I had one of those super exciting days this week. Actually, the week was packed with twists and turns. The Easyriders magazine group stumbled, when it didn’t need to, and that was bothersome. Easyriders represented so much to so many of us for decades. It’s disturbing. It once represented honesty and a movement for freedom, and in some cases it still does.
Then the rest of the week unfolded as I worked with my grandson, Frankie, on his Dyna and we made pure progress, and I muddled around the shop working on my Panhead Project for Sturgis. I’ll try to write a report next week.
I made serious headway on my Hamster sculpture. And I was able to help a local brother, James, the tile man with his Dyna. Shortly, this puppy will be ready for clay. That’s a medium I know nothing about. We’ll see. You know the adage: Time will tell and shit will smell.
Uncle Monkey will relate to this. Everything fell into place with my Panhead project, and it went to Paint with Deny 528 yesterday. I know he’s building a bike for Born Free and I’m excited to see it. Actually Deny came to the headquarters and as an artist was moved by my art efforts as I am blown away by his.
He said, “I don’t want to be known as a painter.” I thought to myself: This guy is a master at what he does and completely unique in this industry. We will hopefully bring you a feature of his 1946 Indian that he restored, but made it look unrestored. Amazing.

TRAILBLAZERS NEWS– BOARD CHANGES

With the 2017 banquet now in our rear view mirror, the Trailblazers Board of Directors is moving ahead with a few changes of note. Trailblazers and AMA Hall of Famer, Tom White, moves up to Vice President this year, joining ongoing officers, Don Emde (President) and Judy Whitson (Secretary).
Tom has been the director of the Tom Cates Memorial Bike Show, presented by Hagerty Insurance for many years and the Board looks forward to utilizing his skills and experience in even more ways in the future. The Board thanks outgoing VP, Keith Mashburn for his years of service as President and Vice President.
Long-time Board member, Paul Colllins has stepped down as an active member of the Board of Directors, but will continue to serve in a newly added position as a Director Emeritus. The Board thanks Paul for his past service and looks forward to seeing him at next year’s banquet in his new role.
Joe Colombero has been elected to the Board replacing Collins. For those unfamiliar with Joe, he has an extensive history in the motorcycle industry, having worked at Suzuki Motor of America, KTM and other companies, including a senior writer at Don Emde Inc. He played a significant role in development of Don’s Cannon Ball Project, which resulted in the book “Finding Cannon Ball’s Trail.”He has also been the historical biographer in recent years writing the stories for the Trailblazers banquet programs and videos. We welcome Joe to the Board.
We have been saddened in recent weeks and months with some serious health related matters with some of our directors. Jody Nicholas was seriously injured in a motorcycle incident a few weeks ago, but is thankfully gradually improving. After his initial treatment at Mission Hospital, Jody was recently moved to St. Jude Rehabilitation Center in Fullerton. He can now receive visitors there as well as cards and letters and we encourage anyone in the area to pay him a visit, and/or send him you well wishes. St. Jude Medical Center, 101 E. The U. S. Trade office is still trying to enact a 100 percent tariff on motorcycles imported from the European Union. In February, a USTR official admitted that motorcycles were included in the proposal as leverage to achieve relief for the beef industry. NORTH DAKOTA GUN NUT REPORT– Court’s Commonsense Conclusion: “There Was a Gun” Isn’t Enough to Justify Issuing a Restraining Order
The Supreme Court of North Dakota confirmed this week that simply possessing a handgun while on one’s own private property cannot support a finding of “disorderly conduct” under the state’s disorderly conduct restraining order law. The decision is Keller v. Keller, 2017 ND 119 (N.D. May 16, 2017).
Karen Keller is married to Chad Keller. They live together with Chad’s children from a previous relationship on a rural property outside of Bantry (pop. 14, as of the 2010 census) in McHenry County, North Dakota.
