It’s almost 11:00 a.m. on a Thursday, and I haven’t finished collecting news. Ray Wheeler and I stumbled into our favorite watering hole recently, Iron City, in San Pedro. As we sat down in the comfortable booth across the dark dining room, away from the myriad of brilliant TV screens overshadowing the bar with streaming sports activities, the bubbly Polish Pistol danced across the bar and threw two coasters on our dark oak table. “Whatta ya have?” she squeaked.

“Jack Daniels on the rocks, a double,” I barked and looked down at the thick pressed paper coaster. Here’s what it said:

“Are you an Eternal Optimist?” I turned it over, and here’s the Blue Moon sponsored message: “You’re a glass-half-full kinda character. Heck, your glass overflows into sunny beams of positivity that can put a smile on the gloomiest face. When life hands you lemons, you ask for an orange. A whole slice of an orange. Because that’s how you garnish your Blue Moon beer. An optimistic is what you are.”

I am what I am, and that’s all that I am—Popeye. Where’s that Jack Daniels? Let’s hit the news.

HANDLING NEGATIVE FOLKS–  This is something to think about when negative people are doing their best to rain on your parade.. So remember this story the next time someone who knows nothing, and cares less, tries to make your life miserable.

A woman was at her hairdresser’s getting her hair styled for a trip to Rome with her husband. She mentioned the trip to the hairdresser, who responded:

” Rome? Why would anyone want to go there? It’s crowded and dirty. You’re crazy to go to Rome. So, how are you getting there?”

“We’re taking Continental,” was the reply. “We got a great rate!”

“Continental?” exclaimed the hairdresser. “That’s a terrible airline. Their planes are old, their flight attendants are ugly, and they’re always late. So, where are you staying in Rome?”

“We’ll be at this exclusive little place over on Rome ‘s Tiber River called Teste.”

“Don’t go any further. I know that place. Everybody thinks it’s gonna be something special and exclusive, but it’s really a dump.”

“We’re going to go to see the Vatican and maybe get to see the Pope.”

“That’s rich,” laughed the hairdresser. You and a million other people trying to see him. He’ll look the size of an ant.

Boy, good luck on this lousy trip of yours. “You’re going to need it.”

A month later, the woman again came in for a hairdo. The hairdresser asked her about her trip to Rome .

“It was wonderful,” explained the woman, “not only were we on time in one of Continental’s brand new planes, but it was overbooked, and they bumped us up to first class. The food and wine were wonderful, and I had a handsome 28-year-old Flight Attendant who waited on me hand and foot.

And the hotel was great! They’d just finished a $5 million remodeling job, and now it’s a jewel, the finest hotel in the city. They, too, were overbooked, so they apologized and gave us their owner’s suite at no extra charge!”

“Well,” muttered the hairdresser, “that’s all well and good, but I know you didn’t get to see the Pope.”

“Actually, we were quite lucky, because as we toured the Vatican, a Swiss Guard tapped me on the shoulder, and explained that the Pope likes to meet some of the visitors, and if I’d be so kind as to step into his private room and wait, the Pope would personally greet me.

Sure enough, five minutes later, the Pope walked through the door and shook my hand! I knelt down and he spoke a few words to me..”

EASYRIDERS KICKS OFF THE 2013 SHOW CIRCUIT IN ANAHEIM CALIFORNIA–This is the annual kickoff show for the Easyriders tour.

The new custom bikes for the year show up here and then go on to several other US cities. They pulled massive crowds with the Jax star of Sons of Anarchy signing autographs.

Their bagger book pulled a large showing of custom dressers. Bike entries were up and dazzling. The chopper world is alive!

