible change, as demonstrated by the NCOC.

South Australian Attorney-General to close loophole in States anti-biker legislation

A legal loophole that South Australian police say has allowed the collapse of two biker association cases — one involving Hells Angels members — is being closed by the State Government.

Attorney-General John Rau says he will move to amend key organized crime legislation following discussions with senior police in recent months.

The amendment will remove a defense open to a member of a declared criminal organization who is charged with associating with another member.

At present a bikers can argue the club he belongs to is not a criminal organization, putting the onus on police to prove otherwise — even though the same motorcycle club has been declared a criminal organization by parliament under the Serious and Organized Control Act.

Rau said the amendment would simplify the use of the association legislation and ensure police and prosecution authorities “were able to use it more effectively”.

Parliament has declared 10 motorcycle clubs to be criminal organizations. Under one section of the legislation, it is an offence for a member of a declared organization to be in a public place with two or more other participants in a criminal organization.

Rau said each time the “no criminal purpose” defense was raised, the prosecution was required to disprove it.

“This means that the prosecution is required to prove that the criminal organization had, at the relevant time, the purpose of engaging in or conspiring to engage in criminal activity,” he said.

“The prosecution should not have to prove the criminal purpose of an organization that has already been declared by the Parliament to be a criminal organisation.”

Rau said he believed removal of the “no criminal purpose” defense would improve the ‘workability’ of the legislation and ensure it remained a “useful tool … to combat serious and organized crime”.

ARE AUTO-LOANS ON THE VERGE?–
For the past couple of months, there have been rumblings that auto loans are indeed on the same downward spiral as home loans were in 2008. Fitch recently announced that loans issued in 2015 may end up being the worst performing ever in the history of auto-loan securitizations. Fitch rates the loans as cumulative net losses projected to reach 15 percent, exceeding the peak loss during the 2008 financial crisis.

This is a slow-moving train wreck however because experts are unsure about loans issued in 2016. The auto loan instability has to do with the fact that institutional investors grabbed subprime auto loan securities because of higher yields (similar to the subprime house loan crisis of 2008). These subprime auto loans have been repackaged several times over and stamped with a high credit rating.

Negative equity has hit an all-time high. During the first three months of 2017, the average negative equity per traded vehicles reached $5,195 which is the highest ever according to Edmunds. Also the highest ever—the 32.8 percent of trade-ins with negative equity. When the negative equity is then rolled into the new loan for the new vehicle—the consumer starts in a steep hole. In the event of a loan default, net losses soar.

Why all this negative equity? Business Insider says there are three reasons:

Even though vehicle prices have gone up, consumers buy more expensive models because interest rates are low and longer loan terms keep the payments at an affordable monthly cost.

2)
Loan terms are longer. In the first three months of 2017, loan terms reached a record 69 months. Terms between 73 and 84 months (seven years) accounted for 32.1 percent of all vehicle loans in the fourth quarter of 2016, up from 29 percent in 2015 during the same period. Used-vehicle loans accounted for 18 percent, a two-percent increase from 2015.

Used vehicle values are falling. In May, the Used Vehicle Price Index by J.D. Power Valuation Services declined for the tenth month in a row.

Also, just like with the mortgage crisis, many consumers who are seeking funds to buy a car do not really have the credit rating or the money to buy a car but are lured in with less than stellar lending practices. This usually means much higher interest rates for people who are already on the edge financially.

How can all this affect a motorist?

The New York Times recently profiled a subprime auto loan borrower named Yvette Harris who is still paying off her 1997 Mitsubishi even after it was repossessed. Her auto lender took her to court and garnished her wages in order to pay off the difference of the sale value of the car and the outstanding loan. This is now a common practice of subprime lenders. Unable to recover the balance of loans by repossessing and reselling the cars, some are aggressively suing borrowers to collect what remains.

Why not take the chance on a risky borrower?

If he or she defaults, subprime lenders can repossess the vehicle and persuade a judge in 46 states to garnish the borrower’s wages to cover the balance of the car loan.