On August 14, 2016, Nichole, Chad’s ex-wife and the mother of the children, had emailed Chad about picking up the kids. Chad responded that the children did not want to go with her. Nonetheless, Nichole and a friend, Rachael, later drove out to the Keller property, stopping short of the driveway. Nichole did not initially get out of the car.
Karen did not recognize the vehicle and came out of the house to see who it was. When Karen turned to go back inside, Rachael and Nichole saw that Karen had been holding a handgun behind her back. The visitors remained some 200 feet away from Karen, and Karen did not leave the residential property.
It was undisputed that Karen did not raise or point the gun at anyone, or make any threatening, abusive or violent statements. (It seems Karen and Nichole did not speak to one another at all during the encounter.) After talking with her child, Nichole left with Rachel.
Nichole called the police. A deputy concluded there was no cause to file charges as nothing in Karen’s conduct violated statutory limitations relating to firearms. Nichole then sought and obtained a one-year disorderly conduct restraining order against Karen, on the basis that she felt fearful for her life because of the gun.
The court issuing the restraining order ruled that the mere presence of a firearm was enough: “[T]here was a gun. [Karen] brought it out on the property. And it’s obvious that Nichole was very scared. And she testified that she is still scared. And to me, that is the definition of gestures that are intended to adversely affect the safety, security, or privacy of another person…”
North Dakota, however, has a statutory definition of “disorderly conduct” in the context of a restraining order. Pursuant to N.D. Cent. Code § 12.1-31.2-01, a judge may grant an order only if there are “reasonable grounds to believe” that a person has engaged in “disorderly conduct,” defined as “intrusive or unwanted acts, words, or gestures that are intended to adversely affect the safety, security, or privacy of another person.” Significantly, this definition expressly excludes any “constitutionally protected activity.”
Karen appealed the issuance of the order, claiming the court was wrong in finding that disorderly conduct existed. She argued that it was not reasonable for someone to be afraid of another person for simply holding a weapon in a non-threatening manner. Further, she pointed to the exception for conduct – like the right to keep and bear arms – protected under federal and state constitutions.
Karen testified she carried a handgun whenever an unknown vehicle arrived at the property. The legal brief she filed with the court indicated she did not know or trust Rachel, and that Nichole had allegedly threatened violence against Karen in the past.
A unanimous, five-member panel of the Supreme Court of North Dakota invalidated the order. The court below had erred in not addressing whether Karen’s actions were constitutionally protected and, if they were, by not excluding evidence of the activity as required by state law. In fact, “Karen Keller’s conduct … was constitutionally protected. Nothing in the record suggests her conduct violated the statutory limitations of possessing a firearm… No evidence exists that the disorderly conduct was anything but possession of the gun, and nothing in the record suggests Karen Keller’s actions went beyond her constitutional right to possess a handgun on her private property.” The only evidence alleged as “disorderly conduct” was constitutionally protected activity that had to be excluded from the court’s consideration, so nothing remained to support the restraining order.
This outcome is entirely consistent with the law, with common sense and with reality. The core of the Second Amendment is the fundamental, individual right to possess and carry a firearm to defend oneself and one’s family. Karen Keller lived in a rural area some distance away from the nearest city, and made it a rule to carry a firearm when unfamiliar persons dropped by. In this particular encounter, she made no threats, did not display her weapon in an aggressive or menacing way, and stayed close to her residence at all times. Millions of Americans keep a gun at home for the same reason – because the police can’t always be there to stop a burglary or home invasion or other crime as it unfolds.
To decide – as the court of first instance did – that possessing a gun on one’s own property, without more, amounts to “disorderly conduct” is directly at odds with the U.S. Supreme Court’s decision in District of Columbia v. Heller, and equates mere gun possession with lawlessness. As we know, the overwhelming majority of gun owners are not criminals and use their lawfully possessed firearms responsibly. Unfortunately for Karen Keller, though, she had to go through a lengthy and likely expensive legal appeal process before her rights were vindicated.