CALIFORNIA COURT OF APPEALS THROWS OUT RED LIGHT CAMERA TICKETS– By Stephen Frank

December 31, 2012 — Red light cameras are coming under increasing legal fire in the Golden State. On Friday, California’s second-highest court published a ruling that struck down red light camera evidence as insufficient to convict a motorist. On June 3, 2009, a camera belonging to the Australian firm Redflex Traffic Systems accused Annette Borzakian of entering the Beverly Hills intersection of Beverly Drive and Wilshire Boulevard 0.28 seconds after the light hand turned red.

Borzakian, a former deputy public defender, decided to fight the citation. During her January 2010 trial, Officer Mike Butkus provided the standard testimony that introduces Redflex evidence in all jurisdictions. Commissioner Carol J. Hallowitz ignored Borzakian’s objections, admitted the evidence and found Borzakian guilty, imposing a $435 fine plus a twelve-hour traffic school. Borzakian immediately appealed, citing the US Supreme Court case Melendez-Diaz v. Massachusetts, which the traffic camera industry has feared since it was decided in 2009.

That case clarified that the Constitution’s Confrontation Clause gave defendants the right to question the actual technicians responsible for analyzing forensic evidence. Here, Officer Butkus played no role in the operation or maintenance of the red light camera system. He merely read the sheet of paper that Redflex handed him. Borzakian argued that this made the photo ticketing evidence inadmissible hearsay. The superior court’s appellate division insisted Melendez-Diaz did not apply.

“The people have never been required to have Redflex employees such as the custodian of records or the field service technicians present in court in order for the people’s exhibits to be admissible,” the three-judge appellate panel found. “Officer Butkus is perfectly capable of authenticating the documents and laying the necessary foundation for their admissibility and in the court’s opinion had done both in this matter. It was explained to [Borzakian] that she could have filed a discovery motion or issued her own subpoenas, as many motorists do, had she cared to do so.”

The three-judge Court of Appeal panel did not agree. Instead, it sided with the Orange County Superior Court’s Khaled decision. State law allows the use of red light camera evidence, but it does so only if certain standards are met. Among these is that the prosecution must establish the yellow light duration at the intersection meets the minimum state standards. Here, Officer Butkus concluded the light had been yellow for 3.15 seconds and that this was sufficient.

“Even assuming a 3.15 second interval meets the mandatory minimum yellow light interval as mandated by the legislature, according to Officer Butkus’s testimony then, he relied upon text typed across the top of two photos, stating ‘Amber: 3.15,’” Justice Fred Woods wrote for the Court of Appeal. “Accordingly, where the evidence was being presented to show the duration of the yellow traffic signal met the minimum interval mandated by the legislature — measured to the hundredth of a second — the record does not support the conclusion Officer Butkus was otherwise qualified to state that the representation was accurate.”

The three-judge panel did not find credible the argument that the red light camera photographs and maintenance logs were merely routine governmental business records that did not require authentication. The court noted that the records were created by Redflex, not the government. “Without the proper testimony, the maintenance logs (and therefore the photographs with text typed across the top) were not properly admitted,” Justice Woods concluded. “Without these documents, as in Khaled, there is a total lack of evidence to support the Vehicle Code violation in question.”

The Court of Appeal reversed Borzakian’s conviction in a decision originally handed down on January 26. The three-judge panel on Friday decided that the decision should hold precedential value and ordered it to be published. I don’t know if it is dangerous for me to express my opinion openly in Indonesia.
But I would say that there are more important things to do like erasing poverty, giving women equal rights, etc.

This is one of the reasons why I’m against the implementation of sharia law. Witty ulema (sharia lawmakers, whatever you call it) like to create silly laws that according to them, conform to Islam.
They might have a profound understanding of Islam, but they have a narrow vision of the world: Muslims can’t give holiday greetings to non-Muslims in Indonesia; women can’t drive cars in Saudi Arabia; women can’t straddle bikes in Aceh.

They’ve gone back to the Stone Age.

WEEKLY GUN NUT REPORT–Today I’m going to explain why gun-control is not only entirely reasonable but also certain to be effective. Only the ignorant can deny this.