The impending subprime auto loan crisis might indeed be worse than the recent subprime loan mortgage crises for individuals. With a mortgage, a homeowner could turn the keys in and walk away. Not so with auto loan debt. Repossession is just the beginning of the quagmire for many car owners caught in the subprime auto loan trap. New York Legal Assistance Group consumer lawyer Shanna Tallarico said, “Low-income earners are shackled to this debt.”

In February, a Bloomberg article stated “To be clear, this doesn’t point to an imminent, 2008-style meltdown. After all, the U.S. auto-loan market is about $1.1 trillion, which pales in comparison with the $8.9 trillion U.S. mortgage market and $8.6 trillion of dollar-denominated corporate credit. And only about one-quarter of the outstanding car loans have been extended to subprime borrowers, who are the ones having the problems.”

Yvette Harris, the single mother living in the Bronx, mentioned earlier says this has been a nightmare. Even after $4,133 of her wages were garnished and she paid an additional $2,743 on her own, the lender still sought an additional $6,500. All for a vehicle that probably has a blue-book value less than $2,000.

EUROPEAN WARNING– Low-emission zones and city bans could force motorcyclists into cars

It is feared that motorcyclists who are no longer allowed to commute on their low-cost, pre-2006 motorcycles, may abandon motorcycling and switch to using a car instead. This could have serious consequences for urban traffic, congestion and pollution.

The current focus of European mobility strategies is on public transport, cycling and walking. However, public transport will never reach every urban area and cycling and walking are only good for limited distances. This means there will always be a need for individual motorized personal transport.

In urban mobility FEMA, the Federation of European Motorcyclists’ Associations, foresees a growing role for powered two-wheelers, especially motorcycles.

Motorcycles are smaller and lighter than cars and are able to keep moving where cars are stuck in traffic, which means they use less fuel, they pollute less and they save travelling time. Motorcycles provide the greatest flexibility of all means of personal transport, because they offer the freedom to travel where and when you want to.

In the meantime, motorcyclists experience a growing pressure by city councils to switch from older, affordable motorcycles to more expensive, less fuel consuming and cleaner motorcycles. Several city councils threaten to ban older motorcycles (pre Euro 3, built in 2006 and earlier) from cities or demand high tolls.

FEMA conducted a survey amongst European motorcyclists to find out if the average motorcycle commuter would be willing to invest in a new(er) motorcycle to keep commuting by bike and to find out how the European rider feels about buying and riding a non-emission bike.

If environmental restrictions would only allow for light, high-tech but low-power-output motorcycles (less than 60 brake horsepower), a small majority would still keep riding. A small majority of motorcyclists could even imagine enjoying the ride on a non-emissions bike.

But, a staggering 87% would not be willing to invest in a more expensive non-emissions bike. If fossil fuel vehicles were ever banned from entering the city, 76% would rather change transport mode than buy a non-emissions bike. This outcome could have serious consequences for urban traffic, congestion and pollution.

METZELER Riders Finish Strong at the 95th Running of Pikes Peak
ROME, Ga. (June 30, 2017) –
The climb to the top of the mountain on June 25 at the 2017 Pikes Peak International Hill Climb proved to be a success for Metzeler motorcycle tires.

For 2017, the tire manufacturer placed a renewed emphasis on the event, applying the experience and success garnered at some of the world’s most prestigious road racing events towards the monstrous mountains of Colorado Springs, Colorado.

Metzeler claimed several podium positions throughout the weekend, including the overall win in the Pikes Peak Challenge Electric-Motorcycle Class.

“Metzeler experienced great success on nearly all motorcycle applications at Pikes Peak,” said Oscar Solis, Metzeler road racing manager. “Whether it be a gas or electric powered bike, middleweight or heavyweight, Metzeler tires were proven to perform on all bikes and under any condition on the road.”