ANTI-DUI EFFORT– Is this a cause, or going to be a cause, for you and BikerNet? I misunderstood at first when I read your earlier email, and yelled out to my wife, “Jesus H. Christ. Keith Ball is pro drunk driving, and hates MADD, mothers with dead kids.”
Then I realized that’s not what you were saying. That you’re anti-DUI, which makes sense. How do we get away with making one’s body chemistry illegal when no crime or harm has been inflicted on anyone? Why not make DWA illegal also? (Driving While Asian. I give a wide berth to Asian women driving minivans, for instance.) DUI is just another form of profiling, while cops should be looking out for reckless drivers, not people with alcohol on their breaths.
The more I think about it, the more outrageous it becomes.
Why not take on this cause the way you took on helmet laws? I could see you on TV programs making your point. You could even make people think you really are pro-drunk-driving, and then make your valid point. Don’t you think someone like Bill Maher would be intrigued? Whenever I’ve interviewed you, you come across as calm and reasoned. I’m kind of friends with Tucker Carlson. I wrote for his conservative website The Daily Caller, even though I’m not at all a conservative. He’s on Fox News now. He might go for something like this.
Just a thought. It’s one of those ideas that sounds wacky at first–as I admit it did to me–but then it turns out to be valid, and very much against actual, as opposed to hypothetical, drunk driving accidents.

EASYRIDERS FAILED SALE– I read the new about Easyriders in the Sunday post. Very sad for me. If it closes, ends, the biker landscape is forever changed. Easyriders has dropped off a lot the past few years, not the same rip-roaring, tell it like it is magazine it used to be but I for one will miss it.
I have a lot of memories wrapped up in that magazines. Memories of me and my buddies sitting around on Friday nights talking bikes, going over and over every issue coming up with ideas for our bikes.
There was nothing like going down to the local 7-11 and picking up the latest issue.
What happened? I guess like everything time changes it? Did the ownership become stagnant? Maybe? Did the readers grow old and lose interest? Maybe some did but not all.
I still subscribe because some part of me would not feel right with out opening the mail box once a month and seeing it in there. There is still a little feeling of excitement taking it in the house and opening it. I guess I am getting old too and maybe set in my ways????

HARLEY BUILDING A PLANT IN THAILAND– Iconic motorcycle builder Harley-Davidson, praised by US President Donald Trump as a pillar of American manufacturing and keeping jobs at home, is building a new plant in Thailand.
Harley-Davidson serves as an example of the nuanced economic realities that are pushing US companies to lay off workers at home and set up new factories overseas. Unions representing its workers accuse the company of cutting US jobs to hire lower-paid foreign workers. Yet global trade barriers and proximity to a growing base of new customers also play roles, complexities inherent in Trump’s ambition to overhaul trade policy.
Motorcycles made in the new factory – plans for which had not been previously disclosed – will be sold in Asia, not the United States, which its domestic plants will continue to serve, Harley-Davidson said.
“This is absolutely not about taking jobs out of the United States,” said Marc D McAllister, a managing director of international sales at Harley-Davidson based in Singapore. “This is about growing our business in Asia.”
Still, unions representing its workers in the United States are not pleased.
“Why couldn’t we build them in the US and export them?” asked Leo W Gerard, the international president of the United Steelworkers, which represents Harley-Davidson workers at plants in Wisconsin and Missouri. He expressed concern that the company could be entering a “race to the bottom” in pursuit of lower labor costs.
“It’s a slap in the face to the US workers who built an American icon,” said Robert Martinez Jr, the international president of the International Association of Machinists and Aerospace Workers. The union represents Harley-Davidson workers at plants including one in York, Pennsylvania, where the company plans to lay off over 100 workers.
Harley-Davidson argues that steep trade barriers in a high-growth market, not a desire to cut US jobs, drove the move. Southeast Asia offers rapid development and increasingly affluent spenders, but many countries in the region levy high tariffs on imported goods that make its motorcycles prohibitively expensive, the company says.
“Building bikes in the US and exporting them does not get us the benefits that we’re talking about when it comes to the tariff barriers,” said McAllister, a 22-year veteran of the company.