First, some orientation. Cement-headed NRA types need to recognize, and state manfully, that the illegalization of guns is in fact perfectly practical. History has shown this repeatedly. When the government outlaws something that huge numbers of people very much want, the outlawed items immediately disappear from society. This has been shown countless times.

When Washington outlawed alcohol, booze vanished overnight and everyone stopped drinking. Can anyone deny this? When Washington banned the use of cannabis, all of those of us made insane by Reefer Madness quit smoking dope, and today there is probably not a town in America in which one might buy a joint.

Similarly, Washington made illegal the downloading of copyrighted music – which also stopped immediately. No one now has illegal music. Ask your adolescent daughter.

So with guns. They are small, easily smuggled, of high value to criminals and will be of higher value when only criminals have them, so it is virtually certain that they will vanish when the government says so.

Mexico, where I live, has stringent laws against guns, which have proved at least a partial success. Criminals have AKs, RPGs, and grenades, while nobody else has anything. That’s a partial success, isn’t it?

While I am in favor of illegalizing guns and thus ending crime, I think the principle should be democratically applied. Let us begin by disarming the Pentagon. If this seems unreasonable, ask yourself: who kills more children in a month, Ritalin-addled little boys in America, or the US Air Force in every Muslem country? All I ask is an honest body count. I will accept your numbers.

But let’s ask the question: Why have American school boys, who in my rural Virginia high-school of 1964 were armed to the eyeballs with deer guns and varmint rifles, never shot anybody intentionally or accidentally?

Make trade courses available in every High School, and make child rearing courses available, if not mandatory. Open the door to education which builds mental strength. Friday we will bus into town to check out the Acropolis if it is a good time for it. Saturday, we are setting up a van tour to Sounion to see the Temple of Poseidon. We board the boats Saturday evening. We spend the rest of the week cruising the amazing Saronic islands.

MOTORCYCLE ESCORT PROGRAM–I Need your need help please. On the link below is the Memorial of our Motorcycle Escort Program we introduced in 2012. It got through the senate committees but we ran out of time, But it did get all the way to the Senate Floor.

A few weeks ago we meet with DOT, State and City Police and MRF to discuss this piece of legislation. DOT and the police dissected it and gave us cons concerning the project.

Some Cons discussed.

Who would be responsible for training the escorts, what program would they attend.

Police currently attend 180 hours of motorcycle escort training in our state, would civilians be willing to undergo that time and type of training if not more. What would be the cost to the participant be.

What government agency would be responsible for the certification.

There is also the extra cost of equipment to the bike who is the escort and additional liability insurance.

Police made it clear they are never going to give a civilian the authority to block traffic. Many times people in vehicles don’t even respect the police and at least the police have the authority to arrest or to give a citation, but civilians do not have that option.

There suggestion was, if there is a toy run, why does it have to be parade like and all travel together through all intersections. If we all know the start location and end location, they suggested persons just go to the event and follow the laws of the road,

Concerns were a person blocking an intersection, than having to speed ahead of all the other bikes to block the next intersection ahead, which is very dangerous due to the high rate of speed to get ahead.

After listening to all this Con the NMMRO has decided to hold off on submitting this piece of legislation from our organization. The person who wrote the memorial may still pre file it.
I am concerned about the safety of the escorts at this time, and until I can compile more information of how to make a program like work I prefer to wait.

I ask for your input to assist us all since many of us are discussing and suggesting similar legislation in our separate states, and for those state who have implemented a program as such please share with us us your accomplishments and failures.

If we are promoting safety awareness to all who share the road and ask that we all be treated equally on our roads, doesn’t this go against what are we are trying to accomplish so others will still respect motorcyclist. Please I request your suggestions, feedback positive or negative and idea. Thank you.

EARLY TIMES: The Birth of ABATE of Wisconsin– We hope you join us on January 12, 2013 at the Marshfield Eagles Club for a very special presentation. Dave Zien, Ron Leonard and I will be presenting the Birth of ABATE of Wisconsin, starting way back with the origin of helmet standards and mandates, the formation of the “outlaw” biker culture and how it evolved into the modern day rights movement.