The 95th running of the famed event at Pikes Peak packed plenty of action as some of the world’s best riders charged the 156-turn course. In the Pikes Peak Challenge Electric Motorcycle division, Robert Barber set a quick pace en route to victory, finishing with an impressive time of 10:55.500. He used a Metzeler RACETEC RR K1 front tire and K2 on the rear.

As one of the most competitive classes in 2017, the Pikes Peak Middleweight Motorcycle category witnessed the top three finishers run times separated by less than 14-seconds as they crossed the line at the 14,115-foot summit. Rafael Paschoalin, who ran Metzeler RACETEC RR K1 front and rear tires, was the runner-up with a time of 10:42.793.

NEWS FROM THE HILL – Autonomous Vehicle Legislation Speeds Through Committee Plus Dissent in the Senate over Healthcare

Lawmakers in the House are now turning their attention to self-driving cars. On Tuesday, the House Commerce Subcommittee on consumer protection held a hearing on a slew of bills — 13 in total — to help scale back regulations and make it easier for autonomous vehicles to hit the road.

Among the bills is a measure that would prohibit regulators from requiring pre-market approval for self-driving cars. Another measure would give up to 100,000 cars a year exemptions from regulations that the industry says are geared toward traditional vehicles.

Lawmakers also looked at legislation on how cars could share data and considered establishing a cybersecurity advisory panel as concerns grow over the self-driving vehicles’ and the threat of hacks. The issue has been receiving more attention from Congress in the last few weeks, as lawmakers struggle to keep pace with the rapidly emerging new technology.

The MRF is continuing to pound the pavement, making sure that motorcyclists have a voice and seat at the table when it comes to these types of vehicles.

Senate Majority Leader Mitch McConnell shelved plans for the Senate to vote this week on the Republicans’ proposed Obamacare repeal, suffering an embarrassing setback as he acknowledged the bill he wrote failed to win over enough troops in his own party.

Republican leaders insisted they will try again in July, but they struggled to explain how they might bridge the gap within their party, where conservatives want the bill to further dismantle Obamacare while moderates say it already goes too far. Critics of the Republican party and current Administration will undoubtedly chalk this up to a win.

They have already been vocal about the lack of promises kept by the party including tax reform, infrastructure revitalization and now healthcare…stay tuned.

EXECUTIVE & REGULATORY UPDATES – EPA Funding Slashed, Pruitt Faces Tough Questions

EPA Administrator Scott Pruitt was on the Hill this week to testify for the second time on the administration’s proposal to massively slash his agency’s funding by 31%. Alaska Sen. Lisa Murkowski, who chairs the committee, is already on the record as not being a big fan of EPA’s proposed cuts.

She noted that while she supports Pruitt’s approach of focusing on the EPA’s central responsibilities while steering away from the climate policies of the Obama administration, the current budget proposal is “in direct contrast” to such an approach.

Pruitt defended the proposal saying that the Agency could live up to its mission and focus on safeguarding the nation’s air and water with better leadership and less waste.

The Trump administration would reduce EPA’s funding by $2.4 billion annually — a larger percentage cut than at any other federal agency and eliminate all funding for research on climate change.

Your MRF is watching the EPA closely, those who ride know that the Agency has always been a thorn in the side of motorcyclists.

NEWS FROM THE STATES: TEXAS – Motorcycle Safety Fund SLASHED

We received word from our partners in Texas this week that the Governor eliminated half of the funding for the Department of Public Safety Motorcycle Safety Unit for the 2018-2019 calendar years.

This set the Motorcycle Safety program back to 2005 levels; a scary thought when motorcyclist fatalities are increasing.

Knowing the funding is vital, your MRF helped to spread the word by alerting our members in the State and drafting letters to be sent to both federal and state lawmakers as well as the Governor through our software program.

In the meantime, our brothers and sisters in Texas are keeping the pressure up on lawmakers communicating that this is unacceptable. Many of you have heard me preach about the fancy new software system the MRF acquired in January. It’s pretty damn impressive – I can draft a letter about profiling or how critical funding for motorcycle safety is and then send a link out via email or Facebook for people to send that letter that I drafted. It takes almost all of the work out of it for you. Because I know you have better things to do like work, spend time with the family or RIDE!