Harley says the new Thailand plant will help it serve more Asian riders like Akaravech Chotinaruemol, a retired financial analyst in Bangkok who collects Harleys and enjoys taking them on winding road trips in Thailand’s rural and mountainous north. For him, nothing else compares to the sound and sensation of riding a Harley.
“I ride only Harley-Davidson,” he said, “and nothing else.”
“It’s a hobby to me, a toy, holiday entertainment,” he added. “And it’s also like a traveling companion.”
Mr Akaravech’s most expensive Harley, a custom 2013 Road Glide, cost roughly US$60,000 (about 2 million baht), thanks in part to Thailand’s high tariffs. In the United States, the same model retails for just over half that amount. The Thailand plant would assemble lower-cost motorcycles.
Harley-Davidson has long cast its eyes abroad amid sluggish growth at home. It hopes to make half its sales international over the next decade, compared with about one-third last year and less than one-quarter 10 years ago. Its international sales last year grew 2.3%; by contrast, sales in the United States fell 3.9%.
Despite Harley-Davidson’s all-American reputation, the Thai plant will not be its first abroad, or even in Asia. The company opened a similar plant in Bawal, India, in 2011 to help it get around that country’s 100% tariff on imported motorcycles. It also assembles motorcycles at a plant in Brazil and has a wheel factory in Australia. The Thailand plant will assemble motorcycles for Asia that were previously imported from India or the United States.
Harley-Davidson’s made-in-Thailand motorcycles will avoid the country’s up to 60% tariff on imported motorcycles. They would also get a huge break on tariffs when exported to Thailand’s neighbours, thanks to a trade deal among the 10 members of the Association of Southeast Asian Nations (Asean).
The Thai plant is also intended to help serve a vast market in mainland China. Asean is pursuing an enlarged free-trade area with Beijing. And McAllister of Harley-Davidson said the Thai plant would lower the transport and shipping time to the Chinese market to around five to seven days, from 45 to 60 days from the United States.
For big companies, “the economics are increasingly compelling, and Asean is again attracting the lion’s share of foreign direct investment into Asia, after China had been the primary destination for many years,” said Frederic Neumann, a co-head of Asian economic research at HSBC in Hong Kong.
By contrast, many of those nations charge steep tariffs on foreign-made goods like Harley motorcycles.
Mr Trump in February used those trade barriers to illustrate the obstacles US manufacturers face when they sell abroad, a central argument as he pushed to renegotiate US trade deals. Four weeks after the Harley-Davidson executives visited the White House, the president said in a speech to congress that he had asked them about international sales.
“They told me – without even complaining, because they have been so mistreated for so long that they’ve become used to it – that it’s very hard to do business with other countries because they tax our goods at such a high rate,” he said.
“They weren’t even asking for a change,” he added. “But I am.”
The new Thai plant is moving into an area already populated with foreign names in the eastern province of Rayong, near the manufacturing operations of Ford, Ducati, General Motors and Suzuki. The plant will initially employ about 100 people assembling motorcycles mainly from imported kits when it opens late next year.
Mr Akaravech said he would not expect there to be a big difference between motorcycles made in Thailand and ones made in the United States. But he expressed concern that an influx of cheaper, zero-tariff, locally made Harleys would bring down valuations for used ones – like those he collects.
“It’s going to hurt the sentiment of the market,” Mr Akaravech said. “If the price is going down, that discourages riders from buying.”

SOUTH AUSTRALIA Radar steers motorcyclists out of danger–
RADAR technology initially developed for use in driverless cars has been adapted for motorcycles.
Vehicle-to-vehicle communications developer Cohda Wireless from South Australia has partnered with Bosch, Ducati and Autotalks on a “digital protective shield” that warns riders of nearby traffic before they see oncoming cars.
Bosch is commercialising the technology in Ducati production bikes but the radar could also be retrofitted to any car or motorcycle.