Did you know ABATE of Wisconsin was not recognized, authorized or approved to operate in Wisconsin by the National ABATE headquarters in Sacramento, California? Dick Smith of the BBA made that inquiry, and it’s absolutely true…we were not recognized by the National ABATE.

Did you know our helmet law here was first challenged by a 1% biker and it went all the way to the Wisconsin Supreme Court? That was almost six years before ABATE of Wisconsin was born. I think you’ll find our history facinating. There will be lots of archival materials to view. Hope to see you there.

Excecutive Director Dave “Chubby” Charlebois will welcome everyone to Marshfield and invite people to spend the night in town and attend the Board Meeting on Sunday. He’ll also report on the State of ABATE today and how the early groundwork of ABATE pioneers built the foundation of the best ABATE chapter in the country.

Tony Pan will describe the outlaw biker culture and how it evolved into the rights movement. Are you an outlaw biker? You might be surprised by the answer. The intricate ballet that was danced between the BBA and ABATE lead to the historic helmet rally of 1977, but do you know what was going on behind the scenes? Do you know what else we accomplished during that same time period?

Dave Zien will bring his passionate story-telling technique to Marshfield as he describes the atmosphere surrounding the huge helmet rallies. He’ll also describe how much of what we did in the 1970’s led to some very interesting, sometimes non-motorcycle accomplishments of the ’80s and ’90s.

Ron “Tick” Leonard was an early district director (we only had 3 back then) and he’ll be talking about what it was like organizing in those early years.

Don’t miss out on this epic event. There will be a 50/50 raffle to benefit ABATE and ABATE products will be on sale also. Region 4A is hosting the event, and it’s absolutely free to anyone attending. I hope non-ABATE members come also so they can see why ABATE is so important to support. This event is open to the public. I know there will be ABATE members from California and Illinois present at this event, and they are very much interested in our history. We’re going to attempt to video tape the program and hopefully, if the video is of good quality, Attorney Mike Hupy said he would produce the tape and make it available to ABATE to use as another PR tool.

BIKERNET DUCK TESTIFIES–A duck walks into a pub and orders a pint of beer and a ham sandwich.
The barman looks at him and says, ”You’re a duck.”

“I see your eyes are working,” replies the duck.

“And you can talk!” exclaims the barman.

“I see your ears are working, too,” Says the duck.

“Now if you don’t mind, can I have my beer and my sandwich please?”

“Certainly, sorry about that,” Says the barman as he pulls the duck’s pint. ”It’s just we don’t get many ducks in this pub. What are you doing round this way?”

“I’m working on the building site across the road,” explains the duck. ”I’m a plasterer.”

The flabbergasted barman cannot believe the duck and wants to learn more, but takes the hint when the duck pulls out a newspaper from his bag and proceeds to read it.

So, the duck reads his paper, drinks his beer, eats his sandwich, bids the barman good day and leaves.

The same thing happens daily for two weeks. Then one day the circus comes to town.

The ringmaster comes into the pub for a pint and the barman says to him ”You’re with the circus, aren’t you? Well, I know this duck that could be just brilliant in your circus. He talks, drinks beer, eats sandwiches, reads the newspaper and everything!”

“Sounds marvellous,” says the ringmaster, handing over his business card…”Get him to give me a call.”

So the next day when the duck comes into the pub the barman says,“Hey Mr. Duck, I reckon I can line you up with a top job, paying really good money.”

“I’m always looking for the next job,” Says the duck. “Where is it?”

“At the circus,” Says the barman.

“The circus?” Repeats the duck.

“That’s right,” Replies the barman.

“The circus?” The duck asks again. With the big tent?”

“Yeah,” the barman replies.

“With all the animals who live in cages, and performers who live in caravans?” says the duck.