Gone are the days where you have to look up your lawmaker’s phone number or address, write them a letter, stamp it and mail it. Now you can click on a link (like the one above) or visit our website http://mrf.org/federal-legislative-issues/ and simply type in your name and address.

The software automatically finds your Member of Congress (at the federal AND state level) based off your address and then you can click “SUBMIT” after looking at the form letter that I drafted. You even have the option to edit it and personalize it to make it your own. How long does this take? Less than 2 minutes. Guaranteed. And the best part is…it makes a difference!

Take profiling for example. The profiling legislation in the House (H.Res.318) started out with 4 original cosponsors. That 4 grew to 7 during Bikers Inside the Beltway. Then we blasted the hill with constituent letters through our software…over 1800 letters were sent to almost every lawmaker in Washington. And guess what? That list of 7 has now doubled to 14. And all it took was a couple of clicks. It’s not perfect, but it’s a start.

These letters and communications help get us there. You’ve heard me say it before – the squeaky wheel gets the grease. So, take 2 minutes out of your day, and send a letter to your lawmaker. The industrial setting was designed much like the initial unveiling by the two iconic Italian brands at Milan Men’s Fashion Week in January.

Limited to only 666 units, the unique and powerful Ducati Diavel Diesel motorcycle blends both the past and the future into a striking image of retro, post-apocalyptic machinery. Each motorcycle features hand-brushed steel superstructures with visible rivets and welding, as well as a rich, genuine-leather seat, in addition to a metal frame plate highlighting the individual production number. The Ducati Diavel Diesel is currently en route to Ducati dealerships nationwide for $25,795 (MSRP).

Alongside the devilish motorcycle was the Diesel capsule collection dedicated to Ducati that reflects the DNA and common roots of the two brands: creativity and innovation are the key elements that make Ducati and Diesel two icons among products Made in Italy. On sale now, the collection consists of two Jogg Jeans, a leather biker jacket and two t-shirts.
 
 

 The new Ducati Diavel Diesel marks the second collaboration between Ducati and Diesel, the first of which, in 2012, the Ducati Monster Diesel, proved a groundbreaking alliance, while setting the foundation for the new creation.

SUPER ADVICE FOR THE HOLIDAY–

Do not corner something that you know is meaner than you.

A couple took a trip to the Holy Land and the husband decided to invite his mother-in-law. Before they even got there she was already complaining about the long flight and he knew he was in for a long trip.

For two weeks they visited every major site from the bible. They walked the path that Jesus walked from where he was born in the manger to the tomb where the stone was rolled away.

On one of the last days there the couple received some bad news from the hotel manager. A housekeeper had found the mother-in-law in her room dead of a heart attack. The manager informed them that they could take care of the arrangements and bury her in the holy land for only $200.00.

If they decided to take her back to the U.S. the expense of preparing the body for the trip and the flight would run about $5,000.00. The husband said he would think about it and let him know the next day.

The next day the hotel manager saw the husband in the lobby and asked him if he had made a decision. “I decided to take her back home for the $5,000.00,” He told the manager.

“That’s fine” said the manager “But do you mind me asking why since we can do it here for just $200.00”.

“Well I’ve been thinking about it”, said the husband, “And in the two weeks that we’ve been here all I’ve heard about was this man that they crucified and buried and then three days later he arose from the grave. For $4800.00 I’m not willing to take that chance!”

It’s been shot for Easyriders by Michael Lichter with all the shop bros on their FXRs.

 

Should I cover my son’s Dyna rebuild. He worked on it yesterday and installed the new Aeromach levers and the Brass Balls grips. We installed the Barnett Scorpion clutch last week.

How about my Sturgis Panhead. I installed the new PBI sprocket and a Biker’s Choice chain. Then I was able to install the Belt Drives belt and clutch and my rebuilt starter. This oil bag from Pacific Cycles in Long Beach came very close to being to tight to be used.

So, what’s it going to be?