According to Bosch, motorcyclists are about 18 times more likely to be killed in a collision than car drivers. However, it claims the new radar could prevent nearly one-third of all motorcycle accidents.
Production of the technology is being driven by a proposed mandate from the United States Department of Transportation that would require all new vehicles to have vehicle-to-vehicle radars installed.
Cohda Wireless Managing Director Paul Gray said the radar was the next step in safety from seatbelts and air bags.
“Technologists have gone as far as they can in terms of minimizing harm during an accident and now it is about avoiding the accidents before they even happen,” he said.
“If a motorcyclist is riding down the street, it will be alerted when a car turning onto the same road creates an opportunity for an accident. This can also happen when the car moving onto the road is not visible to the rider.
“The radar will also alert drivers who are changing lanes if someone is in their blind spot, which is quite an issue for motorcyclists.”
Gray said the technology would eventually be in every autonomous car as well.
Cohda commands about 60 per cent of the vehicle-to-vehicle communication market.
The system uses the public WLAN standard (ITS G5) as the basis for the exchange of data between motorcycles and cars.
Information such as vehicle types, speed, position and direction of travel will be transmitted at a rate of up to 10 times per second to ensure a high level of accuracy.
To allow riders and drivers who are further away to reliably receive the necessary information, the technology makes use of “multi-hopping”, which forwards the information automatically from vehicle to vehicle.
It can be transmitted to any car or motorcycle within a several hundred-metre radius.
The new system is combined with a 3D map, which provides highly accurate positioning and instantly detects vehicle speeds. It can also send notifications through a rider’s helmet using stereo sound.
Bosch board member Dirk Hoheisel said the added ability of letting vehicles communicate better between themselves took road safety to the next level.
Last year, South Australia became the first state in the country to introduce laws allowing for trials of driverless cars on open public roads.
Cohda Wireless’ technology has been trialled on the closed Southern Expressway, on the outskirts of the South Australian capital Adelaide, but the next phase of testing will see it trialled in the CBD and on other urban roads in the coming months.

Especially Land Speed Records. The world’s fastest motorcycle, the TOP 1 ACK ATTACK, is bound for Bolivia for an epic adventure to exceed its own record of 376.363 mph/605.697 km/h.
The twin-engine streamliner is going to make a run for the record on the remote Salar de Uyuni salt flats high in the Andes mountains between August 3-8, 2017.
The TOP 1 ACK ATTACK’s previous record-breaking runs took place on the legendary Bonneville Salt Flats, but the team is now travelling to Bolivia to conquer this new challenge. “Bolivia has been selected because it has a much longer run up and down of 16 miles versus about seven miles at Bonneville,” explains ACK ATTACK pilot and three-time World Land Speed record holder Rocky Robinson. “This makes it safer, too. Wheel spin on driven – not thrust/jet – streamliners is a danger, so the acceleration has to be very gradual to avoid awkward handling. Distance is your friend!”
“Honestly, we would have preferred to set the record in Bonneville,” adds TOP 1 VP of Sales & Marketing Frank Ryan. “TOP 1 lives and breathes the American lifestyle. We produce and package our products in the USA before distributing them to 60 countries around the world. However, several years of bad conditions at Bonneville, coupled with record rainfall this year, means we have to travel to the top of the world to find optimal conditions. Those conditions just happen to be at 12,000 feet above sea level in the Andes mountains.”
Breaking down Bolivia by the numbers: Salar de Uyuni is the world’s largest salt flat at 10,582 square kilometers (4,086 square miles) with an elevation of 3,656 meters (11,995 feet) above sea level. The high elevation will play havoc with fuel management, and the harsh conditions will take their toll on the entire team, but Robinson says they are on a mission to not only defend the current World Land Speed Record of 376 mph/605 km/h, but also to be the first motorcycle to break the 400 mph speed barrier!