“Of course,” the barman replies.

“And the tent has canvas sides and a big canvas roof with a hole in the middle?” persists the duck.

“That’s right!” says the barman.

The duck shakes his head in amazement, and says “What the f*** would they want with a plasterer??!”

HOLLISTER RALLY APPROVED– On Monday, January 7, the Hollister City Council unanimously and enthusiastically voted to bring back the world renowned Fourth of July motorcycle rally for the 2013 season. The re-born event, which has been on hold since 2009, is set to take place on July 5th & 6th.

The American Biker image was born in Hollister Fourth of July weekend in 1947 when a group of rowdy bikers in town for the annual Gypsy Tour event reportedly terrorized the town. The story was picked up by Life magazine who published the iconic photo of a drunken biker sprawled on his bike amid a sea of beer bottles. The exaggeration was further sensationalized in the Marlon Brando movie “The Wild One”. The image stuck and has become an icon of Americana that lives to this day.

After “The Invasion of Hollister”, the annual Gypsy Tour event went dormant for decades. In preparation for the 50th anniversary of the historic event, Sonny Barger presented the idea of a rebirth to the city of Hollister and local business people. It took a lot of effort by many people, but it didn’t take long for the Hollister Independence Day Rally to become the largest Motorcycle Rally on the West Coast.

This year, attendees can expect motorcycle-only parking filling downtown Hollister with side streets devoted to a wide variety of rally vendors. Two large entertainment areas downtown will offer live entertainment and local beer gardens. On Saturday, center lane parking on the main drag will be occupied by the official bike show which is a part of the World Championship of Bike Building. Motorcycle manufacturers will be in attendance at multiple locations offering demo rides.

Riders will receive an enthusiastic welcome back from local businesses, eateries and taverns for this annual town highlight. Around the area there is excellent scenic riding, wine tours and a summer concert series at a local vineyard’s outdoor amphitheater.

The Hollister Rally was shut down due to demands from the Department of Justice and the California Highway Patrol to the tune of $385,000. Like gangsters they demanded payment before they would allow the event to proceed. “It’s the largest check I ever wrote,” said Seth Doulton the Hollister Rally promoter in 2007 and 2008. “The Chief of Police in Pasadena, California pulled the same number when I attempted to establish a show at the Rose Bowl. They demanded a check for $20,000 the night before the event, because some Mongols might attend.” I never had an issue at either events.

Unless the city of Hollister can curb law enforcement extortion, the Hollister Rally will have a tough time. Seth Doulton was forced into bankruptcy after his second rally.

Monday morning Bandit and a known associate rolled out of the Harbor at the crack of ten or so after the mandatory road trip coffee. Destination Big Bear to retrieve a stretched out chopper called, Redemption. Some 30 minutes from headquarters the call came in: Performance Editor Line One…This is Ray….Incoming call, Stand By we have the 10.5 foot long Big Bear Redemption strapped mercilessly to a Kendon trailer for you test ride and report on. Are you ready for Redemption?

Hell Yes. Bring it on. Sounded like they we’re chuckling in the background?

In rolled a hot rod designed for a man at least 6 foot tall with long arms and the desire to look too cool for school. Hop on and we’ll see how ya look. Sit still we’ll take a picture. Well WTF? After picking the crew up off the dusty driveway. They were rolling around with the two black guard dogs howlin’ and laughin’ their asses off. The bike is not reachable for an old guy that’s barely 5 foot 6 on a sunny day, imagine that? Looks like the tall guys lucked out? Or did they? Time will tell..

Hey Big Bear, How about an FXR type hot rod built for speed, handling, stopping and agility? Mid controls? Flat tracker bars? Serious suspension and Horsepower? Now we’re talkin’ my language. How about a cross country ride? East coast to the west coast sounds like a nice ride in March after the Daytona show?