“When we started to build the TOP 1 ACK ATTACK in 2003, our goal was to exceed the record of 322 mph that had stood for 16 years with the Easyriders Streamliner,” said Mike Akatiff, builder of the TOP 1 ACK ATTACK, “but in the back of my head was the thought that we could build a bike to actually go 400 mph. We began challenging the record in 2004, and, with the backing of TOP 1 Oil, we have broken the record three times: in 2006, 2008 and 2010. The 2010 record still stands today at 376.363 mph, but I believe the bike is now ready to go much faster, and with a suitable race track
we feel we can make history once again.”

NEWS FROM THE CAPITAL– Quicker Veterans Benefits Delivery Act of 2017
This bill requires (current law authorizes) the Department of Veterans Affairs (VA) to accept, for purposes of establishing a claim for veterans disability benefits, a report of a medical examination administered by a private physician without requiring confirmation by a Veterans Health Administration physician if the report is sufficiently complete (defined as competent, credible, probative, and containing such information as required to make a decision on the claim for which the report is provided).
The VA is required to submit: (1) a report on the progress of the VA’s Acceptable Clinical Evidence initiative in reducing the necessity for in-person disability examinations, and (2) an annual report for each VA regional office regarding claims for which private medical evidence was determined to be unacceptable.

UNCLE MONKEY ON THE EARLY SHIFT– With a soft kiss the old lady headed out to the early shift. Try as you might you just can’t get back to sleep.
Reluctantly you wonder down to the kitchen. You check out the window to make sure the world is still there, grumble at the bird chirping on the window ledge. You tidy up around the house as you pass through before heading to the garage.
Still early you pass the time working on the honey-do list striking several items off the list.
As quick blast to the hardware store replenishes stock and eliminates a few more items from the list. Satisfied that you knocked down the list enough you slip on some cleaner jeans and throw your leg over the bike for some me time.
You head down by the park across to the water ways. The pavement is hot under foot and the bike it running strong. A few passes along the main strip and a lap or two around the roundabout. Mid-day sun bright overhead your stomach reminds you that you had headed to the garage with little more than a cup of coffee.
You meander your way down to the new Mexican joint overlooking the rail yard. A couple tacos and a cold beer to wash them down as you watch the trains pass by. An old timer farther down the window counters eagerly talks to a long gone friend about locomotive 348 and its place in history.
A heavy freight of shipping containers clank along the tracks across the way as the waitress clears your mess and brings another cold beer. Some kids skid their bicycles to stop to check out your bike.
The old man has moved closer to you to tell you about his time in the rail yards when he wasn’t much older than you, back when everything moved by rail. He explains the importance for the yard.
After you finish your beer you thank him for the history lesson, scatter the kids swarming around your bike with a friendly growl before they settle back in as you strap on the shorty helmet. They plug their ears as you fire the bike, race you as you ride away into the day.

ALWAYS ON THE MOVE— I can’t believe it’s the 25th of May and June is around the corner. I can’t believe I’m trying to hustle to build a Panhead to ride to Sturgis. What the hell, but I couldn’t resist.
We will work on the Story about my Grandson’s trip to Scott Jacob’s art retreat next week. And a flurry of techs will head your way regarding my Grandson’s 2005 Dyna Glide. He’s had an eye infection.
We are just about to launch the Merch Performance Shovelution engine tech next week. Their team is doing a helluva job and making Shovels oil like Evolutions.
With the sheet metal off to the master, I will start to strip then rattle-can the frame satin black. Nothing fancy here. This shows the Lowbrow bracket for mounting fenders. Worked like a champ, except my welds aren’t as sharp as the Kraft Tech crews’.
I spent over an hour making this goofy but strong seat mounting bracket. When I was done, I wondered whether it was in the right position or not. Still don’t know. I test everyone who walks into the shop.
Years ago, I used old pipes to make a bird feeder for the official Bikernet Patio. Last year I started to notice the chrome peeling off one muffler. Just recently it gave way to the bird shit and water from the feeder above. It’s toast.
There’s more but a whiskey bottle is waiting and Paughco parts to install.