UNCLE MONKEY LETS A STAFF MEMBER GO–We had to let go one of our new employees. He seemed to be a great employee and a great guy. In the short time he was with us he proved himself more then capable but as time wore on it started to fray around the edges.

We didn’t question the week he missed when he said his son was sick though rumors were circulated about personal drug abuse. It all ended a couple weeks later when he came into work and said he needed to run home to get his cell phone. He never returned.

Even when one of my other techs seen him later that day and told him to phone into work we didn’t hear from him. We let him go the next day. In cleaning out his workspace the small empty packets of white powder began to shed some light. It literally was a straw that broke the proverbial camels back.

Drugs are in everyday life. Some are acceptable like caffeine and nicotine. Others are allowed in moderation like alcohol and marijuana. Some people can function everyday, even in positions of trust veiling their substance abuse to everyone. Others like my brother cannot function any more.

Alcohol consumes his life to the point he is living off welfare in our mother’s basement whining that society just won’t give him a break. For our dismissed employee cocaine was part of his every waking moment, and while he had been able to keep his house of cards up, the winds of change were sweeping in. His world is closing in around him, cornering him. He can lash out it, crumble between the rock and a hard place or reach for help.

I hope he finds a way out, a way to get out from under the weight of addiction. It is something I wish for everyone who suffers from addiction, any addiction whether it is drugs, gambling, women, or shopping. It clouds your judgement and drives those that love, care, are concerned, and employ you away. There is help. Everyone is extending their hand to help you. It isn’t an easy road or even a path you can travel down by yourself. Reach out before your life lets go.

BELL HELMETS TAKES POWERSPORTS INDUSTRY INTO UNCHARTERED TERRITORY WITH NEW ROGUE– The innovators at Bell that pioneered the first racing helmets in 1954, are blazing yet another new trail for the industry with the company’s latest category-defying product introduction. Today, Bell unveiled “Rogue,” a totally unique open-face helmet, designed to provide facial coverage from the elements that previously had not been provided by any other open-face helmet on the market.

Designed with the cruiser market in mind, but appropriate for a wide variety of motorcycling applications, Rogue addresses a long-standing gap in the market for an open-face helmet that provides increased coverage against the elements. Particularly useful in cold-weather conditions and for long-distance touring, Rogue is equipped with a first-of-its-kind, adjustable and detachable “muzzle” system, allowing riders increased comfort and protection against the elements. The muzzle benefits are also aesthetic, creating an ominous-look to the Rogue, ideal for the attitude and lifestyle synonymous with the cruiser category.

Rogue is based on a lightweight composite shell that looks like a half helmet, but is actually a three-quarter design, thanks to an EPS that extends from the rear portion of the shell into a comfortable neck roll pad.

The innovative muzzle is constructed from molded thermoplastic polyurethane, featuring air vents and a removable fleece liner for added comfort and protection. The muzzle fastens to the helmet through a FidLock magnetic connection system, easily fastened directly into the system’s magnetic receptors and removed by simply sliding the muzzle piece in an upward direction. Length is also adjustable through straps on either side of the muzzle that ratchet into the helmet shell.

The helmet’s shell and EPS are available in three sizes for more expansive size range and maximum comfort, with the liner being removable and washable. Rogue is DOT certified, and available in Solid Black, Solid Matte Black, Army Green and Solid Gunny finishes. Rogue is priced for retail at $249.95 and will be available at Bell dealers in March.

OFFICIAL S&S OIL NOW AVAILABLE–(Viola, WI) S&S Cycle announces the introduction of a new line of premium drive train lubricants for Harley-Davidson and other American v-twin motorcycles. This S&S premium line of lubricants was developed by a collaborative effort between S&S and Spectro Oils of Brookfield, CT.

S&S company president Steve Iggens explains, “The relationship between S&S Cycle and Spectro is a natural. The similarity in the approach that both companies take to product quality and customer satisfaction is striking. Both companies and their products are highly regarded in the market, and we both offer solid value to our customers.
